The harbor shall include all the waters of Lake Macatawa and all lagoons connected with such lake, lying within the City.

No person shall throw, discharge, dump or deposit any garbage or rubbish, as defined in Section 27-1 or any untreated sewage, dead animals, refuse of any kind or the effluent of any septic tank on the banks or into the waters of the harbor.

No person shall construct or alter any permanent dock, wharf, seawall, revetment, piling or fill in without compliance with federal statutes and regulations applicable to such activity.

No person shall allow any dock, wharf, pier or similar landing strip operated by him or her to fall into disrepair or to remain in a dangerous condition. Any such structure, when no longer in use, shall be deemed to be a nuisance and shall be posted in a manner approved by the Building Inspector and may be removed in the manner provided in Section 15.17 of the Charter of the City.

No person shall ski or tow water skiers within 500 feet from the shore of Lake Macatawa.

No person shall fish from any boat in any anchorage or in the ship channel, unless such person shall give the right-of-way to all passing craft legally in such places.

No person shall dive from, or swim in the waters near or adjacent to, any dock, wharf, pier, launching ramp or similar landing strip or property owned, controlled or operated by the City abutting Lake Macatawa unless such areas are expressly designated for diving or swimming. This section shall not prohibit maintenance or repair work on any dock, wharf, pier, launching ramp or similar landing strip authorized by the City Manager or his or her designated representative.

The City Manager, or his or her designated representative, is hereby authorized to construct, place or erect signs or other notices prohibiting diving and swimming in those areas designated in Section 13-6.1 hereof.

(a) 
Definitions. The following words as used in this section shall be defined as provided herein. All other words and phrases shall be defined as they are in the ordinary and customary usage.
(1) 
PERMIT — The daily or seasonal sticker or decal issued by the City of Holland evidencing payment of required fees for the use of the Kollen Park boat launch facility from the pay station located at Kollen Park.
(2) 
MOTOR VEHICLES — Any and all kinds or types of motor-driven or motor-propelled automobiles, trucks, motorcycles, motor scooters, mopeds, and any kind or type of off-road or all-terrain vehicle.
(3) 
LITTER — Any offal or refuse, including, but not limited to paper, cans, bottles, and animal feces.
(4) 
PETS — Dogs, cats, horses, or other domesticated animal or any other animal under the custody or control of a person.
(5) 
WATERCRAFT — Any and all kinds or types of flotation vessels designated for use on the water whether or not motorized, including, but not limited to, boats, canoes, kayaks, jet skis, ski-doos, pedal craft, pontoon boats, inflatable craft, tubes, or wind-propelled surf boards.
(6) 
KOLLEN PARK BOAT LAUNCH RAMP — The launch owned and operated by the City for purposes of launching and recovering watercraft at Kollen Park.
(7) 
POWER LAUNCHING/RECOVERY — Watercraft driven onto or off of trailers by the watercraft's propulsion system. This means that launched watercraft must be floated and the trailer then pulled out from beneath; and that recovered vessels must be floated onto or pulled onto the trailer by a winch or other mechanism.
(b) 
Required permit. No person shall use the Kollen Park boat launch ramp to launch any watercraft into or retrieve any watercraft from the waters of Lake Macatawa without first securing a permit ("permit") and paying the appropriate fee in an amount established by resolution of the Holland City Council.
(c) 
Posting of permit. The permit shall be visibly posted on the windshield or dashboard of the motor vehicle used to trailer or transport the watercraft to the Kollen Park boat launch ramp.
(d) 
Prohibited conduct. No person, firm, or corporation shall engage in any of the following conduct at the Kollen Park boat launch ramp:
(1) 
Occupy or use any portion of the Kollen Park boat launch ramp area for purposes of overnight camping.
(2) 
Utilize the Kollen Park boat launch ramp for any swimming or diving activities.
(3) 
Possess any type of fireworks or explosives within any portion of the Kollen Park boat launch ramp facility area.
(4) 
Allow a pet to run loose at any time within the Kollen Park boat launch ramp area. For purpose of this section, "allow a pet to run loose" shall mean that the pet is neither on a leash held by, nor otherwise under the immediate control, of the person in custody of the pet.
(5) 
Damage, destroy, deface, or remove any tree, shrub, planting, fence, sign, marker, or other equipment or structure, including the pay station, within the Kollen Park boat launch ramp area.
(6) 
Light or maintain a fire within the Kollen Park boat launch ramp area.
(7) 
Deposit or cause any litter to remain in the Kollen Park boat launch ramp area, including but not limited to any fecal material generated by the pets or animals under the control of any person.
(8) 
Fail to observe any of the requirements of the permit or fail to abide by the rules and regulations for the use of the Kollen Park boat launch ramp area.
(9) 
Leave unattended any launched or moored watercraft at any time.
(10) 
Engage in the practice of power launching or power recovery of any watercraft.
(11) 
The commercial use of the Kollen Park boat launch ramp area, including but not limited to the launching of commercial watercraft, dredge cranes or pile drivers by a marine contractor, and the maintenance of watercraft by a marina or other similar activities.
(e) 
Permit term. A permit may be terminated or revoked for violating any City ordinance provision; for violating any of the posted rules for use of the Kollen Park boat launch ramp; for damage to the ramp facility; or for any criminal act in connection with the use of that facility for a watercraft launch or retrieval at the Kollen Park facility. The City Manager may make such additional rules and regulations regarding the use of the Kollen Park boat launch ramp consistent with this section, the City Charter, the Ordinance Code, and the laws of the State of Michigan as may be necessary to promote and protect the health, safety, and welfare at the Kollen Park boat launch ramp.
(f) 
General penalties/civil infraction. Any person who violates or participates with another in a violation of any provision of this section is responsible for a Class I municipal civil infraction and subject to the provisions of Section 2-118 as a Class I civil infraction, including any costs which may be imposed by a court of competent jurisdiction. Each separate act in violation of this section (i.e., launching and retrieving are separate acts) shall be separate offenses. The service of citations or municipal civil infractions under this section may be served by personal delivery, by first class mail, or by affixing the citation to the vehicle, watercraft, or trailer in violation of this section. The City may also seek from a court of competent jurisdiction other remedies to prevent future violations and such other remedies as provided by Section 1-10.2 of the Ordinance Code.
In addition to the sanctions provided in this section for the violation of its provisions, any person who is determined to be responsible for a municipal civil infraction because of any damage that he or she has caused to the Kollen Park boat launch facility area shall reimburse the damage for which the person is responsible, and if that person is responsible for an act of vandalism (including but not limited to graffiti), that person shall reimburse the City for up to three times the amount of damages, as determined by the court.
