A Planning and Zoning Commission for the City is established with the duties and responsibilities as are hereinafter set out in this Chapter.

For the purpose of this Chapter, the following terms are defined as follows:
COMMISSION
The Planning and Zoning Commission established by this Chapter.
STREETS
Any public ways.
SUBDIVISION
The division of a parcel of land into two (2) or more lots or other divisions of land; it includes resubdivision and, when appropriate to the context, relates to the process of subdividing or to the land or territory subdivided.

The Commission shall consist of ten (10) members and shall include the Mayor or his/her Council designee, a member of the City Council and eight (8) citizens appointed by the Council. The City Manager shall interface with the Commission upon request and/or may approach the Commission if and when he/she deems necessary. The Director of Community Development, or his/her designee, shall attend all planning and zoning meetings and shall have the right to take part in discussion but may not vote. All citizen members shall serve without compensation. The term of each of the citizen members appointed under this Chapter shall be four (4) years; which shall have staggered beginnings and termination dates. All expiring terms shall terminate on the first Monday of October. Any vacancy in the membership shall be filled for the unexpired term by appointment by Council. The Council may remove any citizen member for cause stated in writing and after public hearing.

The Commission shall select its Chairman and Secretary from among its citizen members. The term of Chairman and Secretary shall be for one (1) year with eligibility for re-election. The Commission shall hold regular meetings and special meetings as they provide by rule and shall adopt rules for the transaction of business and keep a record of its proceedings; these records shall be public records. The Commission shall appoint the employees and staff necessary for its work and may contract with the City planners and other professional persons for the services that it requires. The expenditures of the Commission, exclusive of grants and gifts, shall be within the amount appropriated for the purpose by the Council.
