The purpose of this Chapter is to establish the procedure which shall govern the operation of a Farmers' and Artisans' Market (hereafter referred to as the Market) operated by the City of Union, Missouri for the benefit of the citizens within the Union, Missouri area.

The Market shall be located at the parking lot owned by the City of Union on Locust Street or such other location as the City Administrator may from time to time designate.

The Market shall be open and available for use on each Friday evening from 3:00 to 7:00 P.M. and Saturday morning from 7:00 A.M. to 12:00 P.M., during the months of April, May, June, July, August, September, and October. The Market may be open during other days and times as the City Administrator may from time to time designate.

The City of Union shall only provide the space at which the Market shall be located. All parties wishing to display any items at the Market shall first register with the office of the Director of Community Development. No fee shall be charged for said registration. The City shall not be responsible for assigning spaces or regulating locations. Spaces shall be on a "first-come, first-serve basis" unless a space is assigned by the Market manager designated by the City. The City of Union shall not be responsible to any seller or buyer with regard to the condition of any product.

Only fresh fruits and vegetables which are locally grown may be offered for sale at the Market. Under no circumstances may produce which bas been purchased from another producer or grower be offered for sale by a vendor at the Market. The sale of produce by commercial growers or producers is expressly prohibited. In addition to fresh fruits and vegetables, crafts and any other food item, which complies with State Law and Franklin County Health Department regulations, may be sold. The City of Union, through its City Administrator or other designated official, reserves the right to periodically inspect the operation of the Market and the items being sold therein.
