Flood damage prevention — See Ch. 79.
It is the finding of this Board that a viable drainage system in the Town of Royalton is necessary in order to protect the health and welfare of the citizens thereof, that because of the topography of the Town, it is imperative that natural drainage flows not be unduly tampered with, that man-made, Town-made, county-made drainage systems not be impeded or tampered with, and that culverts, storm drains, and other drainage amenities be protected, and to conform to Town requirements.
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Any person, corporation, partnership, trust or any other legal entity, and shall include any officer or person having responsibility or control of real property owned by any entity.
It shall be unlawful for any person in the Town of Royalton to, in any way, interfere with drainage systems including culverts, storm sewers, ditches, natural drainage systems which drain areas of the Town and adjacent properties. Unlawful acts include, but are not limited to:
A. 
Filling ditches or drainage swales with any debris or other impediments.
B. 
Placing or constructing any structure upon drainage easements, as recorded or depicted on filed subdivision maps.
C. 
Placing or constructing any structure in a location which blocks any ditch, drainage system or waterway.
D. 
Filling in swales which are utilized to allow drainage from adjacent properties.
E. 
Allowing an accumulation of debris upon one's property in such a fashion as to obstruct any such system or access thereto.
F. 
Installation of pipes in ditches which affect more than one property without the consent of the Highway Superintendent.
G. 
Allowing any prohibited act to exist on any real property owned by or under the control of any person.
Existing structures, debris, fill or impediments, which are prohibited by this chapter, shall be removed within six months of the adoption of this chapter.
A. 
A violation of this chapter shall be an offense punishable by a fine of not more than $250 and/or imprisonment not to exceed 15 days.
B. 
The Town of Royalton shall be entitled to enforce the provisions of this chapter by any legal or equitable remedy, including injunctive relief.
This chapter shall be enforced by the Town of Royalton Building Inspector or the Town of Royalton Highway Superintendent, and such other individuals who may, from time to time, be designated for Code Enforcement by the Town of Royalton Town Board.
