For the purposes of this chapter:
AGRICULTURAL
The use involving the production of plants and animals useful to humans, including forages and sod crops; grains, feed crops and field crops; dairy and dairy products; poultry and poultry products; livestock, including breeding and grazing of cattle, swine and similar animals; berries; herbs; flowers; seeds; grasses; nursery stock; fruits; vegetables; Christmas trees; and other similar uses and activities.
ALLEY
A dedicated public way of 20 feet or more in width, affording secondary access to abutting property and not intended for general traffic circulation.
BLOCK
Property abutting one side of a street and lying between the two nearest intersecting streets, or between the nearest such street and railroad right-of-way, unsubdivided acreage, lake, river or stream, or between any of the foregoing and any other barrier to the continuity of development.
BOARD
The Chesterfield Township Board.
BUILDING LINE or SETBACK LINE
A line parallel to a street right-of-way line established on a parcel of land or on a lot for the purpose of prohibiting construction of a building between such line and a right-of-way, other public area or the edge of a lake, stream or riverbank.
CAPTION
The name by which the plat is legally and commonly known.
CLERK
The Chesterfield Township Clerk.
COMMISSION
The Chesterfield Township Planning Commission.
COMPREHENSIVE PLAN or MASTER PLAN
The basic plan for the township, including graphic and written material indicating the general locations recommended for streets, parks, schools, public buildings, zoning districts, and all physical developments of the township, including any unit or parts of such plan separately accepted or adopted and any amendments to such plan or parts thereof in use by the planning commission.
COUNTY PLAT BOARD
The register of deeds, who shall act as chairperson; the county clerk, who shall act as secretary; and the county treasurer. If the offices of county clerk and register of deeds have been combined, the chairperson of the board of supervisors shall be a member of the plat board and shall act as chairperson. In a county where a board of auditors is authorized by law, such board may elect to serve on the county plat board by adopting a resolution so ordering. A copy of the recorded resolution shall be sent to the state treasurer.
DEVELOPMENT SITE
Any parcel or lot on which exists or which is intended for building development other than the following:
(a) 
Agricultural use involving the production of plants and animals useful to humans, including forages and sod crops; grains, feed crops and field crops; dairy and dairy products; poultry and poultry products; livestock, including breeding and grazing of cattle, swine and similar animals; berries; herbs; flowers; seeds; grasses; nursery stock; fruits; vegetables; Christmas trees; and other similar uses and activities.
(b) 
Forestry use involving the planting, management or harvesting of timber.
DIVISION
The partitioning or splitting of a parcel or tract of land by the proprietor thereof, or by his or her heirs, executors, administrators, legal representatives, successors or assigns, for the purpose of sale, or lease of more than one year, or of building development that results in one or more parcels of less than 40 acres or the equivalent, and that satisfies the requirements of sections 108 and 109.[1] Division does not include a property transfer between two or more adjacent parcels, or property taken from one parcel added to an adjacent parcel; and any resulting parcel shall not be considered a building site unless the parcel conforms to the requirements of this act or the requirements of an applicable local ordinance.
EASEMENT
A specific area of land over which a right, privilege or advantage is granted by the owner to a person, firm, corporation or the public for specific uses and purposes and which shall be designated as a public or private easement.
ENGINEER
A civil engineer who is a professional engineer licensed under Article 20 of the Occupational Code, Act No. 299 of the Public Acts of 1980, being Sections 339.2001 to 339.2014 of the Michigan Compiled Laws.
EXEMPT SPLIT
The partitioning or splitting of a parcel or tract of land by the proprietor thereof or by his or her heirs, executors, administrators, legal representatives, successors or assigns that does not result in one or more parcels of less than 40 acres or the equivalent. For a property transfer between two or more adjacent parcels, if the property taken from one parcel is added to an adjacent parcel, any resulting parcel shall not be considered a building site unless the parcel conforms to the requirements of this act or the requirements of an applicable local ordinance.
FLOODPLAIN
That area of land adjoining the channel of a river, stream, water course, lake or other similar body of water which will be inundated by a flood which can reasonably be expected for that region.
FORTY ACRES OR THE EQUIVALENT
Forty acres, a quarter-quarter section containing not less than 30 acres, or a government lot containing not less than 30 acres.
GOVERNING BODY
The Chesterfield Township Board.
GREENBELTS OR BUFFER AREAS
As defined in the Chesterfield Township Zoning Ordinance.
IMPROVEMENTS
Grading, street surfacing, curb and gutter, sidewalks, crosswalks, water mains and lines, sanitary sewers, storm sewers and drains, fire hydrants, culverts, bridges, utilities, parks and other additions to the natural state of the land which increase its value, utility or habitability.
LAND DIVISION ACT
The State Land Division Act of 1967, being Act 288, P.A. of 1967, as amended.
LANDSCAPING EASEMENT
A strip or parcel of land, privately restricted or publicly dedicated as open space, located between incompatible uses for the purpose of protecting and enhancing the residential environment.
LOT
A measured portion of a parcel or tract of land, which is described and fixed in a recorded plat.
