It shall be unlawful for any person to create or maintain a
noise disturbance.

A person commits the offense of peace disturbance if he/she
unreasonably and knowingly disturbs or alarms another person by loud
noise or commits other offenses as defined elsewhere in this Code.

The following words, terms and phrases, when used in this Article,
shall have the meanings ascribed to them in this Section, except where
the context clearly indicates a different meaning:
An area that has been assigned a commercial or industrial
zoning district designation by the City, except for the areas within
fifty (50) feet of a residential structure that are included in the
definition of "residential zone".
Either:
Any area of the City containing such institutional uses as
schools, government offices, hospitals, medical offices, churches,
recreational areas and similar related public or semi-public buildings,
areas and uses where the public congregates on a regular or irregular
basis, except for the areas within fifty (50) feet of a residential
structure that are included in the definition of "residential
zone".
Any sound from any source which:
Any individual, association, partnership or corporation and
includes any officer, employee, department, agency or instrumentality
of a State or any political subdivision of a State, including Police
Officers.
An imaginary line along the ground surface, together with
its vertical extension, which separates the real property owned by
one (1) person from that owned by another person, but not including
intra-building real property divisions.
A district that has been assigned a residential or public
use zoning designation by the City, including any area in any zoning
district which adjoins a residential zone and is within fifty (50)
feet of a residential structure.

A.
Notwithstanding
any other provision of this Article, a person may undertake without
penalty, construction on, repairs to or maintenance of property within
one thousand (1,000) feet of a residence or hospital when such construction,
repairs or maintenance may otherwise create a noise disturbance during
the following hours:

In emergency situations that threaten the interest of public health or safety, the Building Inspector may issue an emergency permit to extend the hours for property repairs beyond the hours specified in Subsection (A) of this Section. The permit may be granted for a period not to exceed three (3) days while the emergency continues. The permit may be renewed for additional periods not to exceed three (3) days while the emergency continues.

A.
The
following acts are declared exempt from the noise ordinance:
1.
The operation of emergency and Police vehicles responding to calls
for service and the operation of emergency equipment thereto.
2.
The conduct of any policy, military, City administration or emergency
services exercise, simulation or training.
3.
The conduct of any parade, march, carnival, circus, show, fair, festival
or bazaar having obtained the required licenses and permits and otherwise
complying with the provision of this Code.
4.
The operation and conduct of any City or public construction or project
work other than between the hours of 6:00 A.M. and 7:00 P.M.

The creating of any excessive noise on any street adjacent to
any hospital, school, institution of learning, church or court which
interferes with the workings of such institution or which disturbs
or annoys patients in a hospital shall be deemed a violation of this
Article.

Any person violating any of the provisions of this Article shall
be deemed guilty of a misdemeanor and upon conviction shall be punished
as provided for in this Code.
