This article shall be cited and may be referred to hereinafter
as the "Mandatory Recycling Law of the Village of Wesley Hills."
It is the goal of the Board of Trustees of the Village of Wesley
Hills to reduce the total amount of solid waste disposed of by the
Village. To accomplish this goal, the Village desires to implement
a recycling program mandating the separation of newspapers and such
other materials as may subsequently be designated by the Mayor from
other refuse produced by residential and nonresidential premises.
This program is further designed to protect the health and safety
of the residents of the Village.
A.
For the purposes of this article, certain words and phrases shall
be construed herein as set forth in this section, unless it is apparent
from the context that a different meaning is intended. When not inconsistent
with the context, the present tense shall include the future, and
words used in the plural shall include the singular and vice versa.
Further, a masculine pronoun shall include the feminine. The word
"shall" is always mandatory and not merely directory.

As used in this article, the following words shall have the meanings
indicated:
The Board of Trustees of the Village of Wesley Hills.
Newspapers and such other materials as may be designated by the Mayor and approved by the Board of Trustees from time to time pursuant to § 175-6 hereinbelow.
The Mayor of the Village of Wesley Hills.
A paper product printed on newsprint, including all newspapers,
newspaper advertisements, supplements, comics and enclosures. Not
included in this definition are magazines and telephone books.
Any person, firm, partnership, association, corporation,
company or organization of any kind.
All putrescible and nonputrescible solid wastes (except body
wastes), including garbage, wastepaper, trash, construction and demolition
debris and ashes.
The Village of Wesley Hills.
No person shall place designated recyclables in the same refuse
receptacle or otherwise mix them with other forms of refuse for collection,
removal or disposal.
A.
Designated recyclables shall be separated from all other refuse.
B.
Each category of designated recyclables shall be bundled separately
from every other category of designated recyclables.
C.
Ownership of designated recyclables set out for collection shall
vest in the Village. It shall be unlawful for a person to collect,
remove or dispose of designated recyclables which are the property
of the Village without first having obtained the permission of the
Village.
D.
Any person may donate or sell designated recyclables to any person,
whether or not operating for profit. Said person may not, however,
under any circumstances pick up such designated recyclables from the
curbside in the Village.
E.
The Board of Trustees is hereby empowered to designate the day of
the week on which designated recyclables shall be collected.
F.
No person having custody or control of any premises within the Village
shall permit or cause any designated recyclables within his control
to become a hazard or potential hazard to public travel, health or
safety or to become a nuisance of any sort.
The Mayor is hereby empowered to promulgate and amend rules
and regulations as may be deemed necessary to effectuate the intent
and requirements of this article. Said rules and regulations may require
the recycling of additional materials. Said rules and regulations
and each amendment thereof shall be approved by the Board of Trustees
at a public meeting.
This article shall be enforced by the Mayor, Deputy Mayor, or
Code Inspector of the Village of Wesley Hills.
Any person who shall violate this article shall be subject to
the following punishment: Such person's refuse shall not be collected
and shall be marked with a sticker indicating "MANDATORY RECYCLING
- Your refuse was not collected today because recyclable materials
were mixed in. Your refuse will be collected on your next regular
refuse day, once the recyclable materials have been removed. Village
of Wesley Hills Local Law No. 3-1988."
This article shall take effect on June 1, 1988.
