These definitions are in alphabetical order and clarify terminology
used in these regulations.
Any shelter reservation or athletic field reservation with
limited impact on City resources, traffic, public property, or other
public infrastructure. This does not include weddings on public property,
which are considered "events."

Any beverage containing any alcohol content greater than
zero percent (0%).
Any sound which is increased to a decibel level above the
normal mechanical output of the originator of that sound.
Carnival rides, climbing devices, petting zoo and similar
attractions.
Individuals or organizations that apply for an activity or
event permit.
The act of approving or ratifying an application for an activity
or event by the City Administrator, or his designee, or the Community
Land and Recreation Board so as to cause an activity or event permit
to be issued to the applicant.

Facilities designed for athletic play, including, but not
limited to, baseball/softball diamonds, football fields, soccer fields,
basketball courts, volleyball courts, tennis courts, pickleball courts,
running tracks and horseshoe pits.

A shoe specifically designed for and typically worn by a
player participating in a particular sport; such shoe shall not have
metal spikes or metal cleats.
The elected Governing Body of the City.
The City of Parkville, Missouri.
The advisory board which is appointed by the Mayor of the
City and approved by the Board of Aldermen and functions to assist
the Director of Parks and Recreation for planning, event coordination
and tree and community land management.
The character and nature of exhibits, booths, vendors, entertainment,
amusement and all other attributes of an activity or event.
The alteration of real property and its appurtenances or
personal property so as to destroy or reduce the functionality of
such property for its intended purpose.
The City employee or designee who has primary responsibility
for the operation and performance of the City Parks and Recreation
Department. This person may be referred to simply as "Director" within
these regulations.
Any animal that is in the company of or is the property of
a person; and such animal is not wildlife indigenous to the area in
an unconstrained setting.
Any activity defined as an event in the guidelines for events in Parkville pursuant to Section 140.345.

A designated City employee who receives all applications
for events, determines applicable usage fees for the event, makes
recommendations for application changes to the applicant and then
approves the application when satisfied that all aspects of the event
application meet the event criteria set forth in the event guidelines.
The ERC will forward the approved application to the Director for
further approval. The ERC may delegate its evaluation and communications
with the applicant functions to the events subcommittee whenever deemed
necessary by the ERC or the Director. The ERC shall in all instances
make the final recommendation to the Director with regard to approval
or denial of all event applications.
A standing subcommittee of the Community Land and Recreation
Board in accordance with the bylaws of that Board.
The aggregate number of persons reasonably expected to attend
and/or be a member of an activity or event over its permitted duration.

Individuals or organizations acting on behalf of others for
a fee and profit motive to obtain activity or event permits; also
referred to as "event planners" and "party planners."
A group of persons who are assembled on City property for
a similar and specific recreational purpose with a predetermined beginning
and ending date and time; further defined as "private" gatherings
which include attendees specifically invited to attend a specific
gathering on City park property. There can be no public advertising
or promotion associated with a "private" gathering. "Public" gatherings
on City property are open to the general public, and its attendees
often are aware of the gathering because of advertising and promotion.
Note: Gatherings on private property are not included in this definition
or subject to these regulations. Gatherings of persons at a City-recognized
"homeowners' association functions," even if held on a City (public)
street, with intoxicating beverage consumption are not included in
this definition or subject to these regulations.
A publication issued by the Community Land and Recreation Board, with the consent of the Board of Aldermen, pursuant to Section 140.345, which sets forth requirements for events held within City limits.

A natural person at least twenty-one (21) years of age; further
defined as resident (a person whose primary residence is within the
City limits) or non-resident (a person whose primary residence is
outside of the City limits).
To throw or place or cause to be thrown or placed any glass,
glass bottles, wire, nails, tacks, cans, garbage, trash, refuse or
rubbish of any kind, nature or description in or upon park property.
Anything which is injurious to the safety, health or morals
of the users of a park or other public property, or is indecent or
offensive to the senses, or causes an obstruction to the free use
of park or other public property so as to interfere with the comfortable
enjoyment of park or other public property by such users.
Any limited-liability company, partnership, association or
corporation registered to do business in the State of Missouri and
in good standing with the Missouri Secretary of State.
An organization having an eleemosynary purpose and a documented
exemption from Federal income taxes as determined by the Internal
Revenue Service.
The Governing Body of Federal (U.S. only), States, Counties,
Cities, Towns, Villages and public school districts.
Individual or organization who has an applicant that has
applied for and received an event.
Director may close all or part of a park property for event,
safety, etc., and it may be closed entirely or closed for certain
uses for a period of time as determined by the Director of Parks and
Recreation simply by posting of signs to that effect or by other means
which make it obvious that any City park or portion thereof is closed
to the public entirely or closed for certain purposes. Police may
close any portion or all of a park or parks for emergency reasons.
All portions of a park property, including, but not limited
to, shelter houses, stages, picnic tables, trails, athletic fields,
parking areas, vegetation of all kinds planted or occurring naturally,
wetlands, bodies of water and any other structures or areas located
upon park property.

