This article shall be known and may be cited as the "Town of
Lewiston Disposal or Dumping of Garbage, Rubbish and Refuse Law."
A.
It shall be unlawful for any person, persons, firm or corporation
to place, store, deposit, dispose of or dump or cause to be placed,
stored, deposited, disposed of or dumped, for the purpose of abandonment,
old junk, metal, bricks, concrete, blacktop, glass or glass bottles,
stones, plaster, lumber, automobiles, automobile bodies or parts thereof,
metal tanks, barrels, metal containers, swill, garbage or waste material
of any nature on any public or privately owned lot, tract of land,
street, lane, alley or park within the Town of Lewiston.

B.
No person, persons, firm or corporation shall deposit, dispose of
or dump or cause to be deposited, disposed of or dumped anywhere in
the Town of Lewiston any of the aforementioned materials which may
be collected from any place or premises situated outside of the Town
of Lewiston.
C.
This article does not apply to any person, persons, firms or corporations
placing garbage or trash at the curb, streetside or at any authorized
disposal site for regularly scheduled municipal garbage and trash
collection or adequately storing such garbage or trash until the next
regularly scheduled municipal garbage and trash collection.
D.
This article does not apply to disposal of waste, garbage, trash or any other materials outlined in § 293-32A at an authorized State of New York Department of Environmental Conservation permitted facility.
E.
Trees, branches, stumps and brush.

No person, persons, firm or corporation shall cause to be disposed
of by placing at the curb, street side or at any authorized disposal
site for regularly scheduled municipal collection any trees, stumps,
tree branches or brush where the owner of the property has contacted
for the cutting down and removal of same. In such cases, it is up
to the property owner and the contractor to make arrangements for
such disposal. It shall be unlawful for any Town of Lewiston personnel
or equipment to be used for this purpose.

This section shall not apply to homeowners who contract for normal
grass cutting, trimming, and brush/leaf cleanup of their yards.
Any person, persons, firm or corporation violating the provisions
of this article shall, upon conviction thereof, be punished by a fine
of not less than $2,500 or imprisonment for a term not to exceed 15
days, or both, for each such offense. Each such violation of this
article may also be separately prosecuted pursuant to the Penal Law
and Environmental Conservation Law of the State of New York. Each
day such violation continues shall constitute a separate violation
and shall be punished separately pursuant to this article.
