It shall be unlawful and in violation of this Article to conduct, stage, organize and operate any music festival, concert, exhibition or show as hereinafter described and to be held in any street, house or place in the City without first applying for and obtaining a license from the Board of Aldermen.

This Article shall be effective as to music festivals, concerts, exhibitions and shows of which the attendance may be expected to exceed fifty (50) persons and which is scheduled to be staged, operated and run continuously for any period exceeding two and one-half (2½) hours, between 12:01 A.M. to 12:00 P.M. on any given day.

It shall be unlawful for any promoter to allow, permit, encourage, promote, organize or advertise any music festival, concert, exhibition or show unless a valid City permit is first obtained therefore. A separate permit shall be required for each music festival, concert, exhibition or show.

Written application for a permit to conduct and operate a music festival, concert, exhibition or show shall be made to the Board of Aldermen. Such application shall be submitted sixty (60) days or more prior to the date upon which such music festival, concert, exhibition or show is to be, or may be, held. Application for the permits herein provided shall be conditionally approved or denied within forty-five (45) days after the application has been filed. Failure by the Board of Aldermen to act within such period shall constitute approval of the application. If the application for the permit is not approved and the permit is denied, the denial shall be in writing setting forth the reasons for the denial. The decision of the Board of Aldermen shall be final. With each application for a permit to conduct a music festival, concert, exhibition or show, the applicant shall pay an application fee of two hundred fifty dollars ($250.00) for each three (3) hour period of operations and concerts; such fees shall be used by the City for the payment of its general expenses at the direction of the City and no part of such fee shall be remitted to the applicant.

The application for license shall be by an individual or by an officer of any firm or corporation in person before the Board of Aldermen at any regular or special meeting.

A. 
Application for license will contain the following:
1. 
The name of the individual or firm or corporation which is sponsoring the music festival, concert, exhibition or show.
2. 
If the sponsor of the music festival, concert, exhibition or show shall be a corporation, a complete list of its officers and directors, together with a copy of its Articles of Incorporation and Certificate of Incorporation.
3. 
The duration of the music festival, concert, exhibition or show.
4. 
The location of the music festival, concert, exhibition or show.
5. 
The expected number of individuals attending the gathering, together with a list of the performers at the gathering.
6. 
A complete list of the sanitation facilities to be provided at the gathering including toilet facilities, trash disposal facilities, medical facilities, water facilities, camping facilities, eating facilities, etc.
7. 
What, if any, the promoters will have to maintain order and discipline during the gathering.

The license issued shall not be sold, assigned, transferred or disposed of in any manner to others by the licensee, and said licensee shall be liable for any lawful acts done herein and whether or not performed by the licensee.

Whenever in this Chapter any act is prohibited or is made or declared to be unlawful or an offense or an ordinance violation, or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or an ordinance violation, where no specific penalty is provided therefore, the violation of any such provision of this Chapter shall be punished by a fine or imprisonment. Every day any violation of this Chapter shall continue shall constitute a separate offense.
