A Wildwood Celebration Commission for the City of Wildwood is hereby established. The Commission shall consist of eight (8) citizen members determined and appointed by the Mayor, with the consent of the City Council, for a period of two (2) years commencing on January 1 of the year of their appointment and ending on December 31 of the year in which they complete their tenure as a Commission member, unless otherwise reappointed. Upon appointment and at the first meeting of the new Commission, the members shall choose the length of their terms by lot. Four (4) members shall serve for a one (1) year period, with the remaining four (4) members serving two (2) year terms. Again, all succeeding terms shall be for two (2) years. Members of the Commission shall serve voluntarily and without pay. At least one (1) member of the City Council, appointed by the Mayor, subject to approval by the City Council, shall serve as a voting member of the Commission. The Commission shall elect a Chairperson or two (2) Co-Chairpersons by a majority vote of the citizen members, with each member having one (1) vote. The Superintendent of Parks and Recreation of the City shall serve as the Vice Chairperson of the Commission and shall be operational liaison between the City and the Commission and shall be a voting member. Meetings of the Commission shall be held on a regular basis at a time and public place to be determined by the Commission. A quorum for the transaction of business at said meetings shall be a majority of the citizen members of said Commission. All meetings of the Commission shall be open to the public and posted by the City Clerk.

The Commission shall have the authority to organize and conduct the Wildwood Celebration event, including, but not limited to, establishing rules and conditions for participation by vendors, purchasing supplies and services, establishing the location(s) and advertising the event. The Commission shall be responsible for preparing and submitting for approval to the City Council a budget for the upcoming Wildwood Celebration, which budget shall be submitted no later than October 31 of each year.

A. 
The finances of the Commission (including the funds to be expended in the preparation for and conducting of the Wildwood Celebration, as well as the funds received from such Wildwood Celebration) shall be under the general supervision of the Commission subject to the following provisions:

Any funds expended by the City for use by the Commission shall not exceed amounts authorized by the City Council under its annual budget and shall be used for the payment of the City's miscellaneous expenses incurred in preparing for, conducting and cleaning up after the Wildwood Celebration, such expenses including, but not limited to, expenses relating to postage, signs, advertising, tent rental, traffic control, lumber, trash removal and other miscellaneous expenses and supplies connected with the Wildwood Celebration. The Director of Planning and Parks or his/her designee shall review and approve any City funds requested to be used by the Commission. Upon review and approval by the Superintendent of Parks and Recreation, the Director of Planning and Parks shall submit a purchase requisition for processing according to the City's purchasing policy and procedures.

The Commission shall be responsible for keeping accurate records regarding the receipt of revenues and expenditures of the Commission and promptly delivering all monies received to the Finance Officer for placement in a special City fund designated for this purpose. The Superintendent of Parks and Recreation of the Commission shall be responsible for monitoring the receipts and expenditures of the Wildwood Celebration. The Superintendent of Parks and Recreation shall maintain records for expenditures and receipts of the Commission. Any funds to be contributed or paid to the Commission by check shall be made payable designated to the order of "City of Wildwood - Wildwood Celebration Commission."

The Chairperson(s) of the Commission and Superintendent of Parks and Recreation shall present a financial report to the City Council at their first meeting in November or at such other times as the City Council may request. Such report shall contain a detailed accounting of the receipts and expenditures of the Commission regarding the immediately preceding Wildwood Celebration. Any remaining funds, in excess of those set aside for miscellaneous costs, shall be transferred, at the option of the City Council, to a separate City fund for the purpose of park improvements, City beautification or other designated purposes. The Commission may in its report recommend to the Council how any such excess funds should be used.

The City Administrator shall have the authority to approve or disapprove any activity of the Commission as necessary to ensure that the Commission is acting consistent with regulations and policies of the City.

Any person having a contract from the City authorizing such person to do business, perform services, or otherwise appear pursuant to contract at the Wildwood Celebration event shall be deemed to hold a temporary business license for the duration of the event, and no additional business license fee or business registration shall be deemed required for participation of the event.
