A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Louisiana, being marked and designated as the International Fire Code, 2003 Edition, including Appendix Chapters A, B, C, D, E, F and G, as published by the International Code Council, be and is hereby adopted as the Fire Code of the City of Louisiana in the State of Missouri regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the City of Louisiana are hereby referred to, adopted and made a part hereof, as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.070 of this Article.

The following Sections of the International Fire Code adopted herein are hereby revised:
Section 101.1. Insert: City of Louisiana.
Section 109.3. Insert: (Misdemeanor), ($500.00), (90 days).
Section 111.4. Insert: ($50.00), ($500.00).

The Mayor and the Chief of the Fire Department shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits in addition to those now enumerated in the Code adopted by this Chapter. The Chief of the Bureau of Fire Prevention shall post such list in a conspicuous place in his/her office and distribute copies thereof to interested persons.

Nothing in this Article or in the code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in Section 500.090 of this Article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan of or directive of the Code Official or of a permit or certificate issued under the provision of this code shall be guilty of a misdemeanor punishable by a fine of not more than five hundred dollars ($500.00) or by imprisonment not exceeding ninety (90) days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
