There is hereby established a Department of Planning, which shall have such other sections or divisions as from time to time may be authorized by the City Council.

The Department of Planning shall be responsible for the overall planning and development of the City including the preparation and maintenance of the Zoning Map, Official Map and Comprehensive Plan of the City; community development including zoning and other land use regulation ordinances; the preparation of special studies and the provision of information on the physical, social and economic characteristics of the City; housing and neighborhood preservations; the coordination of new development proposals and project approvals; and shall recommend long-range plans for the City and review all projects, plans and applications to insure compliance with all ordinances of the City concerning zoning, subdivision and development requirements; and such other duties as may be prescribed from time to time by the City Administrator.

A. 
There is hereby established the office of Director of Planning. The City Administrator may, only with the approval of a majority of the members of the City Council, appoint or remove the Director of Planning. The term of the Director of Planning shall continue from the date of appointment for an indefinite period of time or until such employment is terminated as provided herein. The Director, under the Administrator's supervision, shall have control and supervision over all employees assigned to the Department of Planning. The Director shall:

Interpret and enforce the zoning and subdivision ordinances[1] in a strict and uniform manner;

Determine if use is in compliance with the spirit of the ordinances;
3. 
Provide staff assistance to the Planning Commission;
4. 
Notify the Board of Adjustment of variations in zoning ordinances;
5. 
Develop long and short-range plans for future development of the community;
6. 
Receive input from or assist other departments;
7. 
Review development proposals to ensure conformance to ordinance regulations;
8. 
Approve re-occupancy permits in conjunction with Public Works;
9. 
Plan and assign work to division staff;
10. 
Prepare and administer the division budget;
11. 
Update official maps and data concerning the City;
12. 
Draft research and compile information concerning census, housing and business;
13. 
Ensure information is available to the community and general public;
14. 
Consult with applicants regarding the development review process and submission of request forms;
15. 
Institute and/or participate in special studies at the direction of the City Administrator, Planning and Zoning Commission or Council;
16. 
Represent the Planning Department at civic and public functions;
17. 
Perform such other duties as may be prescribed from time to time by the City Administrator;
18. 
Recommend capital improvements necessary to implement the long-range plans of the City in conjunction with other departments; and
19. 
Interpret and enforce, in conjunction with the Director of Public Works or other designated officials, all land disturbance ordinances, tree ordinances and other development ordinances of the City.

Serve as the City's Arborist as set forth by the Tree City USA requirements.

The Director of Planning shall have the power to order all work to be stopped on any building or structure where such work is being done in violation of any provision of the City zoning ordinance, subdivision ordinance or any building or development regulations.[1] Such stop orders may be given orally and may be enforced when so given; provided, however, that any oral stop-work order shall be followed by a written order within four (4) hours. All work that is stopped shall not be resumed except upon permission of the Director in any case involving the zoning, subdivision, land disturbance or development ordinances. Written stop orders may be served by the Director, his/her designee, or any Police Officer and may be served by personal service or by posting on the premises affected.
