Terms used in this Article shall have the following meanings:
A park, reservation, playground, beach, recreation center
or any other area in the City, owned or used by the City, and devoted
to active or passive recreation.
Any wheeled conveyance, whether motor-powered, animal-drawn,
or self-propelled. The term includes any trailer in tow of any size,
kind or description, but excludes baby carriages and vehicles in the
service of the City parks.

A.
No
person in a City park shall:
1.
Willfully mark, deface, disfigure, injure, tamper with, or displace
or remove, any building, bridges, tables, benches, fireplaces, railings,
paving or paving material, waterlines or other public utilities or
parts or appurtenances thereof, signs, notices or placards whether
temporary or permanent, monuments, stakes, posts, or other boundary
markers, or other structures or equipment, facilities or park property
or appurtenances whatsoever, either real or personal.
2.
Dig, or remove any soil, rock, stones, trees, shrubs or plants, down
timber or other wood or materials, or make any excavation by tool,
equipment, blasting, or other means or agency.
3.
Construct or erect any building or structure of whatever kind, whether
permanent or temporary in character, or run or string any public service
utility into, upon or across such lands, except on special written
permit.
4.
Damage, cut, carve, transplant or remove any trees or plants or injure
the bark, or pick the flowers or seeds, of any tree or plant; or attach
any rope, wire, or other contrivance to any tree or plant; or dig
in or otherwise disturb grass areas, or in any other way injure or
impair the natural beauty or usefulness of any area.
5.
Tie any animal to any tree or plant.
6.
Hunt, molest, harm, trap, kill, shoot at any animal, reptile or bird;
or remove the eggs or nest, or young of any bird, except that snakes
known to be deadly poisonous, such as rattlesnakes, moccasins, coral
snakes, or other deadly reptiles may be killed on sight.
7.
Give or offer, or attempt to give to any animal or bird any noxious
substances.

A.
No
person in a park shall:
1.
Throw, discharge, or otherwise place or cause to be placed in the
waters of any fountain, pond, lake, stream, bay or other body of water
in or adjacent to any park or any tributary, stream, stormwater, or
drain flowing into such waters, any substance, matter or thing, liquid
or solid, which will or may result in the pollution of such waters.
2.
Bring in or dump, deposit or leave any bottles, broken glass, ashes,
paper, boxes, cans, dirt, rubbish, waste, garbage, or refuse, or other
trash. No such refuse or trash shall be placed in any waters in or
contiguous to any park, or left anywhere on the grounds thereof, but
shall be placed in the proper receptacles where these are provided;
where receptacles are not so provided, all such rubbish or waste shall
be carried away from the park by the person responsible for its presence,
and properly disposed of elsewhere.
3.
Fail to cooperate in maintaining restrooms and washrooms in a neat
and sanitary condition.

A.
No
person in a park shall:
1.
Fail to obey all traffic officers and park employees, such persons
being hereby authorized and instructed to direct traffic whenever
and wherever needed in the parks and on the highways, streets or roads
immediately adjacent thereto in accordance with the provisions of
these regulations and such supplementary regulations as may be issued
subsequently by the Director of Parks and Recreation.
2.
Fail to observe carefully all traffic signs indicating speed, direction,
caution, stopping, or parking, and all others posted for proper control
and to safeguard life and property.
3.
Ride or drive a vehicle at a rate of speed exceeding fifteen (15)
miles an hour, except upon such roads as the City may designate, by
posted signs, for speedier travel.
4.
Park a vehicle in other than an established or designated parking
area, and such use shall be in accordance with the posted directions
thereat and with the instructions of any attendant who may be present.

A.
No
person in a park shall:
1.
Ride a bicycle on other than a paved vehicular road or path designated
for that purpose, except that a bicyclist may wheel or push a bicycle
by hand over any grassy area or wooded trail or on any paved area
reserved for pedestrian use.
2.
When riding a bicycle, fail to comply with all traffic rules and
regulations as are applicable to the operation of bicycles on the
City streets.
3.
Leave a bicycle in a place other than a bicycle rack when such is
provided and there is a space available.

No person shall swim, bathe or wade in any waters or waterways
in or adjacent to any park, except in such waters and at such places
as are provided therefor, and in compliance with park regulations.

Except where permission to hunt deer has been expressly granted by the Board of Aldermen pursuant to and in compliance with Chapter 205, Article V, the Deer Control Policy and Hunting Regulations of the City of Manchester, no person in a park shall hunt, trap or pursue wildlife at any time; or use, carry, or possess air rifles, spring guns, bow and arrows, slings or any other form of weapons potentially dangerous to wildlife and human safety, or any instrument that can be loaded with and fire blank cartridges, or any kind of trapping device. No person shall shoot into park areas from beyond park boundaries.

