A.
The Director of Utilities, Code Enforcement Officer, or other Borough-designated
agent shall, from time to time, inspect existing curbs, sidewalks
and driveway aprons located in the Borough of Lansdale to determine
whether a property owner shall be required to construct, reconstruct
or repair a sidewalk and curb or any part or portion thereof.
B.
Guidelines pertaining to the factors to be considered when determining
whether a curb, sidewalk or a driveway apron must be replaced shall
be available, upon request, at the office of the Department.
A.
In the event a property owner is required to construct, reconstruct,
replace or repair any curb, sidewalk or driveway apron, the cost shall
be borne by the property owner. Property owners shall be provided
with a written notice which shall identify the curb, sidewalk and/or
driveway apron which must be constructed, reconstructed, replaced
or repaired.
B.
Upon 30 days' written notice from the Borough of Lansdale, the property
owner shall, as the case may be, construct, reconstruct, repair or
replace the sidewalk or curb identified in the written notice.
C.
Written notice shall be sent to the address of the premises which
is the subject of the notice and to the address listed on the deed
for the premises as the premises owner's mailing address, if any.
If a premises is vacant, then a notice shall be posted upon the premises.
Upon failure of any property owner, agent, or assign to timely
complete work, the Borough may, at its option, cause the required
work to be done at the cost of the property owner, and the Borough
may collect the cost thereof plus 10%, together with all charges and
expenses, from such property owner and may file a municipal claim
therefor or collect the same by action in assumpsit pursuant to 8
Pa.C.S.A. § 101 et seq., as amended.
Curbs shall be formed to minimize small lengths. Any curb requiring
replacement shall be replaced in sections having a minimum length
of five feet, unless otherwise approved, in writing, by the Borough
official.
Where new work abuts existing work that does not conform to
the required slope or dimensional criteria set forth in this chapter,
the Borough official may require additional curb, sidewalk or apron
to be removed, so that a transition section can be installed between
the new work and existing feature. Where transitions are utilized,
expansion joint shall be placed on both sides of the transition to
facilitate future removal. Where a transition crosses a property line,
permission should be obtained from the adjacent property owner prior
to the commencement of work on the adjacent property. In the event
permission of the adjacent property owner cannot be obtained, and
the work is performed in a Borough right-of-way, the Borough official
shall establish the limits of work and line and grade requirements.

Where existing curbs are constructed of a material other than concrete,
they may not be reset or reconstructed in anything other than concrete.
Notwithstanding the foregoing, in the event that a material other
than concrete, such as Belgian block, was required under the applicable
final land development approval granted by the Borough Council or
pursuant to a Borough Council approved streetscape project, construction
or reconstruction of the curb shall be in accordance therewith, unless
a waiver is granted, in writing, by the Borough Council.
B.
Where existing sidewalks are constructed of a material other than
concrete, they may not be reset in any material other than concrete.
Notwithstanding the foregoing, in the event that a material other
than concrete, such as brick, was required under the applicable final
land development approval granted by the Borough Council or pursuant
to a Borough Council approved streetscape project, construction or
reconstruction of the sidewalk shall be in accordance therewith, unless
a waiver is granted by the Borough Council.
