Any person who shall, by themselves, or through their servants or agents, or as the servants or agents of any other person or persons, firm or corporation, directly or indirectly, or by any device, or by any subterfuge, sell, give away, or otherwise dispose of, within the corporate limits of the City of Salem, Missouri, any firecrackers, fireworks, or any other similar explosives or devices used for the same or similar purpose shall be deemed guilty of a violation of this Article.
Any person or persons who shall, by themselves, or through their agents and servants, or as the agents or servants of any other persons, firm or corporation, import and bring into the City of Salem, Missouri, any firecrackers or fireworks, or any other similar explosives or devices, for the purposes of selling or giving away the same, shall be deemed guilty of a violation of this Chapter.
Any person or persons, who live within the City of Salem, Missouri, who shall, in the City of Salem, Missouri, enter into an agreement with any other person, whereby such person shall through the connivance of both of them, sell, or offer for sale, or give away, in the furtherance of such agreement, any fireworks, firecrackers, or other similar explosives or devices, for the use and benefit of the person so living or residing within the corporate limits of the City of Salem, Missouri shall be deemed guilty of a violation of this Chapter.
Any person who shall enter into a conspiracy with any other person to violate any of the provisions hereof shall be deemed guilty of a violation of this Chapter.
It shall be illegal and contrary to this Article for any person or persons to transport any firecrackers or fireworks, or similar explosives or devices by, through or over the streets of the City of Salem, Missouri, except for a period commencing June twentieth (20th) through July tenth (10th).

A.
For the period between July first (1st) and July sixth (6th), and January first (1st) the following rules on use shall apply:
1.
Fireworks shall be allowed to be discharged only from 8:00 A.M. to 10:00 P.M. excepting on July fourth (4th) when the hours shall be 8:00 A.M. until Midnight and excepting January first (1st) from Midnight until 1:00 A.M. Only Class 1.4G fireworks in unmodified form shall be discharged.
2.
The possession of fireworks by anyone under the age of eighteen (18) years shall be unlawful unless under the direct supervision of a parent, guardian or person over the age of eighteen (18) years.
3.
Fireworks shall not be discharged on any public property or public roadway, nor from a motor vehicle. Fireworks will be allowed in City parks for City functions upon approval by the Board of Aldermen.

A.
Notwithstanding the provisions of this Article:
1.
The Board of Aldermen may, once each year for the Fourth of July, and all Salem R-80 High School home football games at the Salem High School football field, grant permission to a person or organization to conduct a public display of fireworks. Before such permission is granted, the Board of Aldermen shall be satisfied that the parties seeking to conduct such display have made adequate preparations for the safety of such event.
2.
Fireworks will be allowed in City parks for City functions upon approval by the Board of Aldermen.
3.
Any other events approved by the Board of Aldermen.
