The Village Board of the Village of McGraw recognizes that the operation of vehicles known as "all-terrain vehicles" ("ATVs") can, under certain circumstances, cause excessive noise to the detriment of occupants and owners of residential and other premises within the Village. It is the intent of this chapter to ensure the right to the quiet of residential and other premises within the Village. It is the intent of this chapter to ensure that the right to the quiet enjoyment of property is maintained.
For purposes of this chapter, the teen "ATV" shall include, without limitation, four-wheelers, dirt bikes, off-highway motorcycles, and snowmobiles.
No ATV shall be operated for recreational use within the Village of McGraw. Any use of ATVs within the limits of the Village of McGraw must be for utilitarian purposes only, examples of which include, but are not limited to, use in snow plowing or hauling wood. All ATVs must possess an intact muffler matching the manufacturer's specifications for that ATV, and modification of the ATV in any way that increases its noise output is strictly prohibited.
The penalties for the violation of this chapter shall be those specified for violations under Article 45, § 1800, of the Vehicle and Traffic Law of the State of New York.
