The purpose of this Section is to provide for the separation of recyclable and compostable items to aid and promote collection thereof and disposal by means other than deposit in a sanitary landfill or by burning.

A. 
Every occupant of every residence shall be responsible to separate recyclables from their respective premises from all other waste and compostables and store the recyclables in a recyclables containers furnished by the waste hauler or in clear plastic bags.
B. 
All recyclables shall be placed together in the recyclables container, all rinsed and reasonably free of food, dirt and other contaminants. If necessary to save space in the recyclables container, newsprint may be bundled separately and placed next to the recyclables container at curbside.
C. 
Residents, not more than twelve (12) hours prior to the day for scheduled collection of recyclables from their respective dwellings, shall place the recyclables containers at the curbside adjacent to the dwelling or garage accessory thereto and visible from the street in front of the dwelling. After the scheduled collection, the containers for recyclables and any recyclables not collected shall be removed from curbside by the resident no later than 12:00 Midnight on the day of collection.
D. 
The deposit of non-recyclables into a recyclables container, or removal of another person's recyclables from a recyclables container, or theft of a recyclables container, or removal of a recyclables container from another person's premises, or the deposit of recyclables and/or compostables into any container containing waste matter shall be deemed a violation of this Chapter.

A. 
Every resident shall separate compostables from all other waste. Compostables to be collected by the waste hauler shall be stored in biodegradable paper bags. Containers for compostables must be tightly sealed to prevent nuisance odors.
B. 
Plastic bag containers shall not be used for compostables collection.
C. 
All compostables may be placed together in the same compostables container as described in Subsection (A) above. However, tree waste [no longer than four (4) feet long] and branches may also be bundled and placed curbside on collection day.

A. 
Except as provided in Subsection (D), all collection of recyclables/compostables from the premises shall be by a waste hauler licensed by the City. Also, such collection shall be done in compliance with all other applicable ordinances of the City.
B. 
The collection of recyclables/compostables at curbside by a waste hauler not licensed by the City is prohibited.
C. 
A licensed waste hauler shall collect all recyclables from each customer at least once per week on the same day in accordance with schedules of and routes for collection as determined by the Director.
D. 
Neither the foregoing provisions of this Section nor any other provisions of this Chapter shall prevent any resident from discarding that resident's recyclables by delivering them to a recycling plant, centralized collection site, manufacturer, or other vender, or disposing of compostables by proper composting on-site or at an authorized location. The City may also designate a central collection site for the discarding of recyclables or compostables.

A. 
Recyclables and compostables which have been separated from other waste shall not, in any event:
1. 
Be deposited in any landfill;
2. 
Be burned in any incinerator; or
3. 
Be deposited or distributed in any way or manner which is contrary to the applicable law, Statute, Chapter, rule or regulation.
B. 
Provided, however, that the restrictions in Subsections (A)(1) through (2) above shall not apply to any recyclables or compostables which are deposited in a landfill or burned pursuant to specific prior written approval granted by the City, County or State governments.

A. 
The waste hauler shall submit a monthly summary of the quantity and kinds of recyclable and compostable materials collected and the primary purchaser(s) of those materials. Monthly summaries shall be submitted no later than the 15th day of the month following the month for which the report is submitted. A weight ticket showing tons of recyclables and compostables collected shall accompany each report.
B. 
The waste hauler shall provide access to the City, or any of its duly authorized representatives, to review any books, documents, papers and records of the waste hauler which are directly pertinent to this Chapter for the purpose of making an audit, other examination, and preparing excerpts and transcriptions.

The waste hauler shall dispose of recyclables at a local recycling and/or composting facility, if available, otherwise, it may sell recyclables and/or compostables to any purchaser of its choosing, unless otherwise directed by the City. The waste hauler shall be entitled to retain the proceeds of any sale thereof.

In order to promote recycling, each waste hauler licensed to haul residential waste shall educate and encourage its customers on the benefits of recycling.
