Town of Royalton, NY Chapter 95 Noise

§ 95-1 Declaration of policy.

It is hereby declared to be the policy of the Town Board to prevent unreasonably loud, disturbing and unnecessary noise. It is the intention of the Town Board to maintain low noise levels within the Town of Royalton so as to preserve, protect and promote the public health, safety and welfare and to foster convenience, peace and quiet within the Town by the inhabitants and transients within the Town of Royalton. The Town Board finds that every person is entitled to have maintained noise levels which are not detrimental to life, health and to the enjoyment of property, and that continual excessive and unnecessary noise within the Town of Royalton affects and is a menace to public health, safety, welfare and comfort of the people of the Town.

§ 95-2 Title.

This chapter shall be known as the "Noise Pollution Control Law of the Town of Royalton."

§ 95-3 Noises prohibited.

No person shall cause or permit to be caused any noise which can be heard by a person with normal hearing beyond the boundaries of property owned, leased or otherwise controlled by him, that would annoy, injure or endanger the comfort, repose, health, peace or safety of other persons and caused by the following:

A. Minibikes, snowmobiles and motorcycles shall not be operated on private property closer than 200 feet to any residence except the residence of the owner or operator thereof or any residence to which the owner or operator may be invited, except for ingress and egress to or from the operator's residence.

B. No internal combustion engine shall be operated at any time or place in the Town of Royalton without an adequate muffler designed and manufactured to suppress exhaust noises to a minimum for the vehicle.

C. No owner or any other person harboring or having custody or control of any dog in the Town shall permit or allow such dog to engage in habitual loud howling or barking in violation of Chapter 50, Dogs, § 50-3.[1]

D. All other loud or raucous noises likely to annoy or disturb people are prohibited except usual and normal noises resulting from usual and normal activities.

§ 95-4 Penalties for offenses.

A violation of this chapter is an offense punishable by a fine of not more than $250. Each day's violation shall constitute a separate offense.

§ 95-5 Territorial application.

This chapter shall apply to all areas within the Town of Royalton, except within the incorporated Village of Middleport.
