Any person, firm, corporation or partnership who shall engage
in any contractor as defined in Section 94.270, RSMo., 1986, within
the City limits of the City of Lake Ozark, Missouri, shall make application
for a contractor's license to do business within the City of Lake
Ozark, Missouri.

Any person, firm, corporation or partnership who shall engage in any contractor as defined in Section 94.270, RSMo., 1986, within the City limits of the City of Lake Ozark, Missouri, without a valid contractor's license as required by Section 606.010 shall upon conviction be punished by a fine not to exceed five hundred dollars ($500.00) and/or by imprisonment not to exceed ninety (90) days, or by both such fine and imprisonment. Each day that said violation continues after citation therefor shall be considered a separate offense and shall further be subject to the same penalties therefor.

A.
Written Application. Any person, firm or other business
organization requesting the issuance of an original contractor's license
shall make written application therefor to the City Clerk, which application
shall contain all information set forth in Forms 9307-A, 9307-B and
9307-C, copies of which are filed in the office of the City Clerk.
B.
Business To Be Inspected. Upon completion of said application
form and upon payment of the license fee therefore as prescribed by
ordinance, the City Clerk shall cause said business to be inspected
by the City Building Inspector for compliance with building requirements
and the owner thereof shall further cause said business to be inspected
by the Lake Ozark Fire Protection District Fire Marshal, if located
within the corporate limits at Lake Ozark.
C.
Approval After Inspection. At such time that all requirements
of inspection are satisfied and an applicant is shown to not be in
arrears for any sewer bills, taxes owed to the City, any unresolved
building problems or any other burden imposed by any ordinance of
the City of Lake Ozark, such applicant shall be eligible for final
approval by the City Clerk and City Administrator. At said time the
City Clerk is authorized to issue the requested business license without
further procedure.

There is hereby levied a non-refundable application fee for
each business required to have a license to engage in business in
the City, as follows: fifty dollars ($50.00) per year for each business
operating within the corporate limits of Lake Ozark.

When issued, the license shall be valid for a period of one
(1) year from July first (1st) through June thirtieth (30th) of the
following year.

Each contractor required hereby to have a license in the City
of Lake Ozark, Missouri, shall display same at the business location
in open view of the public

At any time during the term of the license should the business
be deemed in arrears of any tax, bill or other burden imposed by law,
the business license shall be revoked. Such notice shall be served
upon said business by certified letter and the letter shall inform
the business what payments need to be paid, the time limit for payment
and action to be taken in event of non-payment.

Any business within the definition of ordinaries, money brokers,
money changers, intelligence and employment offices and agencies,
public masquerades, balls, street exhibitions, dance houses, fortunetellers,
pistol galleries, museums, menageries, equestrian performances, horoscopic
views, telescopic views, lung testers, muscle developers, magnifying
glasses, ten pin alleys, ball alleys, billiard tables, pool tables
and other tables, theatrical or other exhibitions, boxing and sparring
exhibition, shows and amusements tippling houses, sales of unclaimed
goods by express companies or common carriers, auto wrecking shops
and junk dealers who shall remain in arrears of any bill, tax, penalty
or other burden imposed by law for a period of thirty (30) days after
the time limit of payment so stated in a certified letter delivered
to such business shall cease to do business in the City of Lake Ozark
and the Mayor shall cause the Police Department to enforce this provision
as necessary. At such time, the business license shall be deemed revoked
and a new license application fee and business license shall be paid
and acquired in accordance with this Article before the business may
reopen.

The term "contractor" as used in this Chapter
shall mean any commercial establishment having a separate identity,
location or staff that is engaged in the performance of building construction,
maintenance, plumbing, wiring, excavating, framing and other building
crafts.

A.
No contractor's
license shall be issued to any firm, person or corporation which shall
be in arrears of payment of any debt without an appropriate payment
plan to the City of Lake Ozark.
B.
No contractor's license shall be issued to any business that is operating in a facility in violation of Section 700.150 of the Municipal Code of the City of Lake Ozark.
C.
The City
Clerk is directed to prepare an application form and require, prior
to the issuance of a license, a demonstration that the applicant has
complied with the requirements of this Section

A.
It is
hereby declared unlawful for any person to make any false written
statement on any application submitted to the City of Lake Ozark for
any type of permit or license, specifically including, but not being
limited to, contractor's licenses.
B.
Any person violating the terms of Subsection (A) shall be subject to prosecution in the Municipal Court of the City of Lake Ozark and upon conviction of such violation shall be punished by a fine not to exceed five hundred dollars ($500.00) and/or by imprisonment not to exceed ninety (90) days, or by both such fine and imprisonment.
