The nomination and election of City officers shall be non-partisan, and candidates at such elections shall not be designated as members or having any affiliation with any political party.

A. 
All candidates for any City office must possess the following qualifications:
1. 
Be a resident of the City of Chillicothe for one (1) year next preceding their general election;
2. 
Have attained the age of twenty-one (21) years of age prior to the date of their general election; and
3. 
Be a registered voter at the time a declaration of candidacy is filed with the City Clerk or in the case of a write-in candidate where no declaration of candidacy is filed, by the date of the general election for which the person is a candidate.
B. 
All candidates for Councilperson must be a registered voter of the Ward for which the person is a candidate for thirty (30) days prior to the time of filing a declaration of candidacy, or, if in the case of a write-in candidate where no declaration of candidacy is required, then for thirty (30) days prior to the general election for which the person is a candidate.

Declarations of candidacy shall be filed with the City Clerk. The opening date for the filing of such declaration of candidacy shall be 8:00 A.M. the sixteenth (16th) Tuesday prior to the municipal election day with said filing period remaining open until 5:00 P.M. the eleventh (11th) Tuesday prior to the municipal election day. Before the sixteenth (16th) Tuesday prior to the municipal election day, the City Clerk shall notify the general public of the opening filing date, the offices to be filled, the proper place for filing and the closing filing date of the election. Such notification may be accomplished by a legal notice published in at least one (1) newspaper of general circulation in the City. The City Clerk shall determine the sufficiency of all such declarations of candidacy and shall certify all candidates for nomination in filing order with the notice of election to the election authority prior to the tenth (10th) Tuesday before the municipal election day.

A. 
No candidate's name shall be printed upon any official ballot at any election unless the candidate has, as provided for by this Chapter, timely filed a written declaration of candidacy, stating his or her full name, residence, and the office for which he or she proposes to be a candidate, and that if nominated and elected to the office he or she will qualify.
B. 
The declaration shall be in substantially the following form:
I, the undersigned, a resident and registered voter of the _____ ward of the City of Chillicothe, Missouri, do announce myself a candidate for the office of ______________________, to be voted for at the _____ election to be held on the _____ day of _____, _____, and I further declare that if nominated and elected to such office, I will qualify.

A. 
A person may be on the City ballot seeking only one (1) office.
B. 
No person shall file for one (1) City office and, without withdrawing, file for another City office to be filled at the same election. Any person violating any provision of this Section shall be disqualified from running for election to any office at such election.
C. 
Notwithstanding any other provisions of law to the contrary, no person shall be certified as a candidate for a municipal office nor shall such person's name appear on the ballot as a candidate for such office who shall be in arrears for any unpaid City taxes or municipal user fees on the last day to file a declaration of candidacy for the office.

A. 
Any candidate filing for office under the provisions of this Article shall file his or her declaration of candidacy in person in the office of the City Clerk, except as otherwise provided in this Section.
B. 
The declaration of candidacy may be filed by registered mail if the candidate is:
1. 
Unable to appear in person because of physical disability, and the declaration is accompanied by a sworn statement of a licensed physician so stating; or
2. 
A member of the armed forces of the United States on active duty and it is accompanied by a verified statement of the commanding officer of the candidate attesting to his/her active duty status.
C. 
The City Clerk shall not accept for filing any declaration of candidacy that is not presented to him or her in person or which, if sent by registered mail, is not accompanied by the proper statement as required in Subsections (B)(1) and (B)(2) above.

A. 
Each candidate, contemporaneously with the filing of his or her declaration of candidacy as required by Section 105.270 shall pay to the City Clerk a filing fee of twenty dollars ($20.00). The filing fee shall be deposited in the general revenue fund of the City and shall not be refundable in any event.
B. 
Any person who cannot pay the fee required to file as a candidate may have the fee waived by filing a declaration of inability to pay in the form as prescribed under State law, currently set forth in Section 115.357.3 RSMo.

Any person who has filed a declaration of candidacy for an elective office, who wishes to withdraw as candidate must do so by filing a written, sworn statement of withdrawal in the office of the City Clerk in the time and manner required by State law, as currently set forth under Section 115.359.1, RSMo.
B. 
The name of a person who has properly filed a declaration of candidacy, or of a person nominated for office, who has not given notice of withdrawal as provided in Subsection (A) of this Section shall, except in case of death or disqualification, be printed on the official general election ballot, as the case may be.

A. 
The candidate for Mayor, other elected officials, the candidate for the at large member of the Council and the candidate for member of the Council from each ward, who shall receive the greatest number of votes at the regular municipal election for each such office, respectively, shall be declared elected.
B. 
In the event of a tie vote in the election for an office or on any other issue, a runoff election shall be held. Such special election shall be immediately noticed to be held not more than thirty-five (35) days from the date of the certification of the election results of the election in which the tie vote occurred.
