Except as otherwise specifically provided in this chapter, all statutory provisions in Chs. 340 to 350 and § 941.01, Wis. Stats., and all provisions in Chs. Trans. 146, 300, 304, 305 and 326, Wis. Adm. Code, describing and defining regulations with respect to vehicles and traffic, including penalties to be imposed and procedure for prosecution, are hereby adopted and by reference made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute or Administrative Code provision incorporated herein by reference is required or prohibited by this section. Any future amendments, revisions or modifications of the statutes or Administrative Code provisions incorporated herein are intended to be made a part of this section.

(1) 
Definition. For purposes of this section, "heavy traffic" shall be defined as:
(a) 
All vehicles not operating completely on pneumatic tires; and
(b) 
All vehicles or combination of vehicles, other than motor buses, designed or used for transporting property of any nature and having a gross weight of more than 8,000 pounds.
(2) 
Prohibited routes. Heavy traffic is prohibited from using any Village street or highway not designated as a heavy traffic route. This section shall not act to prohibit heavy traffic from using Village streets or highways for the purpose of obtaining orders or moving or delivering supplies or commodities to or from any place of business or residence which has an entrance on a street or highway not designated a heavy traffic route. An exception is leaving or returning to the terminal or place of garaging of any such vehicle. When it is necessary for the operator of such a vehicle to travel upon a street not designated as a heavy traffic route, the operator shall leave and reenter heavy truck routes at the point closest to his immediate destination. This section will not act to prohibit heavy traffic from using a federal or state trunk highway. Village-owned or operated equipment, or equipment contracted by the Village, is specifically excluded from the provisions of this section.

(3) 
Administration. The Chief of Police shall administer this section.
(4) 
Posting of signs. Signs shall be posted for heavy traffic routes. Yellow signposts may also be used to designate heavy traffic routes.

(5) 
Liability. Any operator, corporation, owner, or agent whose heavy traffic vehicle damages any Village streets or highways in violation of this section shall be required to pay any repair or replacement costs.

(6) 
Streets designated Class "B" highways. All streets and highways within the Village are designated Class "B" highways, subject to the weight limitations and forfeitures imposed on Class "B" highways by the Wisconsin Statutes adopted by reference in § 7.01, except the enumerated highways or parts of highways in Subsection (7) below are designated as heavy traffic routes.
(7) 
Heavy traffic routes. The following streets are designated as heavy traffic routes under the provisions of § 349.17, Wis. Stats.:

Where signs indicate, at intersections vehicles shall yield the right-of-way to vehicles on the intersecting street in accordance with § 346.18(6), Wis. Stats.

The following intersection is a controlled intersection. Traffic control signals shall be installed thereon in conformity with the Wisconsin Official Traffic Control Device Manual, the provisions of this chapter and Wisconsin Statutes:
The intersection of Main Street with Second Street
(1) 
Four-hour limit. When signs are posted, no person shall park a vehicle for longer than four hours at any time between 8:00 a.m. and 6:00 p.m. daily.

Two-hour limit. When signs are posted, no person shall park a vehicle for longer than two hours at any time between 8:00 a.m. and 6:00 p.m. daily.

No parking zones.

(a) 
Parking is prohibited within 15 feet of the curb radius at an intersection unless otherwise designated for parking.
(b) 
Parking is prohibited closer than 15 feet to the near limits of a crosswalk.
(c) 
Parking is allowed in all other places, unless signed as a no parking area or curb is painted yellow.
(4) 
Municipal parking lots. The Village has the following municipal parking lots:

General parking limitations. No vehicle, except those with a valid winter parking permit per Subsection (6)(c), shall be parked in any municipal parking lot between 2:00 a.m. and 5:00 a.m. Any vehicle parked during this time period shall be subject to immediate removal and impoundment under the direction of the Police Department at the cost of the vehicle owner.

Winter parking regulations.

(a) 
Alternate side parking. No person shall park a vehicle on any public street in the Village between the hours of 1:00 a.m. and 6:00 a.m. during the months of December, January, February or March, except as follows:

On even-numbered days of the month, vehicles may be properly parked between the hours of 1:00 a.m. and 6:00 a.m. on the even-building-numbered side of the street.
2. 
On odd-numbered days of the month, vehicles may be properly parked between the hours of 1:00 a.m. and 6:00 a.m. on the odd-building-numbered side of the street.
3. 
Vehicles may be properly parked between the hours of 1:00 a.m. and 2:30 a.m. on those "downtown" streets enumerated in Subsection (6)(b).
4. 
Vehicles may be parked in the angled parking stalls on the north side of East Main Street adjacent to parcels 06061231001 and 06061231201 with the understanding that the parcel property owner(s) shall be responsible for snow and ice removal within 24 hours for the angled parking stalls.

