City of Byrnes Mill, MO Adoption of Building Codes

A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Byrnes Mill, being marked and designated as the International Building Code, 2021 Edition, as published by the International Code Council Inc., is hereby adopted as the Building Code of the City of Byrnes Mill, Missouri, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.020 of this Article.

Penalty. Any person violating any of the provisions of the Code adopted in this Section shall be deemed guilty of an ordinance violation and upon conviction thereof shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned in the City or County Jail for a period not exceeding ninety (90) days, or both such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.

Section 500.020 Additions, Insertions, Deletions and Changes.

The following Sections of the International Building Code, 2021 Edition, are hereby revised as follows:

Section 101.4.6 Delete reference to the International Energy Code.

101.4.6 Energy. The provisions of the International Energy Conservation Code shall apply to all matters governing the design and construction of buildings for energy efficiency.

Section 105.2 Delete exception #2 and change to fences not over six (6) feet tall.

Section 406.3.2.1 change to read 5/8-inch Gypsum Board Type X between garage and building.

The following Sections of the International Fuel Gas Code, 2021 Edition, are hereby revised as follows:

Section 114 Board of Appeals: Delete and reword to be the Board of Alderpersons.

114.1 Membership of board. The board of appeals shall consist of five members appointed by the chief appointing authority as follows: one for 5 years; one for 4 years; one for 3 years; one for 2 years and one for 1 year.

301.2 Energy utilization. Heating, ventilating and air conditioning systems of all structures shall be designed and installed for efficient utilization of energy in accordance with the International Energy Conservation Code.

Section 500.060 Adoption of International Residential Code.

A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Byrnes Mill, being marked and designated as the International Residential Code, 2021 Edition, as published by the International Code Council Inc., be it hereby adopted as the Residential Building Code of the City of Byrnes Mill, Missouri, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Residential Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.065 of this Chapter.

The following Sections of the International Residential Code, 2021 Edition, are hereby revised as follows:

Section 105.2 change to read six (6) feet.

R105.2 Work exempt from permit. Exemption from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following:
Building:
1.	Other than storm shelters, one-story detached accessory structures, provided that the floor area does not exceed 200 square feet (18.58 m²).
2.	Fences not over 7 feet (2134 mm) high.

Section 301.1.4 Insert: Intermodal shipping containers may not be repurposed as a residential habitable structure.

R301.1.4 Intermodal shipping containers. Intermodal shipping containers that are repurposed for use as buildings or structures shall be designed in accordance with the structural provisions in Section 3115 of the International Building Code.

Section 302.6 Dwelling & Garage separation change to 5/8-inch type X

R302.6 Dwelling-garage fire separation. The garage shall be separated as required by Table R302.6. Openings in garage walls shall comply with Section R302.5. Attachment of gypsum board shall comply with Table R702.3.5. The wall separation provisions of Table R302.6 shall not apply to garage walls that are perpendicular to the adjacent dwelling unit wall.

A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Byrnes Mill, being marked and designated as the International Existing Building Code, 2021 Edition, as published by the International Code Council Inc., be it hereby adopted as the Existing Building Code of the City of Byrnes Mill, Missouri, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Residential Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section.

Section 500.070 Property Maintenance Code Adopted.

For the purpose of the protection of the public health, safety and welfare with respect to establishing minimum standards for buildings used for dwelling purposes, there is hereby adopted the International Property Maintenance Code, 2021 Edition, as published by the International Code Council Inc., and same is hereby adopted as the Property Maintenance Code of the City of Byrnes Mill, Missouri and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.073 of this Chapter. One (1) copy of the Property Maintenance Code adopted in this Section shall be on file in the office of the City Clerk of the City for public inspection.

Section 500.073 Additions, Insertions, Deletions And Changes.

The following Sections of the Property Maintenance Code, 2021 Edition, are hereby revised as follows:

Section 302.4 Insert wording “in excess of nine (9) inches."

302.4 Weeds. Premises and exterior property shall be maintained free from weeds or plant growth in excess of [JURISDICTION TO INSERT HEIGHT IN INCHES]. Noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens. Upon failure of the owner or agent having charge of a property to cut and destroy weeds after service of a notice of violation, they shall be subject to prosecution in accordance with Section 109.3 and as prescribed by the authority having jurisdiction. Upon failure to comply with the notice of violation, any duly authorized employee of the jurisdiction or contractor hired by the jurisdiction shall be authorized to enter upon the property in violation and cut and destroy the weeds growing thereon, and the costs of such removal shall be paid by the owner or agent responsible for the property.

Section 500.080 Fire Prevention Code.

Adoption Of The Fire Code. A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Byrnes Mill, being marked and designated as the International Fire Code, 2021 Edition, as published by the International Code Council Inc., is hereby adopted as the Fire Code of the City of Byrnes Mill, Missouri, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (C) of this Section.

Additions, Insertions, Deletions And Changes. The following Sections of the International Fire Code, 2021 Edition, are hereby revised as follows:

Section 101.1 Title: Insert the City name.

Section 103 Code Compliance Agency. Delete in entirety.

Section 104: Duties And Powers Of The Fire Code Official.

Rename: Duties and Powers of the Code Official (wherever the wording Fire Code Official is found to be changed to Code Official).

Section 105.1.2 Types of permits. Delete Operational Permit.

105.1.2 There shall be two types of permits as follows:

1. Operational permit. An operational permit allows the applicant to conduct an operation or a business for which a permit is required by Section 105.5 for either:

1.1. A prescribed period.

1.2. Until renewed or revoked.

Section 105.2.2 Inspections authorized: Delete in its entirety.

Section 105.1.3 Permits for the same location: Delete in its entirety.

Sections 105.5 to section 106 Required operational permits: Delete in its entirety.

Section 111.1 Board of Appeals: Change to read:

The Board of Appeals shall consist of the Board of Adjustment as prescribed in Title IV, Chapter 400 Article XXII of the Municipal Code of the City of Byrnes Mill.

Section 112.4 Violation and Penalties: change to read:

Open burning shall be conducted in accordance with the Missouri Department of Resources 10CSR10-6.045.

Section 500.081 Applicability of IBC Code — Participation in Fire Protection District — Inspections.

Adoption of the Fire Prevention Code as set out in Section 500.080 will therefore join the City with the High Ridge Fire Protection District to allow their inspection of buildings within the City as needed for compliance with the IBC Codes.

Section 500.082 Permits.

The City does not issue building permits in relation to the Fire Prevention Code; however, the City does hereby encourage all its citizenry to comply with all codes required by the Fire Protection District.

Section 500.083 Cooperation by City With Fire Protection District.

It shall be the policy of the City to work with the appropriate Fire Protection District for the purpose of fire prevention.

Section 500.084 Charges by City to Fire Protection District — Exemption of City From Permit Fees.

The City shall not charge the Fire Protection District for any water usage or cost of maintenance of City-owned fire hydrants in its duties, excluding domestic water at the various stations, which shall be charged at the normal rate as provided for by this Code, and, in return, the Fire Protection District shall not charge the City for any fire permits that may be needed within the City-owned buildings or future buildings.