Every facet of work assigned to the Parks and Recreation
Department, whether in a City park or related to the recreation aspect
involving park personnel on park property or within the confines of
the park.
All real property, including all improvements and facilities
thereon, designated by the City for use by the general public as a
park and/or recreation area and which is operated in accordance with
regulations adopted by the City and maintained by the Parks and Recreation
Department as a park and/or recreation area.
The City department which has primary responsibility for
park operations and policies. (Also see "Director of Parks
and Recreation.")
For the purposes of this Chapter, the term "Parkville Nature
Sanctuary" includes the Parkville Nature Sanctuary, the Sullivan Nature
Sanctuary, and the White Alloe Creek Conservation Area.

A written fee-based license issued by the Parks and Recreation
Department allowing the holder of the permit to use park property
for an activity. All activity permit applications are made to the
Parks and Recreation Department or its designee. All permits provide
rules applied to each activity.[1]

A written fee-based license issued by the City of Parkville
allowing the holder of the permit to use public or private property
for an event.

Any sign or visual and readable notice located within a park
property which states a rule(s) which are in effect for that park
property. Postings shall be considered to be within park property
if located no more than fifty (50) feet outside of the entrance to
or boundary of that park property.
The act by an individual or organization of applying to the
Parks and Recreation Department for a permit to occupy a park facility
by an approximate number of persons for a specific period of time.
A fee is charged to the applicant by the City for this reservation.
A Law Enforcement Officer in good standing in his/her jurisdiction
or appropriately trained employee of a company which is licensed to
provide security services within the City. Security personnel must
be contracted for and assigned to a specific gathering.
Smoking means possessing a lighted or ignited tobacco, nicotine
product or paraphernalia; or engaging in an act that generates smoke
(including, but not limited to, possessing a lighted or ignited pipe,
hookah pipe, cigar, electronic cigarette or cigarette of any kind);
or lighting or igniting a pipe, hookah pipe, cigar, electronic cigarette
or a cigarette of any kind. Smoking includes the use of any product
which emits smoke in the form of gases, particles, vapors or other
byproducts released by electronic cigarettes, tobacco cigarettes,
herbal cigarettes, marijuana cigarettes and any other type of cigarette,
pipe or other implement for the purpose of inhalation of vapors, gases,
particles or their byproducts released as a result of combustion or
ignition.

A facility located upon park property which is used primarily
for musical or theatrical performances.
Any walking trail, exercise path or walking surface maintained
for pedestrians within a park.
Every device in, upon or by which a person or property is
or may be transported or drawn, either electric or battery operated
or operated by internal combustion engine, except those exclusively
by rails. Bicycles, skateboards and personal transporters are considered
to be vehicles. A wheelchair, when used to transport a physically
handicapped person, is not considered to be a vehicle.
Operating, driving or placing a vehicle on any park property
surface or area which is designated for vehicular driving, operating
or parking. The legitimate use of a wheelchair, either motorized or
manual, by a physically handicapped person is not considered to be
a vehicular use.
Selling of food, beverage, merchandise, goods or services
of any kind to the general public.
Include all sellers of merchandise (including artists), service,
or food/beverages. Vendors also include carnival/amusement ride services.

All City-maintained parks shall be open for public use and enjoyment.
The hours of operations shall be as follows:

Platte Landing Park and English Landing Park: 5:00 A.M. to 12:00
Midnight every day.

Those who have been issued a fishing permit may fish in accordance
with the permit.

Platte Landing Park shall be closed from 12:00 Midnight to 5:00
A.M. to individuals except for the sole purpose of loading and launching
boats and only for such period of time necessary to load and launch
a boat.

Gresham Memorial Fountain: 5:00 A.M. to 12:00 Midnight.