(b) 
"Downtown" parking prohibited. The provisions of Subsection (6)(a)1 and 2 notwithstanding, no person shall park a vehicle on either side of any of the following public streets in the Village between the hours of 2:30 a.m. and 6:00 a.m. during the months of December, January, February or March:

1. 
Winter Parking Permit. A person may obtain a permit, with approval from the Police Department and Public Services Department, to park a particular vehicle in a municipal parking lot or on public streets during the times prohibited under Subsections (1) and (2) of this subsection. The permit will be issued under guidelines adopted by the Village Board. The guidelines will consider, among other things, the availability of alternative parking on private property, commuter ride sharing situations and individual special events involving late night or overnight visitors. To help offset administrative and enforcement costs an annual permit fee will be charged as set by the Village Board and included in the Village Fee Schedule.
2. 
Alternate side parking exception. The alternate side parking regulations of Subsection (6)(a) of this section shall not apply to public streets where parking is at all times already limited to one side.
(7) 
Stopping, standing or parking of vehicle prohibited. No person shall stop, stand or park any vehicle, whether attended or unattended, on school days between 7:30 a.m. and 8:30 a.m., and 3:00 p.m. and 4:00 p.m. on the north side of Academy Street from Second Street east to the alley between Center Avenue and Fourth Street.

(8) 
Handicapped. No person will park in areas designated for handicapped parking unless the vehicle displays special registration plates, identification cards or emblems issued by any state Department of Transportation, designating the vehicle as one used by a handicapped person.

Notwithstanding the provisions of § 346.48(2)(b)2., Wis. Stats., adopted by reference in § 7.01, school bus operators shall use flashing red warning lights when pupils or other authorized passengers are loaded or unloaded.

(1) 
Chief of Police authorized to install signs and signals. The Chief of Police is authorized to install appropriate standard traffic signs, signals and markings conforming to the State Department of Transportation rules.
(2) 
Removal of unofficial signs and signals. The Chief of Police has the authority granted by § 349.09, Wis. Stats., to remove a sign, signal, marking or device placed in violation of this chapter or § 346.41, Wis. Stats.
(1) 
Definitions. For purposes of this section, the following terms shall have the meanings indicated:
BICYCLE
A bicycle is a pedal-driven or motor-powered device with wheels attached to a frame.

PLAY VEHICLE
A coaster, skateboard, roller skates, roller blades, sled, toboggan, unicycle or toy vehicle upon which a person may ride.
(2) 
Bicycle registration and regulation.

(a) 
Registration. Bicycle owners may register their vehicle with the Police Department. A sticker is issued at the time of registration.
(b) 
Use of Military Ridge Bicycle Trail.
1. 
Wisconsin Administrative Code Ch. MR 45 adopted. Except as otherwise specifically provided in this chapter, the provisions of Ch. NR 45, Wis. Adm. Code, entitled "Use of Department Properties," describing and defining regulations with respect to use of lands, structures and property owned, under easement, leased or administered by the state, are adopted and by reference made a part of this chapter as if fully set forth.
(3) 
Riding in specified areas prohibited.
(a) 
No person shall operate or ride a bicycle or play vehicle in any of the following areas in the Village:
1. 
On either sidewalk adjacent to Main Street between Fourth Street and Washington Street; or
2. 
On any sidewalk adjacent to those portions of Third Street, Second Street, South First Street and Grove Street between Front Street and the east-west alley located north of Main Street; and
3. 
No person shall ride a skateboard in or on any Village property, except in areas designated as a skate park, or sidewalk areas listed in Subsection (3)(a)1 and 2. All other sidewalks may be used to travel to and from a destination. Jumps or impediment of any kind in or on any Village property including sidewalks is prohibited. See also Municipal Code § 19.03.

(b) 
No person shall operate or ride a play vehicle on any street or alley in the Village, except while crossing such street or alley at a crosswalk.
(4) 
Pedestrians have right-of-way. Operators or riders of bicycles, e-cycles and play vehicles shall yield the right-of-way to pedestrians using sidewalks.

(5) 
Penalty. The penalty for violation of this section is provided in § 25.04 of this Municipal Code.

(1) 
Statutes adopted. Except as otherwise specifically provided in this section, the statutory provisions describing and defining regulations with respect to snowmobiles in Ch. 350, Wis. Stats., are hereby adopted by reference and made part of this section as if fully set forth. Section 346.02(10), Wis. Stats., is also adopted by reference. Acts required to be performed or prohibited by such statutes are required or prohibited by this section.

Rules of the road. The adoption of § 346.02(10), Wis. Stats., by reference is intended to include the rules of the road as follows: §§ 346.04, 346.06, 346.11, 346.14(1), 346.18 to 346.21, 346.26, 346.27, 346.33, 346.35, 346.37, 346.39, 346.40, 346.44, 346.46 to 346.48, 346.50(1)(b), 346.51 to 346.55, 346.87 to 346.91, 346.92 (1) and 346.94(1) and (9).

