(1) 
Creation. An independent and nonpartisan Utility Commission is created to manage and operate the electric, water and sewer utilities of the Village.
(2) 
Membership; terms. The Utility Commission shall consist of seven Commissioners. Two of the seven Commissioners shall be Village Trustees, who shall serve on the Commission without additional compensation, and whose term shall be for one year. The remaining five Commissioners shall be residents of the Village, each of whom shall serve a seven-year term. These terms shall be staggered so that no more than one Commissioner's term shall expire each year.

(3) 
Appointments. The Village Board shall elect the Commissioners at its first regular meeting in September for terms to begin October 1. In the case of a vacancy on the Commission, the Board may appoint a Commissioner to fill the vacancy for the remainder of the term.
(4) 
Organization. The Commissioners shall choose a President and a Secretary.
(5) 
Powers of Commission.
(a) 
Charge and management. The Commission shall take entire charge and management of the Village electric, water and sewer utilities, and any other public utility authorized by the Board. The Commission shall have full authority to supervise the operation of the utilities, subject only to the general control and supervision of the Board, with the general control and supervision being exercised through the enactment and amendment of this section.
(b) 
Employees.

Utility Manager. The Commission shall appoint a Utility Manager and provide for the authority of the manager to act on behalf of the Commission.
2. 
Delegation of authority. The Commission may delegate its appointment and hiring authority under this subsection, along with its authority to fix compensation to the Board or Utility Manager.
(c) 
Rates, rules and regulations. The Commission shall have authority to fix rates and establish rules and regulations for the governance, management and operation of the utilities, subject to the jurisdiction of the Public Service Commission of Wisconsin and establish rules for the governance of its own procedures.
(d) 
Contract. The Commission shall have full authority to let bids and enter into contracts in the name of the Village.

(e) 
Other powers. The Commission shall have powers necessary or convenient to the management and operation of the Village public utilities. The Village intends the Commission shall have full authority over the utilities, unless that authority is specifically withheld by statute.
(6) 
Utility expenses. Utility expenses shall be reviewed and authorized for payment by the Commission at its regular meeting.

(7) 
Receipts and accounting. All receipts paid to the utilities shall be deposited and the record of deposit shall be given to the Treasurer. Separate accounts will be maintained for each utility and are subject to disposition by the Commission or its designee.

(8) 
The terms "management and control" or "management and operation" shall include, without limitation by enumeration, all authority related to the utility properties of the Village, and all authority related to managing the public utilities, except as specifically withheld by statute.

(1) 
Neither water or sewer service or the extension of water and sewer laterals shall be provided or installed by the Village to or on any premises located outside the Village limits, except under circumstances where the service extension provides a benefit to the Village. Decisions on requests for service outside the Village limits shall be made by the Village Board. Sewer service shall not be extended outside of the Village urban service area, and water service shall not be extended beyond the service territory established by this Code, except by amending this Code to amend the water service territory.
(2) 
Pursuant to the authority granted by § 66.0813(3)(a), Wis. Stats., water service outside the Village limits is limited to the following parcels:
(a)

(b) 
9908 CTH ID, parcel number 010/0606-113-9990-5.
(c) 
9920 CTH ID, parcel number 010/0606-113-8241-3.
(1) 
General procedure. Where special assessments for utility services are to be made against abutting or benefited property, the Village Board shall levy assessments in accordance with the provisions of § 66.0703, Wis. Stats., except as otherwise provided.
(2) 
Sewer assessments.
(a) 
The actual cost of installing, constructing or laying of sanitary sewer mains and appurtenances of the sewer district along or in any street, alley, highway or across any lot or parcel of land shall be charged in whole or in part to each lot or part of lot or parcel of land to be benefited thereby fronting or abutting upon the street, alley or highway or crossed by the sewer. Assessments on corner lots shall be determined by the Village Board.
(b) 
Where the amount assessed against any one lot or parcel of land for installation of sewer mains in accordance with Subsection (1) exceeds $500, the property owner, after assessment has been determined, shall have the option of paying the assessment in five equal annual installments. Unpaid balances will accrue interest at an annual rate to be determined by the Village Board, by notifying the Village Treasurer by October 1 before the assessment has been placed on the tax roll.

(3) 
Water main assessments. Where the amount assessed against any one lot or parcel of land for extension of water mains in accordance with Subsection (1) of this section and § 13.11 of this chapter exceeds $500, the property owner, after the assessment has been determined, shall have the option of paying the assessment in five equal annual installments, the unpaid sums to draw interest at the annual rate to be determined by the Village Board, by notifying the Village Clerk by October 1 before the assessment has been placed on the tax roll.
(4) 
Assessments on real estate to be conveyed. When any interest in real estate on which a special assessment has been levied is transferred, full payment of the total balance due, including all installments plus accrued interest, if any, shall be made at or prior to the transfer. In the event of nonpayment, the full balance due shall be placed on the next succeeding Village tax roll and interest shall be due from January 1 of that year.
