A.
The City of Weatherby Lake Zoning Code requires the following:
1.
Permit required. No building or other structure,
deck or driveway shall be erected, constructed, reconstructed, enlarged,
altered, demolished or removed, nor shall the use of any land be changed
without first obtaining approval and/or a permit from the Zoning Enforcement
Officer or his/her authorized delegate, to be used in accordance with
the terms of the Zoning Code.
2.
Expiration. Every permit issued by the Building Official under the provisions of this Code shall expire at eighteen (18) months and become null and void if the building or work authorized by such permit is not commenced within six (6) months from the issue date of the permit or if the building or work authorized by such permit is suspended or abandoned for a period of six (6) months or more after the work has commenced. Before such work can be commenced or resumed, a permit extension or renewal as required by Subsection (A)(3) or (4) below shall be obtained.
3.
Permit extension. A permittee holding an unexpired
permit may apply for a one-time six-month extension, provided the
permittee can show good and satisfactory reasons, beyond control,
that the work cannot be completed within the eighteen-month period
from the original permit issue date. An additional fee equal to one-half
(1/2) the original permit fee will be charged.
4.
Permit renewal. A permittee holding an expired
permit for which the applied work is not complete shall be required
to apply for a new permit at the cost of one percent (1%) valuation
of the job.
5.
No permit shall be issued until the applicant has furnished
the office of the City Clerk information satisfactory to the Zoning
Enforcement Officer or his/her authorized agent, which shall include
the following:
a.
Building permit application. The completion
of a building permit application shall include a listing of the location
of the lot to be built upon, the registered owner, the builder/contractor,
the scope of work to be performed, all setbacks to code, the project
valuation and be signed by both the owner and builder/contractor.
b.
Construction documents. Submittal documents
shall consist of construction documents and other data. Two (2) sets
of the documents shall be submitted with the building application
for permitting. The construction documents shall be prepared and sealed
by a Missouri registered design professional. Construction documents
shall be drawn on suitable material (minimum of eighteen (18) inches
by twenty-four (24) inches) and shall be of sufficient clarity to
indicate the location, nature and extent of the work proposed and
show in detail that it will conform to the provisions of this Code,
relevant laws, ordinances and rules and regulations as determined
by the Codes Enforcement Officer. Electronic media documents are permitted
for submission when approved by the Codes Enforcement Officer. (Ref.
IRC 2009 Section 106.1)
c.
Plot plan. The construction documents submitted
with the application for building permit shall be accompanied by two
(2) preconstruction stake plot plans sealed by a Missouri registered
land surveyor. The plot plan must show the proposed building as staked,
with setbacks from property lines, to the roof overhang of the building,
including external stairs or decks proposed to be built, easements
and platted building lines. In addition the plot plan shall have five-foot
contours, existing and proposed, top of foundation wall elevation,
first floor elevation and show the proposed temporary gravel driveway
with three-quarters-inch rock minimum and required erosion control
measures. (Ref. IRC 2009 Section R106.2)
d.
List of materials. Completion of building materials
list that will be used to complete the structure if a new house or
a list of materials and components if the project is a remodel or
renovation of an existing structure.
e.
Erosion control plan. An erosion control plan shall be submitted in compliance with Weatherby Lake Code Section 500.060 and is the responsibility jointly and severally of the property owner and builder/contractor.
f.
Approval of construction documents. When the
Codes Enforcement Officer issues a building permit the construction
documents shall be approved with a stamp that states "Reviewed for
code compliance." One set of reviewed construction documents shall
be retained by the Codes Enforcement Officer. The other set shall
be returned to the applicant and shall be kept at the work site and
shall be open to inspection by the Codes Enforcement Officer or his/her
authorized agent. (Ref. IRC R106.3.1)
g.
Waiver for sealed construction documents. The
Codes Enforcement Officer is authorized to waive the requirement for
construction documents to be prepared by a registered design professional
for remodeling and/or alteration or repair projects, provided the
remodeling, alteration or repairs do not entail changes to the foundation
or basic building supporting structure and/or load-bearing wall of
the house being remodeled, altered or repaired.
h.
Board of Zoning Adjustment. While all of the above said documents need to be presented and approved by the Zoning Enforcement Officer before he/she may issue a permit, the applicant may upon the submission of a plot plan [set forth in Subsection (A)(5)(c)] appeal/apply to the Board of Zoning Adjustment pursuant to Section 405.400A(1) of this Code to determine whether the Zoning Board of Adjustment will give a variance from the requirements of this Code as it relates to said plot plan.
