The following definitions shall apply in the interpretation
and enforcement of this Chapter:
Those streets posted with signage marking them as "Snow Routes"
in accordance with the provisions of this Chapter.

Any tires mounted on drive wheels of motor vehicles which
are especially designed to give effective traction on snow, mud or
ice-covered streets by means of extra heavy-duty treads with specifically
high-traction patterns, including radial tires, except that no tire
so defined shall be construed to be a snow tire which is damaged or
worn to the extent that its performance would be substantially impaired.
Any tires mounted on drive wheels of motor vehicles which
are especially designed to give effective traction on snow, mud or
ice-covered streets by means of metal studs spaced as to give high-traction
patterns except that no tire so defined shall be construed to be a
studded tire which is damaged or worn to the extent that its performance
would be substantially impaired.
Any metal chains mounted on drive wheel tires of motor vehicles
which cross the tread of each such tire laterally in at least three
(3) different places.

A.
It
shall be unlawful to park, stop, or stand a motor vehicle on any snow
route of the City two (2) hours after the Public Works Supervisor
declares that a "Snow Watch" is in effect based on a forecast of one
(1) inch or more of snow or a forecasted fall of sleet or ice in any
amount.
B.
In the event of a non-forecasted snow or ice event leading to the immediate declaration of a "Snow Watch," the parking restrictions set forth in Subsection (A) will apply to all snow routes from the time of the declaration of a Snow Watch.
C.
The
parking prohibition under this Section shall remain in effect until
the streets along the snow routes have been completely cleared of
the snow and/or ice by snow removal equipment and the Snow Watch declared
cancelled by the Public Works Supervisor.

A.
No
person operating a motor vehicle on a snow route on which there is
a covering of snow, sleet or ice shall allow such vehicle to become
stalled wholly or partly because the drive wheels thereof are not
equipped with effective tires, chains, snow tires, radial tires or
studded tires.
B.
No
person operating a motor vehicle on part of a snow route on which
there is a covering of snow, sleet or ice or on which there is a parking
prohibition in effect, shall allow such vehicle to become stalled
because the motor fuel supply is exhausted or the battery has become
inoperative.

Whenever a vehicle becomes stalled for any reason, whether or
not in violation of this Chapter, on any part of a snow route on which
there is a covering of snow, sleet or ice, or on which there is a
parking prohibition in effect, the person operating such vehicle shall
take immediate action to have their vehicle towed or otherwise removed
from the roadway of such snow route. No person shall abandon or leave
his vehicle in the roadway of a snow route regardless of whether he
indicates, by raising the hood or otherwise, that the vehicle is stalled.

Whenever all of the conditions which give rise to a parking
prohibition in effect pursuant to this Chapter no longer exist, the
prohibition shall be terminated.

Any provision of this Chapter which becomes effective upon the
occurrence of certain weather conditions shall, while temporarily
in effect, take precedence over other conflicting provisions of law
normally in effect, except that it shall not take precedence over
provisions of law relating to traffic accidents, emergency travel
of authorized emergency vehicles, or emergency traffic directions
of a Police Officer.

On each street designated by this Chapter as a snow route, there
shall be posted special signs at intervals indicating that this is
a snow route. These signs shall be distinctive and uniform in appearance
and shall be plainly readable to persons traveling on the street or
highway.

Whenever any vehicle shall be found parked or abandoned on a
snow route in violation of this Chapter, such vehicle may be removed
and conveyed by means of towing and impounding the same or by towing
or otherwise removing to the nearest available space which would not
adversely affect the flow of traffic. This provision expressly permits
the towing of vehicles to private storage lots should such towing
be determined appropriate by the City. In the event that a motor vehicle
is towed to a private storage lot, the owner of such motor vehicle
shall be responsible for all storage and towing costs, together with
any other fines and costs set forth herein.

No person shall deposit, or cause to be deposited, any snow
and/or ice on or against a fire hydrant or on any sidewalk, street,
or loading and unloading areas of a public transportation system,
except that snow and ice may be windrowed on public roads incident
to the cleaning thereof or windrowed on curbs incident to the cleaning
of sidewalks in business districts.

No person shall impede or interfere in any way with a snowplow
or other snow removal vehicle while such snowplow or other snow removal
vehicle is in operation on City streets.

A.
Whenever
any vehicle shall be found illegally parked or abandoned in violation
of this Chapter, the police shall notify the owner or driver of such
vehicle by handing to him or affixing on the vehicle a parking violation
summons.

The presence of any vehicle found parked or abandoned in violation
of this Chapter on any snow routes shall be prima facie evidence that
the person in whose name such vehicle is registered, in the records
of the Director of Revenue of the State, committed or authorized such
violation.

The City Engineer is hereby granted the authority to designate
those streets that he feels should be snow routes and to so indicate
that fact on said streets by the posting of signs as provided for
herein. In addition, the City Engineer shall publish as often as necessary
a full listing of those streets which have been designated by him
as snow routes and which have been so indicated by the posting of
signs as provided for herein.
