A.
No
person shall maintain an animal kennel or engage in the keeping or
selling of animals, fowl or bees for commercial purposes within the
City without obtaining a permit. Application therefor shall be in
writing and filed with the Director of Public Works and shall contain
the following information:
1.
A sketch showing the location of the property for which the permit
is sought, together with the location of all buildings and structures
within three hundred (300) feet of such property;
2.
The number of animals, fowl or bees to be maintained;
3.
A detailed description of the shelter or other enclosures proposed
to be provided for the animals, fowl or bees, together with a description
of the arrangements proposed for storage of food or feed, for waste
removal, ventilation and such other information as may be required
by the Director of Public Works concerning the proposed facilities.

Upon the filing of any application under this Article, the Director
of Public Works shall inspect the premises and make such additional
investigation as he/she may deem proper to ascertain the adequacy
of the proposed facility for the safe and sanitary keeping and care
of the animals, fowl or bees. Upon a finding by the Director of Public
Works that the premises are properly zoned for the proposed use, that
the premises where the animals are to be kept are adequate and will
provide proper shelter and protection for such animals in a sanitary
atmosphere and that the proposed facility will not be in violation
of any applicable ordinance of the City, a permit shall be issued
upon payment of the fee specified by this Article.

A permit pursuant to this Article shall be issued for a period
of six (6) months. The fee upon original issuance shall be twenty-five
dollars ($25.00). A renewal permit shall be issued upon a determination
by the Director of Public Works, following a reinspection of the premises,
that the premises are being maintained in a clean and sanitary condition,
that the animals have not been subjected to suffering or cruelty,
that the keeping of such animals does not constitute a hazard to the
health, peace or safety of the community and that the maintenance
of the kennel is not in violation of any applicable law or ordinance
and upon payment of the renewal fee in the sum of twenty-five dollars
($25.00).

By acceptance of a permit under this Article, the permittee
shall be deemed to consent to inspection of the premises by the Police
or health officials of the City.

Any permit issued under this Article may be suspended by the
Director of Public Works or may be revoked after an opportunity is
given to the permittee for a hearing before the Director of Public
Works if the Director finds that the permittee has failed to provide
any animal in his/her possession, care or control with proper and
sufficient food, drink, shelter or protection or has subjected any
such animal to needless suffering, unnecessary cruelty or abuse or
has failed to maintain the premises in a clean and sanitary condition.
