Prior to the design and construction of a sewer extension, the developer requesting the sewer extension must submit to the Village an approved final plat or certified survey for lands to be sewered. Plats and certified surveys must be accompanied by a certification from appropriate town and county zoning officials stating that the land is zoned for the proposed use.
The developer must obtain written confirmation from the Southeastern Wisconsin Regional Planning Commission that lands to be sewered are in the approved Village of East Troy sewer service area.
Sewer extension requests may be considered by the Village if all downstream sewers, interceptors, lift stations, force mains, and treatment facilities have sufficient reserve capacity to accommodate the wastewater flows and loads anticipated to be generated by the proposed sewer extension. The Village reserves the right to reject the application for a sewer extension if insufficient capacity exists in the downstream wastewater facilities. Evaluation of the capacity of the downstream wastewater facilities will be conducted by the Village's Engineer at the expense of the developer.
The developer may select an engineer to design all proposed sewer extensions. The resulting construction plans and specifications shall be reviewed and approved by the Village's Engineer prior to submittal to the WDNR. All plans shall conform to the standards of the WDNR and such additional requirements and standards that the Village may establish. All costs for the design of the sewer extension, including review of the plans and specifications by the Village's Engineer, shall be paid by the developer.
All costs and expenses incidental to the design, construction, and installation of the sewer extension, including but not limited to engineering, construction, legal, permits and other fees related to the project or associated with the connection or hookup to the Village wastewater collection system, shall be borne by the developer requesting the extension. The developer shall establish an escrow account, or other security acceptable to the Village, in a bank selected by the Village and shall initially deposit in the account sufficient funds to cover all preliminary expenses authorized by the Village. The account shall be subject to an agreement executed between the developer, the bank and the Village which allows the Village to withdraw monthly amounts from the account sufficient to cover payments then due. The developer will make subsequent deposits into the account at the direction of the Village sufficient to cover the remaining costs of the project.
The developer requesting the sewer extension shall assist in securing all required utility easements, the location and width of which shall be determined by the Village. The Village will furnish blank easement forms to the person who will be responsible for the proper legal description of the easement parcel and for the proper execution of the easement by the grantor. All completed easements shall be submitted to the Village, designated as the grantee, for its review and shall be recorded at the appropriate county's Register of Deeds office by the Village, the cost of such recording to be charged to the developer.
The project as approved must include the installation of building sewers, extending from the connection at the sanitary sewer to the lot line of each lot as shown on the approved final plat or certified survey map. This shall be included in the developer's costs and made a part of the proposed project.
All persons performing work on the wastewater facilities, including but not limited to work on the installation of sewer extensions, shall hold a valid license with the State of Wisconsin and said license shall be in good standing with the State of Wisconsin. All persons performing work on the wastewater facilities, including but not limited to work on the installation of sewer extensions, shall provide a bond to guarantee performance and shall maintain liability insurance, with minimum coverage to meet the Village's then current requirements. All certificates of insurance shall name the Village as an additional insured. No work may be conducted prior to the submittal of and approval by the Village of the required bond and insurance.
During the construction of any sanitary sewer extension which the Village has approved, the Village, or an authorized representative thereof, will inspect the same to see that said work is being constructed in accordance with the approved plans and specifications. Failure to make such inspections shall not nullify the right of the Village to require reconstruction should nonadherence to approved plans and specifications be subsequently discovered. All costs associated with inspection of the sewer extension construction shall be paid by the developer.
Following completion of sewer extension construction, complete and accurate record drawings shall be prepared and submitted to the Village. The engineer selected by the developer shall prepare the record drawings. The contractor who performed the work shall keep detailed records of all record drawing information as required by the project specifications and shall submit such information to the engineer for use in preparation of the record drawings. The record drawings shall be submitted to the Village for review and approval. Lateral cards shall be prepared and submitted to the Village for every building sewer installed. The format and details of all lateral cards shall comply with the standards established by the Village. Additionally, the Village's master sewer map shall be updated to reflect all sanitary sewer extensions. The master map shall be updated by the Village's Engineer or its authorized representative, with the cost of said work being paid by the developer.
A connection fee shall be applied to each building sewer. The cost of the connection fee shall be paid by the developer. Connection fees shall be determined in accordance with § 400-93 of this chapter.
