The name of this organization shall be the Planning and Zoning Commission of the City of Chillicothe, Missouri.
[CC 1999 §27-01]
The authorization for the establishment of this Planning and Zoning Commission is set forth under Chapter 89, RSMo., at Sections 89.400 through 89.470, RSMo., and any acts amendatory thereof or supplementary thereto. Powers and duties were delegated to the Planning and Zoning Commission by the City Council of the City of Chillicothe on the tenth (10) day of April 2000 in accordance with the above mentioned enabling law.

A. 
Annual Meeting. The annual meeting of the Planning and Zoning Commission shall be the first (1st) regular meeting in the month of January of each year. Such meeting shall be devoted to the election of officers for the ensuing year and such other business as shall be scheduled by the Planning and Zoning Commission.
B. 
Regular Meetings. Regular meetings of the Planning and Zoning Commission shall be held in the City Hall on the first Monday of each month at a time fixed by the Commission. A regular meeting may be canceled or rescheduled by the Commission to a different time by the act of the Commission.

C. 
Special Meetings. Special meetings of the Planning and Zoning Commission shall be held at a time and place designated by the officer calling the same and shall be called by the Chairman or Vice Chairman. Written notice thereof shall be given to all the members not less than twenty-four (24) hours in advance thereof.
D. 
Quorum. At any meeting of the Planning and Zoning Commission, a quorum shall consist of a majority of the seated members of the Commission or four (4) members if there are no vacancies on the Commission. No action shall be taken in the absence of a quorum, except to adjourn the meeting at a subsequent date.
E. 
Voting. At all meetings of the Planning and Zoning Commission, each member attending shall be entitled to cast one (1) vote. In the event that any member shall have a personal interest of any kind in a matter then before the Commission, he/she shall disclose his/her interest before voting upon the matter and the Secretary shall so record in the minutes. The affirmative vote of at least a majority of the present voting membership shall be necessary for the adoption of any resolution or other voting matter.
F. 
Proceedings.
1. 
At any regular meeting of the Planning and Zoning Commission, the following shall be the regular order of business:
a. 
Roll call
b. 
Minutes of the preceding meeting
c. 
Public hearings
d. 
Old and new business
e. 
Communications and bills
f. 
Report of the officers and committees
g. 
Adjournment
2. 
Each formal action of the Planning and Zoning Commission required by law, Statute, rule or regulation shall be embodied in a formal resolution duly entered in full upon the minute book after an affirmative vote as provided in Subsection (E) hereof.

A. 
Membership shall consist of seven (7) members, all of whom have been nominated by the Mayor and approved by the City Council at their monthly meeting. Their term shall be for four (4) years after the first (1st) appointments and their terms staggered, two (2) shall be appointed for one (1) year, two (2) members for two (2) years and three (3) members for three (3) years.
1. 
Officers. The officers of the Planning and Zoning Commission shall consist of a Chairman elected by the Commission; a Vice Chairman and a Secretary elected by the Commission at the annual meeting for a term of one (1) year. In the event the Secretary shall be absent from any meeting, the officer presiding shall designate an acting Secretary.
2. 
Duties of officers. The duties and powers of the officers of the Planning and Zoning Commission shall be as follows:
a. 
Chairman.
(1) 
To preside at all meetings of the Commission.
(2) 
To call special meetings of the Commission in accordance with these bylaws.
(3) 
To sign documents of the Commission.
(4) 
To see that all actions of the Commission are properly taken.
b. 
Vice Chairman. During the absence, disability or disqualification of the Chairman, the Vice Chairman shall exercise or perform all the duties and be subject to all the responsibilities of the Chairman.
c. 
Secretary.
(1) 
To keep the minutes of all meetings of the Commission in an appropriate minute book.
(2) 
To be custodian of Commission records.
(3) 
To inform the Commission of correspondence relating to business of the Commission and to attend to such correspondence.
(4) 
To handle funds allocated to the Commission in accordance with its directives, the law and City regulations.
(5) 
To sign official documents of the Commission.

A. 
The City Planning and Zoning Commission shall have the powers authorized pursuant to Sections 89.320 through 89.470, RSMo., inclusive, including the following:
1. 
Organizing itself, maintaining records and minutes of its proceedings, preparing and recommending a City plan covering physical development within the City.
2. 
Make reports and recommendations to the City Council relating to the plan for the development of the municipality and the periodic updates thereof.
3. 
Review all proposals for changes to streets and public utilities (regardless of whether said utility is publicly or privately owned) as regards to conformance with the City plan.
4. 
Review all subdivision plats and recommend action on same in conformance with Sections 89.400 through 89.450, RSMo., inclusive.
5. 
Prepare as part of the City plan a major street plan which provides design standards for streets, pavements, street grades and the use of public street easements for other utilities or services, public or private.
6. 
The Planning and Zoning Commission may have such other duties as are provided it by the City Council, so long as said duties conform with the enabling Statute found at Chapter 89, RSMo.

Within the limits imposed by the funds available for its use, the Commission may employ such staff personnel and/or consultants as it sees fit to aid in its work. Appointments shall be made by a majority vote of the entire Commission membership, with approval of the City Council.
[CC 1999 §27-06]
Should any vacancy occur among the membership of this Planning and Zoning Commission by reason of death, resignation, disability or otherwise, immediate notice thereof shall be given to the City Clerk by the Secretary. The vacancy shall be filled by the appointment of a duly qualified replacement member, which replacement member shall be nominated by the Mayor and appointed by majority of the City Council, with such member to serve the unexpired term of office in which such vacancy shall occur.

These bylaws may be amended at any meeting of the Planning and Zoning Commission, provided that notice of said proposed amendment is given to each member in writing at least five (5) days prior to said meeting.
