There is hereby created a Board of nine (9) members to be known
as the Park Board which shall have charge of the City parks. The members
of the Park Board shall be appointed by the Mayor with the approval
of the City Council, and they shall be chosen from the citizens of
the City at large with reference to their fitness for such office,
provided that no member or employee of the City Government shall be
a member of the Park Board, and not more than five (5) members shall
belong to the same political party.

Three (3) members of the Park Board shall be appointed each
year during the month of May to take office on the first (1st) day
of June next following their appointment, and they shall hold office
for three (3) years until their successors are appointed and qualify;
and vacancies on the Board, occasioned by any cause, shall be filled
in the same manner, the member being appointed to fill the vacancy
being appointed to serve the unexpired term of his/her predecessor.

As soon as practicable each year after the qualification of
the new members, the Park Board shall meet and elect a President and
a Secretary-Treasurer. The President shall be the Presiding Officer
of the Board and it shall be his/her duty to preside over the Board
and perform such executive duties as may be required of him/her. It
shall be the duty of the Secretary-Treasurer to keep a record of the
meetings, regular and special, of the Board, to keep a record of its
expenditures and accounts and the purposes thereof, and to perform
such other duties as may be required.

The Secretary-Treasurer of the Park Board shall make bond to
the City in the penal sum of one thousand dollars ($1,000.00) with
good and sufficient corporate surety licensed to do business in this
State. Such bond shall be conditioned that he/she will faithfully
perform all the duties imposed on him/her; that he/she will well and
truly account for and pay over to the City all money of the City coming
into his/her hands as Secretary-Treasurer of the Park Board; that
he/she will account for and turn over to his/her duly appointed and
qualified successor or the proper officer of the City at the expiration
of his/her term all money, books, records and any personal property
whatsoever belonging to and being the property of the City. The requirement
of the bond hereunder may be waived by the City Council upon proof
of sufficient insurance coverage.

The Park Board shall make and adopt such bylaws, rules and regulations
for their guidance and for the government of the City parks as may
be expedient, not inconsistent with State law or this Code or other
City ordinance, and as approved by the City Council.

The Park Board shall hold regular meetings once each month and
may hold such special meetings from time to time as they may deem
necessary upon the call of the President on the demand of three (3)
or more of the members thereof.

The Park Board shall have full and complete charge of the operation,
maintenance, repair and improvement of all parks under its jurisdiction.

All funds derived from the operation or properties under the
jurisdiction of the Park Board and such funds as may be derived by
taxation specifically for park purposes shall be deposited in a fund
to be known as the Park Fund which shall be kept by the City Treasurer
separate and distinct from all other funds of the City.

A. It shall
be the duty of the Park Board to keep books of account showing with
accuracy contemporaneous current entries of the receipts and expenditures
of the Board in such manner as to enable such entries to be understood
and investigated and also to preserve on file with its Secretary-Treasurer
duplicate vouchers for all expenditures. Such books and duplicate
vouchers shall at all times be opened to the examination of the City
Council or any appropriate committee appointed by the Council.
B. The Park
Board shall make reports of its business and transactions to the Mayor
and City Council at regular intervals.
C. It shall
be the duty of the Mayor and City Council to allow and order paid
such accounts in the same manner as the bills and salaries of other
officers and employees of the City are allowed and paid, provided
that payment shall be made out of the Park Fund and the checks thereon
shall be drawn only by the Mayor and City Clerk.