6.
The Zoning Enforcement Officer or his/her authorized delegate
shall present this information to the Plans Review Committee of the
Planning Commission for the Committee's review. Within five (5) working
days of receiving this information, the Plans Review Committee may
recommend to the Zoning Enforcement Officer or his/her authorized
delegate the issuance or denial of a building permit to the applicant.
7.
No permit shall be issued by the Zoning Enforcement Officer
or his/her authorized delegate unless the Plans Review Committee has
approved such action.
8.
The Plans Review Committee shall not approve the issuance of
a building permit nor shall a permit be issued by the Zoning Enforcement
Officer or his/her authorized delegate unless the plan or information
submitted by the applicant shall show that such building, structure,
deck or driveway is to conform in all particulars with the provisions
of the Zoning Code.
a.
If the Committee determines that the information does conform
to the Zoning Code, it shall recommend to the Zoning Enforcement Officer
or his/her authorized delegate to issue a permit to the applicant.
b.
If the Committee determines that the information does not conform
to the Zoning Code, it shall recommend to the Zoning Enforcement Officer
or his/her authorized delegate that the permit is denied.
c.
Record of such applications and plans shall be kept in the office
of the City Clerk.
9.
The Zoning Enforcement Officer or his/her authorized delegate,
in his/her own discretion or upon direction from the Board of Alderpersons,
shall have the power to revoke any permit which has been issued in
case of violation of the conditions of such permit or upon a violation
of the provisions of the Zoning Code.
10.
Work exempt from permit.
a.
Retaining walls not over four (4) feet measured from bottom
of footing to top of wall unless supporting a surcharge, i.e., retaining
walls for a driveway into a basement garage. All retaining walls over
four (4) feet require a permit. (Note: Replacement of all sea walls
requires a permit and coordination with the Weatherby Lake Improvement
Company.)
b.
Ordinary repairs and general maintenance, i.e., replacing broken
windows, painting, paperhanging, tiling, carpeting and similar finish
work. The repairing of appliances, plumbing and electrical fixtures,
where no basic structure is changed or electrical wiring, gas, mechanical,
vents or plumbing system relocation added to or altered.
11.
Building inspections (Ref. IRC Code 113).
a.
General. Construction of work for which a permit
is required may be subject to inspections by the Zoning Enforcement
Officer or his/her delegate, and such construction or work shall remain
accessible and exposed for inspection purposes until approved.
b.
Preliminary inspections. Before issuing a permit,
the Zoning Enforcement Officer or his/her delegate is authorized to
examine the structure or site for which an application has been filed.
c.
All inspections called for on the inspection check card shall
be completed and signed off prior to proceeding with additional work.
d.
Request for inspections shall be submitted twenty-four (24)
hours prior to requested inspection appointment.
e.
Request for inspections during normal business hours (8:00 A.M.
to 2:00 P.M., Monday through Friday, except City-recognized holidays)
shall be charged at the rate of forty dollars ($40.00) per hour with
a minimum charge of forty dollars ($40.00); all inspections outside
normal business hours shall be charged at the rate of sixty dollars
($60.00) per hour with a minimum of one hundred twenty-five dollars
($125.00).
f.
Request for repeat inspections or repeat inspections due to
incomplete work or code violations during normal business hours (8:00
A.M. to 2:00 P.M., Monday through Friday, except City-recognized holidays)
shall be charged at the rate of forty dollars ($40.00) per hour with
a minimum charge of forty dollars ($40.00); all inspections outside
normal business hours shall be charged at the rate of sixty dollars
($60.00) per hour with a minimum of one hundred twenty-five dollars
($125.00).
g.
The Zoning Enforcement Officer or his/her delegate may refuse
to issue a permit and/or pass an inspection if the work is not accessible
and exposed for inspection or there is not someone present with whom
the Zoning Enforcement Officer or his/her delegate can communicate
in English and the absence of such a person materially prevents or
hinders the inspection with regard to the time of the inspection,
the time needed to do the inspection and/or the information available
to the inspector.
12.
Required inspections.
a.
Footing. Inspection may be made after forms
and reinforcing are in place according to print.
b.
Foundation. Inspection may be made after forms
and reinforcing are in place according to print.
c.
Underground plumbing. Inspection may be made
after all underground plumbing is installed when vapor barriers are
installed; an additional inspection will be made prior to pouring
concrete.
d.
Frame inspection (rough). Inspection may be
made after roof framing bracing is in place, after all plumbing, pipes,
vents, chimney, rough electrical, heating, etc., are installed.
e.
Weather-resistant covering. Inspection may
be conducted after wind/water-resistant exterior covering is installed.

