No person and no agent, servant or employee of any person shall open or use any public fireplug or fire hydrant or take any water therefrom for building purposes, street sprinkling, flushing of sewers or gutters or for any other purpose without first obtaining a written permit from the following:
A. 
For the purpose of using water for building purposes, said permit shall be obtained from the Water and Sewer Billing Division as provided in § 840-35.

B. 
For all other purposes, said permit shall be obtained from the Department of Public Works.

A. 
All contractors, builders or other persons desiring to open or use any public fire hydrant or fireplug for the purpose of taking any water therefrom for building purposes shall first obtain a written permit therefor from the Water and Sewer Billing Division which permit shall be granted upon condition that a meter, as approved by the Department of Public Works, shall be installed at the cost and expense of the permittee.

B. 
Payment for the use of such installation shall be made in accordance with the prescribed schedule of metered rates.
C. 
If the circumstances so require, the Water and Sewer Billing Division may waive the requirements for the installation of the meter, and, in lieu thereof, a flat charge of $100, payable in advance, for the use of said water for a period of one month shall be made.

Nothing in this article shall be deemed to apply to the action or conduct of any officer, agent or employee of the City who is duly authorized to open or use a public fire hydrant or take any water therefrom.
