The sale or offering for sale or exhibiting or possessing with
intent to give away, sell or offer to sell within the Town of LeRoy
of fireworks, firecrackers, blank pistol, rifle or shotgun cartridges,
implements for the use of same, or fireworks of any kind by any person,
firm, partnership, joint venture, limited liability company, limited
liability partnership, association, corporation or other entity is
hereby prohibited.
A.
The display, exhibition, discharge, explosion or shooting of fireworks,
firecrackers, cannons or blank cartridges by any person, firm, partnership,
joint venture, limited liability company, limited liability partnership,
association, corporation or other entity within the corporate limits
of the Town of LeRoy is hereby prohibited, unless conducted directly
by the Town of LeRoy as approved by the Town Board or the Town Board
has given prior written permission therefor to the exhibitor.
B.
Pursuant to Penal Law § 405.00(1) of the State of New York,
the Town Clerk is hereby designated the "permit authority" to grant
and issue permits for the public display of fireworks, subject to
the further approval of the applicant by the Town Board. The application
procedure shall be in full accordance with Penal Law § 405.00.
Any person or entity violating the provisions of this chapter
shall be subject to a fine not exceeding $250. For the second such
offense charged within five years from conviction of the first such
offense, the fine shall not exceed $500.