f.
Window and door flashing. Inspection may be
conducted after all flashing for windows and door flashing is installed.
(Ref. IRC R708.8.)
g.
Special inspections. Special inspections may
be conducted, when required by the Zoning Enforcement Officer or his/her
delegate, when normal inspections do not cover the scope of the work
proposed.
h.
Other inspections. In addition to the called
inspections above, the Zoning Enforcement Officer may make or require
any other inspections to ascertain compliance with the Code and other
laws enforced by the Zoning Enforcement Officer.
i.
Final inspection. The final inspection may
be made after all work required by the building permit is accomplished.

No newly constructed house shall be occupied until the Zoning
Enforcement Officer or his/her delegate have signed the final inspection
card and have issued a certificate of occupancy.

Notwithstanding the provisions of Section 405.350, the Zoning Enforcement Officer is authorized to issue a temporary certificate of occupancy before the completion of the entire work covered by the permit, provided that such portion or portions shall be occupied safely. The temporary certificate of occupancy will be issued for a maximum of thirty (30) days. Weather related delays will be granted sixty (60) to ninety (90) days on a case by case basis.

New Residences. One percent (1%) of valuation or calculation
by multiplying livable square footage, basement, finished/unfinished
square footage and garage square footage times the current average
building cost per square foot.

The contractor, builder or owner prior to start of construction shall secure a completion bond per the fee schedule set forth hereinafter in Section 405.370(C).

B.
Additions, Remodels And Alterations. One percent (1%) of valuation based upon construction contract, which includes cost of labor and materials. If no contract exists, cost of materials substantiated by documentation and an estimate of labor cost using prevailing labor rates may be used or upon the reasonable cost of labor and materials if there is no construction contract, one hundred dollars ($100.00) minimum charge. (Note: The Plans Review Committee will estimate the cost if the applicant does not present documentation of material and labor cost.) The contractor, building or owner prior to start of construction shall secure a completion bond per the fee schedule set forth hereinafter in Section 405.370(C).
C.
Decks, Patios, Sunrooms, Porches, Swimming Pools, Spas, Driveways,
Hot Tubs, Gazebos And Accessory Buildings. One percent (1%)
of valuation based upon construction contract, which includes reasonable
cost of labor and materials, and if no contract exists, substantiated
by documentation and an estimate of labor cost using prevailing labor
rates or upon the reasonable cost of labor and materials if there
is no construction contract, twenty-five dollars ($25.00) minimum
charge. (Note: The Plans Review Committee will estimate the cost if
the applicant does not present documentation of material and labor
cost.)
Completion bond (renovating/alterations). The
contractor or builder, prior to start of construction, will secure
a completion bond. The amount of the bond is based on the following
formula.
0 to $20,000.00 — Bond $300.00 of which $250.00 will be
placed into escrow to be returned following final inspection.
$20,001.00 to $50,000.00 — Bond $500.00 of which $400.00
will be placed into escrow to be returned following final inspection.
$50,001.00 to $100,000.00 — Bond $1,000.00 of which $750.00
will be placed into escrow to be returned following final inspection.
Over $100,001.00 — Bond $1,500.00 of which $1,000.00 will
be placed into escrow to be returned following final inspection.
D.
Erosion Control Permit (Landscaping, Etc.). – $100.00
E.
Demolish And/Or Removal Fee. – $100.00

A permit will be obtained to demolish or remove any existing
structure in the City.
