A. It
shall be the duty of the City Marshal, upon his/her own knowledge
or on information given him/her by any person who is a resident of
the City, to serve a written notice to remove the obstruction on any
person who may have placed or thrown or caused to have been placed
or thrown on any street, avenue, lane, alley or sidewalk within the
City any wood, lumber, stone, brick or other obstruction. If the obstruction
is not removed within twenty-four (24) hours after such notice, the
Mayor shall cause the obstruction to be removed. After giving ten
(10) days' notice by at least four (4) written advertisements set
up at conspicuous places in the City stating where and when such property
is to be sold, the Mayor shall proceed to sell the property to the
highest bidder for cash in hand. But if such obstruction is such that
the value of the materials will not, in the opinion of the City Marshal,
pay the cost of removal together with the damages that may have accrued,
then he/she shall remove or cause the materials to be removed outside
the City limits, keeping an accurate account of the cost thereof,
and he/she shall commence suit against the offender in the name of
the City for all costs and damages of removing such obstruction and
recover the costs as other debts due the City or for breach of ordinance.
B. This
Section shall not be so construed to interfere with the placement
of building materials on the streets, sidewalks, lanes or alleys if
such materials shall not obstruct more than the sidewalk and one-half
(½) of the street. Such materials shall not remain in the streets,
avenues, sidewalks, lanes or alleys longer than necessary for the
erection and completion of the building for which they are intended.
C. Nothing
in this Section shall prevent any merchant or grocer from placing
packages or boxes of merchandise that he/she may be receiving or shipping
upon the sidewalk in front of his/her place of business if the packages
or boxes do not occupy more than one-half (½) of the width
of the sidewalk or remain on the sidewalk more than four (4) hours.

No person shall hang or suspend or cause to be hung or suspended
any article of goods, wares or merchandise over any sidewalk in the
City in such a manner as to obstruct the free passage along the sidewalk.

A. Permit Required. No building of any name or nature shall
be moved over, upon or through any street, lane or alley of the City
until the person owning or removing such building shall first obtain
a permit to do so from the City Administrator. Such permit, when given,
shall name the streets, lanes or alleys upon, over and through which
such building shall be moved, and such person shall not move any such
building over any other street, lane or alley than those designated
in the permit.
B. Removing, Raising Or Lowering Wires. Each person on the
request of any other person shall temporarily remove or raise or lower
wires to permit the moving of houses or other bulky structures. The
expense of such raising or lowering of wires shall be borne by the
person making such request and payment in advance may be required.
Not less than forty-eight (48) hours' advance notice shall be given
to arrange for such temporary wire changes.
C. Lights At Night. If it becomes necessary for any building
being moved to remain on the streets, lanes or alleys of the City
overnight, a light shall be placed in the front and rear of such building
as a protection to pedestrians and vehicles.
D. Bond. The City Administrator shall not give a permit to
any person to move any building through, over or upon any street,
lane or alley of the City unless the person asking for such permit
shall enter into a bond to protect the City with one (1) or more sufficient
securities to be approved by the City Council. Such bond shall be
in such sum determined to be adequate by the City Council, conditioned
for the payment of all damages that may accrue to the City or to any
person by reason of damages to property in moving such building, which
bond may be sued upon in the name of the City to the use of any person
injured by the breach of its conditions. The bond shall be filed in
the office of the City Clerk.

No person shall place or have placed any wire or rope along
or over any street or alley of the City or use the streets or alleys
of the City for any private or public business or enterprise of a
permanent nature or do or cause to be done any weighing, either for
private or public purposes, on any scales situated wholly or partly
in or on any street, gutter or sidewalk in the City without first
obtaining a special permit from the City Council to do so.

No person shall keep or leave open any cellar door or grating
of a vault on any sidewalk, pavement of any public place or at any
time suffer any such door or grating on premises occupied by him/her
to be in an insecure or dangerous condition.

A. All persons, firms or corporations owning or having the right to
control real property within the City shall keep paved sidewalks appurtenant
to said real estate swept and clean of mud, dirt and filth. After
any fall of snow such persons, firms, or corporations operating any
store, shop or other places of business shall, within twenty-four
(24) hours, remove into the street the snow from sidewalks appurtenant
to their real estate. All persons, firms or corporations owning or
having the right to control real property within the City shall also
remove snow from around any fire hydrants situated upon or adjacent
to such real property to the extent that such fire hydrants shall
be readily visible from the streets.
B. Penalty. Failure to comply with any provision herein
is declared to be a nuisance and a misdemeanor for each day of such
violation. Each such violation is punishable by a fine not to exceed
fifty dollars ($50.00).

The right is hereby granted to all persons maintaining power
lines or telephone or telegraph wires over streets or sidewalks to
trim trees, brush or hedges upon and overhanging the streets, alleys,
sidewalks and public places of the City to prevent such foliage from
coming into contact with wires and cables. All of such trimming shall
be done under the supervision and direction of the City Council or
any City Official to whom such duties have been or may be delegated.