A.
No
person in a park shall:
1.
Picnic or lunch in a place other than those designated for that purpose;
attendants shall have the authority to regulate the activities in
such areas when necessary to prevent congestion and to secure the
maximum use for the comfort and convenience of all. Visitors shall
comply with any directions given to achieve this end.
2.
Fail to observe and respect written permits issued for use of a particular
picnic area, firepit, or structure, for a specific period.
3.
Close off any picnic area, firepit, or structure provided for recreational
use or for the comfort of visitors in the park to the exclusion of
other persons in any manner, nor shall any person use such area and
facilities for an unreasonable time if the facilities are crowded.
4.
Leave a picnic area before the fire is completely extinguished and
before all trash in the nature of boxes, papers, cans, bottles, garbage
and other refuse is placed in the disposal receptacles where provided.
If no such trash receptacles are available, then refuse and trash
shall be carried away from the park area by the picnicker to be properly
disposed of elsewhere.

No person shall camp, set up tents, shacks, or any other temporary
shelter for the purpose of overnight camping except as authorized
by the issuance of a written permit by the City. No person shall leave
anywhere in the park overnight, any camp trailer, camp wagon or other
movable vehicle except such equipment left on designated parking areas
when associated with camping groups holding authorized permits for
such camping.

No person in a park shall take part in the playing of any games
involving thrown or otherwise propelled objects such as stones, arrows,
javelins or other potentially dangerous items. The playing of rough
or comparatively dangerous games such as football or baseball is prohibited
except on the fields and courts or areas provided therefor. Roller
skating shall be confined to those areas specifically designated for
such pastime.

No horseback riding shall be allowed in any City park, except
by permit from the City.

A.
Generally. No person shall permit the running of a dog or
other animal at large. All dogs or other domesticated animals in a
park where such animals are permitted shall be restrained at all times
by a leash. No leash on which a dog or other animal is tethered or
restrained as described above shall be of greater length than ten
(10) feet. No vicious animal of any kind shall be brought into the
park at any time even though restrained as described above.
B.
Special Events. During designated special events held at
any of the municipal parks of the City of Manchester, it shall be
unlawful for any person to bring an animal on the park grounds except
as provided or authorized by the City of Manchester for said designated
event. Appropriate notice restricting said animals shall be given,
such as through the media and/or notice posted at entrances or other
locations on the park grounds.

No person shall build or attempt to build a fire in a park except
in such areas and under such regulations as may be designated by the
City. No person shall drop, throw, or otherwise scatter lighted matches,
burning cigarettes or cigars, tobacco paper or other inflammable material,
within any park area or on any highway, road or street abutting or
contiguous thereto.

No person shall enter an area or roadway in a park posted as
"Closed to the Public," nor shall any person use, or abet the use
of any area in violation of posted notices.

A.
No
person in a park shall sleep or protractedly lounge on the seats,
or benches, or other areas, or engage in loud, boisterous, threatening,
abusive, insulting or indecent language, or engage in any disorderly
conduct or behavior tending to breach the public peace.
B.
No
person in a park shall fail to produce and exhibit any permit from
the City he/she claims to have upon request of any authorized person
who shall desire to inspect the same for the purpose of enforcing
compliance with any ordinance or rule.
C.
No
person shall play a loud radio or musical instrument in the park,
except by permit of the City.

A.
No
person in a park shall:
1.
Expose or offer for sale any article or thing, nor shall he/she station
or place any stand, cart, or vehicle for the transportation, sale
or display of any such article or thing, except persons operating
authorized concessions by the City.
2.
Announce, advertise, or call the public attention in any way to any
article or service for sale or hire, except persons operating concessions
authorized by the City.
3.
Paste, glue, tack or otherwise post any sign, placard, advertisement,
or inscription whatever, nor shall any person erect or cause to be
erected any sign whatever on any public lands or highways or roads
adjacent to a park.

The person to whom a permit is issued under Article II of this Chapter shall be liable for any loss, damage or injury sustained by any person whatever by reason of the negligence of the person to whom such permit shall have been issued. Organizations granted permits to hold functions within a park shall furnish to the City, upon request, proof of their financial responsibility and liability for any and all injuries sustained by any person as a result of that organization's activity within the park, including the preparation of and the dismantling of all facilities provided for the function covered by the permit. The aforementioned financial responsibility shall be in such form as the City shall require to hold the City, its officials, agents and employees harmless and to defend any claim for any loss whatsoever.

The City shall have the authority to eject from the park any
person acting in violation of this Article. The City shall have the
authority to seize and confiscate any property, thing or device in
the park used in violation of this Chapter. In the event of resistance
to action intended to correct a violation of this Article, either
physical or otherwise, the Park Department shall refer the violation
to the Police Department.