Pocket Park: 5:00 A.M. to 12:00 Midnight.

Watkins Park: 8:00 A.M. until one-half (1/2) hour after dusk
every day of the week.

Adams Park: 8:00 A.M. until one-half (1/2) hour after dusk every

The possession or consumption of alcoholic beverages is prohibited
in City parks, except when otherwise approved as part of the conditions
of the permit.
Smoking in or around playgrounds, sports complex dugouts, bleachers and spectator areas, permanent restroom facilities and the Parkville Farmer's Market, during its operation, is prohibited unless otherwise permitted by the Board of Aldermen or an approved special event permit issued in accordance with Section 140.345, Guidelines for Events in Parkville.

No person in a park shall paste, glue, tack or otherwise post
any sign, placard, advertisement or inscription whatever, nor shall
any person erect or cause to be erected any sign whatever on any public
lands or highways or roads adjacent to a park.

No camping shall be permitted in any City park at any time except
with special permission of the Board of Aldermen or the City Administrator.

No person shall deface, damage, injure or destroy any City building,
bridge, fence, wetland, or other City enclosure, gate, gatepost, grounds,
lamp, lamppost, fireplug, hydrant, railing, sign, tree, box or any
other City park property by breaking, cutting, hacking, pulling down,
tearing, marking, daubing with paint or other substance or in any
other way or manner defacing, damaging or injuring or destroying said
property.

No person in a park shall damage, cut, carve, transplant or
remove any tree or plant or injure the bark or pick the flowers or
seeds of any tree or plant, nor shall any person attach any rope,
wire or other contrivance to any tree or plant. A person shall not
dig in or otherwise disturb grass areas or in any other way injure
or impair the natural beauty or usefulness of any area.

Persons shall not engage in disorderly conduct or any conduct
tending toward a breach of peace or engagement in any violent, tumultuous,
offensive and disorderly conduct by threatening, quarreling, challenging
to fight or any fighting in public or by using obscene or offensive
profane language.

All domestic animals must be kept on a leash within the boundaries
of any City park, except in designated off-leash dog park areas.

"Migratory fowl" shall mean, for the purposes
of this Section, any species of birds, not otherwise defined as a
domesticated animal, commonly known as swans, geese, ducks and any
other water fowl falling under the jurisdiction of the Missouri Conservation
Commission or otherwise defined as migratory fowl.

No person shall build any fire in any City park in any place
other than in ovens, stoves or other fireplaces provided for that
purpose by the City, except as specified as a condition of the permit.
All fires built by any person must be extinguished before that person
leaves the fire area.

No firearms or bows and arrows shall be permitted in any part of
a City park except in the case of any City police officer or law enforcement
personnel in his/her jurisdiction and except bow and arrow hunts authorized
by the Board of Aldermen. Firearms may be transported through Platte
Landing Park for use in other areas where hunting is permitted.

B.Â
No
person other than Police Officers authorized by law shall use, carry
or possess any crossbow or slingshot, air gun, spring gun, BB gun
or any other weapon in which the force used to propel projectiles
is gunpowder, air, compressed air or springs or any instrument that
can be loaded with and fire blank cartridges on any City park system
property except as otherwise permitted by this Chapter. No person
shall discharge a firearm or other weapon into park areas from beyond
park boundaries.

The use or possession of fireworks of any kind on City parkland is only permitted as part of an approved special event permit issued in accordance with the guidelines for events in Parkville pursuant to Section 140.345.

Food and beverages having no alcoholic content are allowed for
picnics if disposed of properly.

No person shall play any game of chance or have possession of
any instrument or device for gambling on City park property. It shall
be unlawful for any person in a park or recreation area to play, engage
or take part in any game or competitive sport for money or other valuable
thing.

Horses shall not be permitted in any City park at any time except
with special permission of the Community Land and Recreation Board.

All vehicles with the exception of emergency personnel and maintenance
vehicles shall make use of roadways provided for such usage and not
any other portion of the park.

No persons or organizations shall use the park for the purpose of
any event or activity which will interfere with or exclude the usage
of a portion of the park by other members of the public, unless that
group or organization shall have first obtained from the City the
following:

Pet owners must pick up pet or animal waste and dispose of such
in a proper container as provided in the park.

No park picnic tables, barrels or other appurtenances shall
be moved from their specific locations without prior consent of the
Director.

