This Charter shall be submitted to
the voters of the City of O'Fallon at the General Municipal Election
to be held on April 7, 2009. The election shall be administered by
the officials now charged with the responsibility for the conduct
of municipal elections.

All of the provisions of this Charter
shall become effective upon the adoption of this Charter and shall
become effective on the convening of the first meeting of the newly
constituted City Council held after the General Municipal Election
on April 7, 2009.

The Mayor and each City Council member
in office on the date this Charter is adopted shall continue in office
until the expiration of his or her term of office and until his or
her successor is elected and installed. Within fifteen (15) days after
the General Municipal Election of April 7, 2009, the City Council
shall canvass the returns of the election, declare the results thereof,
and induct into office the City Council members declared elected.
Thereupon the newly elected City Council members, together with those
who continue to serve their terms of office, shall forthwith become
the official governing body of the City and shall conduct the first
meeting of the newly constituted City Council.

A.
At its first meeting, or at any meeting
held within sixty (60) days thereafter, the City Council may adopt
temporary Ordinances to deal with cases in which there is an urgent
need for prompt action in connection with the transition of government
and in which the delay incident to the appropriate Ordinance procedure
would probably cause serious hardship or impairment of effective City
government. Every temporary Ordinance shall be plainly labeled as
such but shall be introduced in the form and manner prescribed for
Ordinances generally.
B.
A temporary Ordinance may be considered and may be adopted, with or without amendment, or rejected at the meeting at which it is introduced. A temporary Ordinance shall become effective upon adoption or at such later time preceding automatic repeal under this subsection as it may specify, and the Referendum power shall not extend to any such Ordinance. Every temporary Ordinance, including any amendments made thereto after adoption, shall automatically stand repealed as of the ninety-first (91st) day following the date on which it was adopted, and it shall not be readopted, renewed or otherwise continued except by adoption in the manner prescribed in Section 3.10 for Ordinances of the kind concerned.

A.
Within forty-five (45) days from the approval of this Charter by the voters of the City of O'Fallon, the City Council shall appoint an Apportionment Commission consistent with the requirements of Section 3.2(B)(1) of this Charter. Notwithstanding any other provision of this Charter to the contrary, within one hundred twenty (120) days of its appointment, the Apportionment Commission shall prepare a plan of Wards, which plan shall include a plan for the reapportioning and redistricting of the City into five (5) wards, and shall present that plan, together with a report explaining it, to the Mayor and City Council. Within sixty (60) days of the presentation of the plan of Wards to the City Council the Council shall, by ordinance, reapportion and redistrict the City into five (5) wards. Such reapportionment and redistricting of the City shall be in effect for the General Municipal Election held in the City in 2010.
B.
City Council positions filled by the April
2009 General Municipal Election will serve two (2) year terms. After
redistricting, as required by this Charter, any City Council position
scheduled for the April 2010 General Municipal Election will be for
a three (3) year term. Any City Council position scheduled for the
April 2011 General Municipal Election will be for a three (3) year
term.
C.
In 2010, as a result of redistricting,
the two (2) new City Council positions shall be filled by election.
The candidate receiving the higher vote total shall be elected for
a term of three (3) years. The candidate receiving the next highest
vote total shall be elected for a term of one (1) year.

The purpose of the provisions of Article 14 is to provide a transition from the present government of the City of O'Fallon, Missouri, to the new government provided for in this Charter and to inaugurate the new government under the provisions of this Charter. They shall constitute a part of this Charter only to the extent and for the time required to accomplish that aim.
