A certain document, a copy of which has been on file for at least ninety (90) days in the office of the City Clerk of the City of Town and Country, being marked and designated as "The International Mechanical Code, 2018 Edition," including Appendix A, with the additions, insertions and changes, if any, prescribed in Section 500.033 of this Article, as published by the International Code Council, be and is hereby adopted and made a part of this Code of Ordinances for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems in the City of Town and Country and providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, conditions and terms of such International Mechanical Code, 2018 Edition, published by the International Code Council, on file in the office of the City Clerk are hereby referred to, adopted, and made a part hereof as if fully set out in this Code, with the additions, insertions and changes, if any, prescribed in Section 500.033 of this Article.

Throughout the International Mechanical Code, 2018 Edition, wherever the terms “name of jurisdiction” or “local jurisdiction” appear, it shall be deemed to mean “City of Town and Country, Missouri.” Wherever the term “code” appears, it shall mean the International Mechanical Code, 2018 Edition.

The International Mechanical Code, 2018 Edition, adopted in Section 500.030 hereof shall be amended as set forth herein:
CHAPTER 1 SCOPE AND ADMINISTRATION
101.1 Title (Amended): The Mechanical Code of the City of Town and Country ("Mechanical Code") shall consist of:
1. The International Mechanical Code, 2018 Edition, one (1) copy of which is on file in the office of the City Clerk of the City of Town and Country.
2. The amendments to the International Mechanical Code, 2018 Edition, set forth herein. The International Mechanical Code, 2018 Edition, is referred to herein as the "code."
106.5.2 Fee schedule (Amended): Fees shall be as prescribed in the Building Code.
106.5.3 Fee refunds Delete.
108.4 Violation penalties (Amended): Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair mechanical work in violation of the approved construction documents or directive of the Code Official, or of a permit or certificate issued under the provisions of this code, shall be guilty of an ordinance violation, punishable by a fine of not more than one thousand dollars ($1,000.00) or by imprisonment not exceeding ninety (90) days. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
108.5 Stop-work orders (Amended): Upon notice from the Code Official that mechanical work is being done contrary to the provisions of this code or in a dangerous or unsafe manner, such work shall immediately cease. Such notice shall be in writing and shall be given to the owner of the property, or to the owner's agent, or to the person doing the work. The notice shall state the conditions under which work is authorized to resume. Where an emergency exists, the Code Official shall not be required to give a written notice prior to stopping the work. Any person who shall continue any work on the system after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable for a fine of less than one thousand dollars ($1,000.00). Each day that a violation continues after due notice has been served shall be deemed a separate offense.
SECTION 109 MEANS OF APPEAL (Amended):
The Board of Adjustment shall hear all appeals from decisions of the Code Official made in the administration of the code, as described in Appendix B of the International Building Code as adopted by the City of Town and Country.

The St. Louis County Mechanical Code, 2009 Edition, as amended by St. Louis County in last amendatory Ordinance No. 24,438, approved on July 14, 2010, is hereby adopted as the Mechanical Code of Town and Country, insofar as said code applies to elevators and amusement rides only.

Nothing in this Article or in the code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 500.037 of this Article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

All other ordinances or parts of ordinances in conflict herewith are hereby repealed.

Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan of or directive of the Code Official, or of a permit or certificate issued under the provision of this code, shall be guilty of an ordinance violation, punishable by a fine of not more than one thousand dollars ($1,000.00) or by imprisonment not exceeding ninety (90) days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