Parking
shall be permitted only in those areas specifically designated as
parking areas.

Parking
is specifically prohibited on the grass or other non-paved areas of
any City park unless specifically authorized by the Director of Parks
and Recreation.

Loading
and unloading activity shall not exceed ten (10) minutes.
D.Â
Overnight parking is prohibited except for vehicles loading or launching
boats.

Trucks rated over one and one-half (1½) tons are prohibited
in all City parks other than City maintenance trucks or as approved
specifically by the Director of Parks and Recreation.

All waste paper, tin cans, rubbish and refuse shall be placed
in appropriate containers as shall be provided by the City; and if
no such container is provided, then such person shall remove any such
waste or rubbish or garbage brought in by said person for proper disposal
outside the park.

Sales or advertisement of merchandise or other goods for sale or hire in any City park or City-owned recreation facility is prohibited, except by an approved vendor as part of a concession agreement approved by the Board of Aldermen or an approved special event permit issued in accordance with the guidelines for events in Parkville pursuant to Section 140.345.

No person shall solicit alms or contributions for any purpose,
whether public or private, on any City park system property, unless
the solicitation is in connection with a City-sponsored event and
approved by the City.

All
persons shall carefully observe all traffic signs indicating speed,
direction, caution, stopping or parking and all others posted for
proper control of vehicular traffic and to safeguard life and property.
Where no signs are posted, speed limit shall not exceed ten (10) miles
per hour.
B.Â
No
person shall operate a vehicle at a rate of speed exceeding that posted.

It shall be unlawful for any person to catch or kill any wildlife
in any City park.

No person shall take, acquire, receive or otherwise move or
remove, using any method, any of the following items found within
park property without the expressed written consent of the Director
of Parks and Recreation: wildlife or other animals (except domestic
pets), plantings or cuttings therefrom, natural foliage or cuttings
therefrom, rocks or soil, any other natural materials.

No person shall make use of said park other than during the aforesaid periods of time, except in English Landing Park and Platte Landing Park, where presentation of a current fishing permit issued by the City to the bearer shall allow the bearer to be present in the park between the hours of 12:00 Midnight and 5:00 A.M. for the sole purpose of fishing. That permit, when issued to a person with a physical disability who possesses a distinguishing license plate or placard as described in Parkville Municipal Code Section 355.020(C), shall also allow the bearer to park in a designated parking stall in English Landing Park or Platte Landing Park between the hours of 12:00 Midnight and 5:00 A.M. The permit bearer may have one (1) person accompanying him/her, whether fishing or not, who does not possess a permit.

B.Â
Fishing
permits shall be issued at no charge upon request to Parkville City
Hall during regular business hours. They shall be valid only during
calendar years issued. Applicants shall be required to produce proper
identification. Permits cannot be used in lieu of State fishing licenses
and shall so state.

Maxine McKeon Stage is not to be considered a shelter, and shelter-type
uses of the stage are prohibited. The River Shelter/Stage may be reserved
as a shelter when not reserved for stage usage.
B.Â
Stage use is by permit only, issued as part of an approved special event permit issued in accordance with the guidelines for events in Parkville pursuant to Section 140.345.
C.Â
No food or beverage is allowed on the Maxine McKeon Stage.
D.Â
Stage usage for private parties and individuals is prohibited without
a permit.

The reservation period for park shelter usage shall be from March
1 to October 31 of each calendar year, unless shortened or lengthened
for reasons determined by the Director of Parks and Recreation.

