A. Purpose. In order for the City of Bridgeton to assure that
all programs or activities it undertakes, as defined in Section 504
of the Federal Rehabilitation Act of 1973, are established in a manner
which assures that handicapped individuals shall have an equal opportunity
to participate or utilize such programs without prohibited discrimination
on the basis of handicap, the following procedure is adopted for the
processing of alleged complaints of prohibited discrimination on the
basis of handicapped status.
B. Filing of Complaint. Any handicapped individual who has
been the subject of prohibited discrimination because of handicapped
status in connection with a program or activity offered or undertaken
by the City of Bridgeton shall have the right within thirty (30) days
after the date of the alleged prohibited discrimination to file a
written complaint of said discrimination together with all relevant
information relating to such complaint with the Administrative Assistant.
C. Procedure.
1. The Administrative Assistant shall consider all relevant information
submitted by the complainant or other interested persons. The Administrative
Assistant may at his option call a meeting of complainant and other
interested persons to determine relevant matters regarding the complaint.
The Administrative Assistant shall make a written record of all information
considered and shall render a decision within thirty (30) days after
the receipt of a complaint and promptly thereafter notify the complainant
of such decision, and his right to appeal to the City Council.
2. If the complainant is aggrieved by such decision of the Administrative
Assistant, the complainant may within ten (10) days after receipt
of notice of such decision file an appeal to the City Council. In
the event of such an appeal the Administrative Assistant shall provide
the written record of such complaint to the City Council and said
appeal shall be considered at a meeting held within thirty (30) days
after receipt of such appeal.
3. In considering such an appeal the City Council shall review the record
prepared and submitted by the Administrative Assistant, and shall
make a determination as to the validity of the complaint.
4. If it is determined that the complaint is valid the Administrative
Assistant shall make adjustments to the program or activity to assure
that the prohibited discriminatory policy is discontinued.
