The City Manager, as Chief Executive Officer of the City, shall develop, administer and promulgate such policies, rules and regulations, as he/she may deem appropriate, for the efficient operation of the City's personnel system.

The City Manager shall appoint such officers and employees, except for the positions of City Clerk and City Treasurer, as may be necessary for the management of City affairs. All appointive officers shall hold their tenure of office subject to the pleasure of the City Manager. The City Manager may also combine offices, delete offices and/or assign additional duties.

All appointments and promotions of City Officers and employees shall be made solely on the basis of merit and fitness as demonstrated by examination or other evidence of competence. In the interim, the City Manager may appoint as a temporary measure a deputy, department employee or other person who shall fill such office vacancy until a suitable person may be appointed to such office.

A. 
As specified in City ordinances and State or Federal law, no person shall be appointed to or removed from or in any way favored or discriminated against with respect to any City position or appointive City administrative office because of race, color, religion, sex, sexual orientation, gender identity, national origin, ancestry, age, disability, genetic information, or political affiliations.

B. 
No person shall willfully make any false statement, certificate, mark, rating or report in regard to any test, certification or appointment under the personnel provisions of this Charter or the rules and regulations made thereunder or in any manner commit or attempt to commit any fraud preventing the impartial execution of such provisions, rules and regulations.

No person who seeks appointment or promotion with respect to any City position or appointive City administrative office shall directly or indirectly give, render or pay any money, service or other valuable thing to any person for or in connection with his/her test, appointment, proposed appointment, promotion or proposed promotion.
D. 
Any person who by himself/herself or with others willfully violates any of the provisions of Subsections (A) through (C) shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine or by imprisonment or both as established by law or ordinance.

A. 
It is unlawful for any person falsely to represent himself/herself to be an officer or employee of the City or, without lawful authority, to exercise or attempt to exercise any of the duties, functions or powers of an officer or employee of the City.
B. 
No person shall interfere with or obstruct any officer or employee of the City in the performance of his/her official duty.

Within budget limitations, the City Manager shall employ such personnel as may be required and shall prescribe such rules and regulations and personnel policies as he/she may deem advisable. The employment of City personnel shall be on a non-partisan basis.

The compensation of all officers and employees of the City shall be in accordance with a budget, duly adopted by the Council, for the current year. Such compensation shall be in lieu of all fees or funds receivable from any source whatsoever and all fees and funds shall be paid into the City Treasury.

Every officer of the City shall report annually to the City Manager on the first (1st) of January and shall embrace a full report of the activities of their respective offices and such other matters as may be required by the City Manager and Council.

No officer of the City shall contract any debt or incur any obligation for or on account of the City or purchase any supplies for any department of the City without express authority to do so.

The City accepts the provisions of the Workers' Compensation Act, together with all laws supplementary or amendatory thereto, in connection with any liability on the part of the City to its employees.

It shall be the duty of each officer and employee, when for any reason vacating his/her office or employment, to promptly deliver to his/her successor all of the records, books, papers, funds, etc., pertaining to his/her office. Failure to comply with the provisions of this Section shall constitute a misdemeanor.