MAJOR STREETS OR THOROUGHFARE PLAN
The township right-of-way requirements which set forth the location, alignment and dimensions of existing and proposed streets and thoroughfares.
MUNICIPALITY
A township, city or village.
OUTLOT
When included within a boundary of a recorded plat, means a lot set aside for purposes other than a development site, park, or other land dedicated to public use or reserved to private use.
PARCEL
A continuous area of acreage of land which can be described as provided for in the State Land Division Act.
PARENT PARCEL or PARENT TRACT
A parcel or tract, respectively, lawfully in existence on the effective date of the amendatory act that added this subdivision.
PERFORMANCE GUARANTEE
Any security, including cash, corporate surety bonds, or irrevocable bank letters of credit or other similar performance guarantees acceptable to the township board, for required subdivision improvements that will be installed by the proprietor.
PLANNED UNIT DEVELOPMENT
Shall be as defined in the Zoning Ordinance.
PLAT
A map or chart of a subdivision of land.
(a) 
PRELIMINARY PLATA map showing all requisite details of a proposed subdivision submitted to an approving authority for purposes of preliminary consideration, in conformance with State Land Division Act, this chapter, and any other applicable township codes, ordinances, rules or regulations.
(b) 
FINAL PLATA map of all or part of a subdivision providing substantial conformance to the preliminary plat of the subdivision prepared in conformance with the requirements of the township's subdivision regulations and the Subdivision Control Act and suitable for recording by the county register of deeds.
PROPRIETOR
A natural person, firm, association, partnership, corporation, or combination of any of them which may hold any ownership interest in land, whether recorded or not.
PUBLIC OPEN SPACE
Land dedicated or reserved for use by the general public, including parks, parkways, recreation areas, school sites, or community building sites.
PUBLIC UTILITY
All persons, firms, corporations, co-partnership, or municipal or other public authority providing gas, electricity, water, steam, telephone, sewer, or other services of similar nature.
PUBLIC WALKWAY
Right-of-way dedicated to public use, which crosses a block to facilitate pedestrian access to adjacent streets, open spaces or properties.
REPLAT
The process of changing, or the map or plat which changes, the boundaries of a recorded subdivision plat or part thereof. The legal dividing of an outlot within a recorded subdivision plat without changing the exterior boundaries of the outlot is not a replat.
SECRETARY
The secretary of the township planning commission.
SKETCH PLAN
Shall be as described in section 58-13 of this chapter.
STREET
Any avenue, boulevard, road, lane, parkway, viaduct or other way which is an existing state, county or municipal roadway, or any road or way shown in a plat heretofore approved pursuant to law. A street, as defined above, includes the land between the right-of-way lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, sidewalks, parking areas and lawns.
(a) 
MAJOR THOROUGHFAREAn arterial street of great continuity which is intended to serve as a large volume trafficway for both the immediate municipal area and region beyond, and may be designated in the township thoroughfare plan as a major thoroughfare, parkway, freeway, or equivalent term to identify those streets comprising the basic structure of the street plan.
(b) 
COLLECTOR STREETA street intended to serve as a major means of access from minor streets to major thoroughfares, including principal entrance streets to large-scale developments.
(c) 
LOCAL STREETA road of limited continuity used primarily for access to abutting residential properties.
(d) 
MARGINAL ACCESS STREETA local street parallel to and adjacent to a major thoroughfare which provides access to abutting properties and protection from thru-traffic.
(e) 
BOULEVARD STREETA street developed in two, one-way pavements separated by a median.
(f) 
TURNAROUNDA short boulevard street permanently terminated by a paved area with sufficient outside radius to permit vehicular turnaround appropriate for this particular type of street.
(g) 
CUL-DE-SACA short minor street having one end permanently terminated by a vehicular turnaround.
(h) 
LOOP STREETA minor street of short length with two openings to traffic, beginning from the same street, and projecting parallel to each other and connecting at their termination by a loop.
SUBDIVISION or SUBDIVIDE
The partitioning or splitting of a parcel or tract of land by the proprietor thereof or by his or her heirs, executors, administrators, legal representatives, successors, or assigns for the purpose of sale, or lease of more than one year, or of building development that results in one or more parcels of less than 40 acres or the equivalent, and that is not exempted from the platting requirements of this act by sections 108 and 109.[2] Subdivide or subdivision does not include a property transfer between two or more adjacent parcels, if the property taken from one parcel is added to an adjacent parcel; and any resulting parcel shall not be considered a building site unless the parcel conforms to the requirements of this act or the requirements of an applicable local ordinance.
SURVEYORS
A professional surveyor licensed under Article 20 of the Occupational Code, Act 299 of the Public Acts of 1980, being Sections 339.2001 to 339.2014 of the Michigan Compiled Laws.
TOWNSHIP
The Charter Township of Chesterfield, Macomb County, Michigan.
TOWNSHIP ENGINEER or ENGINEER
The staff engineer or consulting professional engineer employed by the township.
TOWNSHIP PLANNER or PLANNER
The staff planner or consulting professional community planner employed by the township.
TRACT
Two or more parcels that share a common property line and are under the same ownership.
ZONING ORDINANCE
The Charter Township of Chesterfield Zoning Ordinance, as amended.
