A.
It
shall be the responsibility of the City Administrator to enforce this
Zoning Code.
B.
In
case any building or structure is erected, constructed, reconstructed,
altered, converted or maintained or any building, land or structure
is used in violation of this Chapter, the City of Louisiana, in addition
to other remedies, may institute any appropriate action or proceed
to prevent such unlawful activity, to restrain, correct or abate such
violations, to prevent the occupancy of said premises or prevent any
illegal act or use in or about such premises.
C.
The
owner, agent, lessee or tenant of any part of a building, structure
or premises in or upon which a violation has been committed or shall
exist or the agent, architect, building contractor or any other person
who commits, takes part or assists in any violation or who maintains
any building, structure or premises in or upon which any violation
shall exist shall be guilty of a misdemeanor.
D.
Upon
conviction thereof and at the discretion of the court, the punishment
shall be a fine of not less than ten dollars ($10.00) and not more
than one hundred dollars ($100.00) for each and every day such violation
shall continue, but if the offense is willful, on conviction thereof,
the punishment shall be a fine of not less than one hundred dollars
($100.00) and not more than two hundred fifty dollars ($250.00) for
each and every day that such violation shall continue or by imprisonment
for ten (10) days for each and every day such violation shall continue,
or by both such fine and imprisonment in the discretion of the court.
E.
Any
such person who having been served with an order from a court of jurisdiction
to remove any such violation, who shall fail to comply with such order
within ten (10) days and who has not filed an appeal to stay said
order within that time after such service or shall continue to violate
any provisions of the zoning regulations named in such order shall
also be subject to a civil penalty of two hundred fifty dollars ($250.00).