Dog park hours: 5:00 A.M. to 12:00 Midnight. The dog park is closed
when City parks staff is conducting maintenance.
B.Â
Guests use the dog park at their own risk. The City is not liable
for any injury or damage caused by any dog in the dog park. Owners/handlers
are responsible for any injuries caused by the dog(s) which they have
brought to the dog park.
C.Â
Children under the age of eight (8) in the dog park are discouraged.
Children under the age of twelve (12) must be accompanied by a parent
or guardian.
D.Â
All park gates must remain closed at all times, other than during
entry and/or exit; only one (1) gate shall be open at any one (1)
time, and then only to enter or exit the dog park.
E.Â
The dog park area is only for dogs, their handlers and those accompanying.
No other use is allowed.
F.Â
Each handler is limited to a maximum of two (2) dogs at one (1) time
in the dog park and must have one (1) leash in hand for each dog and
have the dog under his/her control.
G.Â
All dogs must have a current rabies vaccination and shall wear a
visible rabies tag on their collars at all times in the dog park.
H.Â
All dogs shall remain leashed until inside the dog park.
I.Â
Dogs must be under the control of and within view of their owners/handlers
at all times.
J.Â
No cell phone use is allowed in dog park.
K.Â
Aggressive dogs are prohibited.
L.Â
Dogs under four (4) months of age and female dogs in heat are prohibited
from the dog park.
M.Â
Choke, prong, and spiked collars are prohibited on all dogs in the
dog park.
N.Â
Handlers must clean up after their dogs, removing and disposing of
pet waste in sealed plastic bags and placing the bag in the trash
can. Owners shall repair any holes dug by dogs that they have brought
to the dog park.
O.Â
Smoking, alcoholic beverages, human food, and glass containers are
not permitted in the dog park. Training treats for dogs are permitted.
P.Â
Dogs must be leashed and removed from the dog park at the first sign
of aggression toward people or other dogs. Mounting behavior is not
allowed.
Q.Â
Dogs with communicable diseases or open sores or wounds are not permitted
in the dog park.
R.Â
Any bite of a person or other dog must be immediately reported to
police. The persons and dogs involved must wait for an officer to
respond, except when immediate medical care is needed.

Failure to vacate a reserved facility by a non-permit holder shall
be considered trespassing after being requested and refusing to leave
by the police, a City official, or the permit holder.

The guidelines for events in Parkville, as defined in Section 140.010 and on file in the City Clerk's office, are incorporated herein by reference and shall have the power of law. The guidelines for events in Parkville may be amended from time to time by a majority vote of the Community Land and Recreation Board and by a resolution adopted by the Board of Aldermen.

A.Â
All fees related to parks facility use and special event permits are set forth in the schedule of fees adopted by the Board of Aldermen by resolution as authorized by Section 800.010 of the Municipal Code.
B.Â
Reserved use of the East Shelter, West Shelter, River Shelter, Friends
of Parkville Parks Shelter or Green Spaces 1 – 4 in English
Landing Park may be reserved for an activity by groups, as follows:

1.Â
No more than four (4) reservations will be made per shelter
or green space per day. Periods of reservation will be 7:30 A.M. to
10:30 A.M., 11:00 A.M. to 2:00 P.M., 2:30 P.M. to 5:30 P.M., and 6:00
P.M. to 9:00 P.M.
2.Â
Shelter or green space use shall be limited to groups of not
more than seventy-five (75) people each, and groups of more than seventy-five
(75) people will need reservations for more than one (1) facility.
3.Â
A person wishing to reserve one (1) or more of the facilities named above shall complete the appropriate activity permit and pay the appropriate fee pursuant to Section 140.350(A).
C.Â
Reserved use of the baseball fields, soccer fields, sand volleyball
courts, and pickleball courts in English Landing Park may be reserved
for related activities by individuals or groups, as follows:

Baseball fields, soccer fields, sand volleyball courts, and
pickleball courts are reserved per hour per field/court, as defined
in the Schedule of Fees.
D.Â
Information regarding availability and rules will be given by phone,
and reservation information, but reservations will not be made until
the applicant has come to City Hall with the completed application
and paid the appropriate fee if approved.
E.Â
The small shelters in English Landing Park and basketball court shall
be open to the public at any time during the park's regular hours
of operation on a first-come, first-serve basis, but the East Shelter,
West Shelter, River Shelter, baseball fields, soccer fields, sand
volleyball courts, and pickleball courts shall be open to the public
on a first-come, first-served basis whenever they are not reserved.

Park facilities may also be reserved as part of an approved special event permit issued in accordance with the guidelines for events in Parkville pursuant to Section 140.345.
G.Â
The
use of portions of English Landing Park, Platte Landing Park or the
Parkville Nature Sanctuary/White Allee Conservation Area and Sullivan
Nature Sanctuary may be allowed through a film and video permit as
follows:

A person wishing to use these properties for the purpose of film or video shall complete the appropriate activity permit and pay the appropriate fee pursuant to Section 140.350(A).

Any individual, concern, organization or corporation found guilty
of violating any provisions of this Chapter shall, upon conviction,
be subject to penalties not exceeding a fine of five hundred dollars
($500.00) and costs or imprisonment for a term not exceeding ninety
(90) days, or both such fine and imprisonment.
