A. Powers. The Marshal shall be the Chief of Police and shall
at all times make or order all arrests, with proper process, for violation
of the laws of the State or ordinances of the City. He/she shall be
and remain on duty such hours and at such times as the Board of Aldermen
shall direct by order entered on record, provided that the number
of hours shall not be unreasonable or excessive. He/she shall be ready
at all times to execute and attend the duties of his/her office during
the time by said order designated.
B. Further Powers And Duties. The Marshal shall see that all
ordinances of the City are strictly enforced and shall at once serve
all warrants, process or notices issued to him/her by the Mayor, Municipal
Judge or other proper person; to take up horses, mules, asses, cattle,
swine, sheep and goats found running at large within the limits of
the City. He/she shall collect all fines imposed on any person or
persons for the violation of any of the City ordinances and pay the
same to the City Treasurer as required by law and take duplicate receipts
therefor, one (1) of which he/she shall file with the City Clerk,
and he/she is hereby required to render to the Board of Aldermen a
full and complete statement of all monies collected by him/her on
the first (1st) of each month, from whom and on what account, by virtue
of his/her office. He/she shall preserve and care for all property
in the City Hall and City Jail and attend the Board of Aldermen when
in session and official duties alone shall be an excuse for non-attendance.
C. Badge Of Office. The Marshal shall wear some badge of office
in plain view and his/her assistants shall wear badges so they can
plainly be seen.
D. Leave Of Absence. In case the Marshal desires to be absent
himself/herself from duty, it shall be his/her duty to gain a leave
of absence from the Mayor and upon such leave of absence being granted
the Marshal shall designate some party to act for him/her during his/her
absence, but the designation so made shall have the approval of the
Mayor.
E. Salary. The City Marshal shall receive as compensation for
his/her services a salary as designated by ordinance to be paid monthly
and such fees as are provided by law and ordinance.

Since the duly elected, qualified and acting City Marshal is
Chief of Police by Statute, the Chief shall have supervision over
all officers and members of the department; provided that in case
of suspension or discipline of any individual member, Police Chief
will work in close cooperation with the Mayor, who is the conservator
of the peace and responsible under Statutes for all law enforcement.
The Chief of Police shall be the keeper of the City Jail and have
custody of all persons incarcerated therein. He/she shall keep such
records and make such reports concerning the activities of his/her
department as may be required by Statute or ordinances of the City.
The Chief shall be responsible for the every day performances of his/her
department and all members of the Police force shall serve subject
to his/her orders.

A. There
is hereby created the operative office of Assistant Chief of Police.
B. The
duties of the Assistant Chief of Police shall be to act in the capacity
of Chief of Police at any time the Chief of Police is not available
or as directed by the Chief of Police.
C. The
salary of the Assistant Chief of Police shall be set by ordinance
from time to time.
