A. 
Within one (1) year from the date of burial there shall be placed a permanent marker for the individual grave space for anyone being buried in Union Park Cemetery in Chaffee, Missouri.
B. 
For grave spaces being utilized within the following described area, there shall be special restrictions and regulations with regard to the placement of such permanent marker. Within the following described area a permanent marker shall be placed and shall identify the grave space and person buried therein with said marker being flush with the ground. No part of the grave marker shall extend above the surface of the ground so as to impede maintenance and care of said cemetery. The following description is a description of the perimeter of such area:
A tract or parcel of land lying in and being a part of the N.½ S.W.¼ of Section 17, T.29N., R.13E., Scott County, Missouri being more fully described by metes and bounds as follows:
Commencing at the S.E. corner of the N.W.¼, S.W.¼ of Section 17, T.29N., R.13E., Scott County, Missouri; thence N. 0°15E. on and along the W. 1/16 Section line of Section 17 a distance of 467.82 feet to the point of beginning; thence S.55°12'50"W. a distance of 249.62 feet to a point; thence N.37°53'11"W. a distance of 19.48 feet to a P.C. of a curve to the left having a radius of 60 feet; thence northwesterly on and along said curve a distance of 41.35 feet to the P.T. of said curve; thence N.77°22'44"W. a distance of 41.22 feet to a point; thence N.39°06'11"E. a distance of 57.23 feet to the P.C. of a curve to the left having a radius of 100 feet; thence northeasterly on and along said curve a distance of 28.65 feet to the P.T. of said curve; thence N.22°41'15"E. a distance of 142.10 feet to the P.C. of a curve to the right having a radius of 100 feet; thence northeasterly on and along said curve a distance of 31.21 feet to the P.T. of said curve; thence N.40°34'04"E. a distance of 85.07 feet to the P.C. of a curve to the right having a radius of 40 feet; thence northeasterly on and along said curve a distance of 28.23 feet to the P.T. of said curve; thence N.81°00'35"E. a distance of 29.27 feet to the P.C. of a curve to the right having a radius of 80.00 feet; thence southeasterly on and along said curve a distance of 18.48 feet to the P.T. of said curve; thence S.85°45'28"E. a distance of 31.16 feet to the P.C. of a curve to the right having a radius of 80 feet; thence southeasterly on and along said curve a distance of 38.45 feet to the P.T. of said curve; thence S.58°13'14"E. a distance of 39.55 feet to the P.C. of a curve to the right having a radius of 40 feet; thence southeasterly on and along said curve a distance of 31.84 feet to the P.T. of said curve; thence S.12°36'44"E. a distance of 47.45 feet to the P.C. of a curve to the right having a radius of 40 feet; thence southwesterly on and along said curve a distance of 39.99 feet to the P.T. of said curve; thence S.44°40'09"W. a distance of 65.85 feet to the P.C. of a curve to the right having a radius of 140 feet; thence southwesterly on and along said curve a distance of 25.77 feet to the P.T. of said curve; thence S.55°12'50"W. a distance of 12.02 feet to the point of beginning.
Containing in all one and sixty-two hundredths (1.62) acres more or less.
Subject to a ten (10) foot road easement along the inside perimeter of the above described property and all other easements affecting the same.

A. 
Rules, regulations and policies for the operation and maintenance of the Union Park Cemetery are hereby established, and such rules, regulations and policies shall be created by the Cemetery Committee along with the Cemetery Administrator, subject to approval by the City Council of the City of Chaffee, Missouri. The Cemetery Committee shall consist of four residents of the City of Chaffee and one Councilperson (each appointed by the Mayor with the approval of the City Council). The members of the Cemetery Committee shall serve until the first meeting of the City Council of the City of Chaffee in June of even-numbered years and until his/her successor is duly appointed and qualified.
B. 
The rules, regulations and policies created by the Cemetery Committee and the Cemetery Administrator shall be placed in written form, and, upon the purchase of a cemetery lot in the Union Park Cemetery, the purchaser shall receive, at the time of purchase, a copy of the written rules, regulations and policies affecting said cemetery.
C. 
The rules, regulations and policies shall be amended as necessary and the amendments be placed in writing and delivered to purchasers of lots as required above. Said amendments shall be made at the discretion of the Cemetery Committee and the Cemetery Administrator of the City of Chaffee, upon approval of the City Council.
D. 
The rules, regulations and policies in effect as of the date of the adoption of this Section shall be those as previously established by the City Council. Those rules, regulations and policies may be modified, changed or repealed as set forth hereinabove by the Cemetery Committee along with the Cemetery Administrator and subject to the approval of the City Council of the City of Chaffee, Missouri.

A. 
There is hereby established the position of Cemetery Administrator who shall be responsible for supervision of the sale of cemetery lots in the Union Park Cemetery, and further shall mark individual grave spaces and oversee the interment of bodies and erection and placement of grave markers upon the various gravesites. The Cemetery Administrator further shall assist the other various City Officials of the City of Chaffee in the management, bookkeeping and administration of the Union Park Cemetery.
B. 
Appointment And Compensation For Cemetery Administrator. The Cemetery Administrator shall be appointed by the Mayor upon approval by the majority of the Council of the City of Chaffee, Missouri. The Cemetery Administrator shall maintain the position for a period of two (2) years with said term being construed to have begun on April 1, 1989, and said term shall extend for said two (2) year period and thereafter until a successor is duly appointed and qualified. The Cemetery Administrator shall receive compensation in the amount of two hundred dollars ($200.00) per month for the services performed in that position.

Individual grave spaces shall be sold from the Union Park Cemetery, Chaffee, Missouri, at the rate of two hundred dollars ($200.00) for each individual grave space. Payment shall be made to the Collector of the City of Chaffee with said funds being deposited to the Perpetual Care Cemetery Fund.

There is hereby established a fund for the preservation, care, upkeep and adornment of Union Park Cemetery, Chaffee, Missouri, such fund to be known as "Perpetual Care Cemetery Fund" which may accept and acquire by gift or donation, money or funds to be placed to the credit of such Perpetual Care Cemetery Fund.

The City of Chaffee hereby accepts any gift or donation to the Perpetual Care Cemetery Fund and further provides that all such gifts and donations and monies or funds received by the City from the sale of lots in the Union Park Cemetery shall be placed by the Treasurer of the City of Chaffee to the credit of such Perpetual Care Cemetery Fund.

Monies and funds placed in the Perpetual Care Cemetery Fund shall be invested from time to time at the direction of the City Council in bonds of the United States Government or of the State of Missouri or placed in any bank or savings and loan association which is authorized to do business in this State and which funds so deposited are protected by Federal deposit insurance.

A. 
The City Council, in its sole discretion, shall expend the income received from the Perpetual Care Cemetery Fund for the preservation, care, upkeep and adornment of the Union Park Cemetery and for no other purpose whatsoever. The principal of the Perpetual Care Cemetery Fund shall not be encroached upon for any purpose whatsoever and no monies shall be transferred out of such Perpetual Care Cemetery Fund except for the purpose of being invested as provided herein.
B. 
The Cemetery Committee of the City Council of the City of Chaffee shall supervise said Perpetual Care Cemetery Fund and advise the City Council, at least annually, as to the status of such fund and recommended investments and expenditures.