(3) 
Additional regulations.
(a) 
Speed. No person shall operate a snowmobile on any public highway when allowed within the Village at a speed in excess of 10 mph.
(b) 
Hours of operation. No person shall operate a snowmobile within the Village between 10:30 p.m. and 7:00 a.m., except upon a public highway when allowed as authorized by the state statutes and this section or for the purpose of gaining access to or leaving such highway.
(c) 
Unattended snowmobiles. No person shall leave or allow a snowmobile to remain unattended on any public highway or property while the motor is running or with the starting key in the ignition.
(d) 
Operation on sidewalks, parks or pedestrianways prohibited. No person, for any reason, shall operate a snowmobile on any sidewalk, park or pedestrianway within the Village.[1]

MINIBIKE
Any self-propelled device primarily used for transportation or sport, including, but not limited to, motorcycles, go-carts, motorized/e-bicycles, off-the-road trail bikes and all-terrain vehicles.
(2) 
Provisions for minibike operation. No person shall operate a minibike in the Village in the following manner:
(a) 
At an unreasonable rate of speed.
(b) 
In any way so as to endanger the person or property of another.
(c) 
While under the influence of intoxicating liquor, fermented malt beverages, narcotics or other controlled substances.
(d) 
In a way that the exhaust of the motor makes an excessive or unusual noise.
(e) 
Without a functioning muffler.
(f) 
On private property without the consent of the owner or lessee. Failure to post private property does not imply consent for use.
(g) 
Between one hour after sundown and dawn.
(h) 
On or across a cemetery, burial ground, school or church property, without the consent of the owner.
(i) 
On any lands owned, operated or leased by the Village.

(1) 
Prohibited. No disassembled, dismantled, junked/abandoned, wrecked, inoperable or unlicensed motor vehicle shall be stored or allowed to remain in the open on a public street or public property in the Village for a period of more than five days unless it is in connection with an automotive sales, authorized junkyard or repair business enterprise located within a properly zoned area.
(2) 
Definitions.
MOTOR VEHICLE
Any self-propelled land vehicle which can be used for towing or transporting people or materials, including, but not limited to, automobiles, trucks, buses, motorized campers, motorcycles, motor scooters, mopeds, tractors, snowmobiles, etc.
(3) 
Junked/abandoned motor vehicle. Any motor vehicle which through disuse or failure to be used, remains in one location for a period of 48 hours or more when physically located on a public street or highway or on public property, or for five days or more when located on private property and in the ordinary public view or the view of neighboring persons or property owners, or a motor vehicle which has been reported as stolen to any law enforcement agency or a motor vehicle which does not have a current motor vehicle license will be designated as an abandoned motor vehicle. A motor vehicle will not be considered an abandoned motor vehicle when it is out of ordinary public view, the view of neighboring persons, construction equipment used for a Village project, or when designated as not abandoned by a duly authorized official of the Village pursuant to the municipal ordinance.
(4) 
Removal. Whenever the Chief of Police finds any such vehicle placed or stored in the open upon private property in the Village, he shall notify the owner of the property and/or owner of the vehicle of the intention of the Village to remove the vehicle. If such vehicle is not removed within 15 days after notice, the Chief of Police shall cause the vehicle to be removed, the cost of removal to be charged to the property from which it is removed, and such charges to be entered upon the tax roll as a special charge if not paid by the due date. Upon removal, the vehicle shall be stored in a junk or salvage yard or other suitable place for 30 days, and the owner thereof shall be notified if the name and whereabouts of the owner can be readily ascertained. At the end of 30 days, the vehicle shall be disposed of unless claimed by the owner. If such vehicle is claimed by the owner, all reasonable charges for handling and storage shall be paid by the owner.
(1) 
General. No person shall operate a vehicle having a gross weight greater than 10,000 pounds on Front Street between Third Street and Fourth Street.
(2) 
Exceptions. Subsection (1) does not apply to vehicles owned by the state, a county or the Village when vehicles are being used for the removal, treatment or sanding of snow or ice or are authorized emergency vehicles.

(1) 
Compression brakes prohibited. No person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of the motor vehicle.
(2) 
Defense. It shall be an affirmative defense to prosecution under this section that compression brakes were applied in an emergency and were necessary for the protection of persons or property.
(3) 
Emergency vehicles. Emergency vehicles are exempt from this section.

The penalty for violation of any provision of this chapter shall be a forfeiture or jail assessment, if required, including any costs, fees and surcharges imposed under Ch. 814, Wis. Stats.
(1) 
State forfeiture statutes. Any forfeiture for violation of § 7.01 shall conform to the forfeiture permitted to be imposed for violation of the statutes adopted by reference, including any variations or increases for subsequent offenses.

Local regulations. Except as otherwise provided herein, the penalty for violation of this chapter shall be as provided in § 25.04 of this Municipal Code.

(b) 
Persons convicted of parking violations under § 7.07(3) shall be subject to a penalty under § 25.04 of this Municipal Code. In addition to the forfeiture, the convicted person shall be assessed all towing and storage charges incurred by the Village.

(c) 
Except for violations referred to in Subsection (a) and (b) above, a person cited for a parking violation, including winter parking violation, who does not wish to contest the citation may make a $15 payment in lieu of a court appearance. Payment shall be made to the Mount Horeb Police Department, as instructed on the citation. Fines increase to $20 after five days of nonpayment. After 14 days of nonpayment the license plates associated with the violation are suspended. Handicap parking violation payment is $50. After 14 days of nonpayment, the license plates associated with the handicap parking violation are suspended.

Enforcement procedure. This chapter shall be enforced according to §§ 23.33, 66.0114, 345.11 to 345.61, 350.17 and Ch. 800, Wis. Stats.
(2) 
Deposit.

(a) 
Any person charged with a violation of this chapter may make a deposit of money, as directed by the charging officer, at the Police Department or office of the Clerk of Court or by mailing the deposit to such places. The person receiving the deposit shall notify the arrested person, orally or in writing, that:

If the person makes a deposit for a violation of a traffic regulation, the person need not appear in court at the time stated in the citation. The person will be deemed to have entered a plea of no contest and submitted to a forfeiture and penalty assessment if required by § 165.87, Wis. Stats., a jail assessment if required by § 53.46(1), Wis. Stats., plus any applicable fees in Ch. 814, Wis. Stats., not to exceed the amount of the deposit that the court may accept as provided in § 345.37, Wis. Stats. The person receiving the deposit will issue the person a receipt as required by § 345.26(3) Wis. Stats.
2. 
If the person fails to make a deposit for a violation of a traffic regulation or appear in court at the time stated in the citation, the court may enter a default judgment finding the person guilty of the offense.
(b) 
The amount of the deposit shall be determined in accordance with the deposit schedule adopted by the Wisconsin Judicial Conference and shall include the penalty assessment if required by Wisconsin Statutes, a jail assessment if required by § 302.46(1), Wis. Stats., and any applicable fees. If a deposit schedule has not been established, the officer shall require the alleged offender to deposit the forfeiture established by the Chief of Police, which shall include the penalty assessment, if required by Wisconsin Statutes, to the Police Department. Deposits for nonmoving violations shall not include the penalty assessment and may be mailed or brought to the Police Department.
(3) 
Petition to reopen judgment. When a person has been convicted on the basis of a forfeiture of deposit or a plea of guilty or no contest and the person was not informed as required under § 345.27(1) and (2), Wis. Stats., the person may, within 60 days after being notified of the revocation or suspension of the operating privilege, petition the court to reopen the judgment and grant him an opportunity to defend on merits. If the court finds that the petitioner was not informed as required under § 345.27(1) and (2), Wis. Stats., the court shall order the judgment reopened. The court order reopening the judgment automatically reinstates the revoked or suspended operating privilege.

(1) 
"Neighborhood electric vehicle" means a self-propelled motor vehicle that has successfully completed the neighborhood electric vehicle America test program conducted by the United States Department of Energy, and that conforms to the definition and requirements for low-speed vehicles as adopted in the federal motor vehicle safety standards for low-speed vehicles under 49 CFR §§ 571.3(b) and 571.500. "Neighborhood electric vehicle" does not include a golf cart.
(2) 
A person may operate a neighborhood electric vehicle on any Village street that has a speed limit of 35 miles per hour or less, subject to the following restrictions:
(a) 
The person operating the neighborhood electric vehicle must hold a valid Wisconsin operator's license or a valid operator's license from another state.
(b) 
The neighborhood electric vehicle must be licensed.
(c) 
Neighborhood electric vehicles are not permitted on Village sidewalks or in Village parks, except the paved trail in Grundahl Park.

Pursuant to § 349.215, Wis. Stats., the Village may choose to appoint adult school crossing guards for the protection of persons who are crossing a highway in the vicinity of a school. If appointed by the Village, the school crossing guards shall wear an insignia or uniforms that designate them as school crossing guards and shall be equipped with signals or signs to direct traffic to stop at school crossings.

Pursuant to § 349.217, Wis. Stats., the Village may choose to appoint traffic control attendants for the protection of persons who are crossing a highway in the municipality or county. Any appointment by the Village shall specify all dates, times, and locations, for which the appointment is valid. Any person appointed by the Village as a traffic control attendant shall receive prior training in traffic control and traffic safety before the appointment commences. If appointed by the Village, the traffic control attendants shall wear an insignia or uniform that designates the person as a traffic control attendant and be equipped with signals or signs to direct traffic.
