As used in this Article the following terms shall have these prescribed meanings:
AMBULANCE
Any privately or publicly owned motor vehicle or, on or after January 1, 1988, any craft, if such motor vehicle or craft is specially designed or constructed and equipped and is intended to be used for and is maintained or operated for the transportation of patients, including dual-purpose police patrol cars and funeral coaches or hearses which otherwise comply with the provisions of Sections 190.100 to 190.190, RSMo., but the term does not include any motor vehicle specially designed, constructed or converted for the transportation of persons permanently disabled and normally using a wheelchair, or handicapped persons not acutely ill, or emergency vehicles at airports.
AMBULANCE SERVICE
Any service established to transport patients (see "patient" below).
ATTENDANT
A trained and qualified individual responsible for the operation of an ambulance and the care of the patients transported thereby whether or not the attendant also serves as driver.
DRIVER
Any individual who operates or attempts to operate an ambulance vehicle on the streets, alleys or other public thoroughfare within the limits of the City of Blue Springs, Missouri.
CITY
Blue Springs, Missouri.
PATIENT
An individual who is sick, injured, wounded, diseased, or otherwise incapacitated or helpless, or dead, excluding deceased individuals being transported from or between private or public institutions, homes or cemeteries, and individuals declared dead prior to the time an ambulance is called for assistance.
PERSON
Any individual, firm, partnership, association, corporation, company, group of individuals acting together for a common purpose or organization of any kind, including any governmental agency other than the United States or the State of Missouri.
POLICE
Duly authorized full time members of the Police Department of the City of Blue Springs, Missouri.

No person, either as owner, agent, or otherwise, shall furnish, operate, maintain, advertise or otherwise engage in or profess to engage in the business of an ambulance service, within the City, unless they hold a currently valid license for an ambulance service issued by the City pursuant to this Article and by the Department of Health and Senior Services.

A. 
Licenses shall not be required for ambulance services which are:
1. 
Owned and operated by an agency of the United States Government or by the Central Jackson County Fire Protection District or by the City of Blue Springs, Missouri.
2. 
Rendering requested assistance to ambulances currently licensed in cases of disaster or major emergency too great for local resources; or in response to the provisions of written community mutual aid agreements.
3. 
Operated from a location or headquarters outside the City and transporting patients who are picked up outside the limits of the City to locations within the City, or through the City to other locations.

A. 
Application for a license hereunder shall be made on such forms as may be provided by the Chief of Police or their designee and shall contain the following information:
1. 
Name and address of the applicant and the trade name under which business will be conducted; if a corporation, the name, date and place of incorporation, address of principal office of business and the names and addresses of the principal officers and the registered agent for the corporation; if a partnership, association or other business entity, the names of the partners or other persons comprising the association or business entity and the business and residence address of each partner or other person involved in the business and the operation;
2. 
The number of vehicles to be operated or controlled by the applicant and a description of each vehicle;
3. 
Name and address of each employee and statement of qualifications of each such employee as an ambulance driver or attendant;
4. 
Copy of current ambulance license issued by the Department of Health and Senior Services or its successor.

There shall be at all times at least two (2) Department of Health and Senior Services licensed personnel on each ambulance licensed and operated under this Article.

No license shall be issued, renewed, or continued in operation unless the applicant or the holder thereof has paid a license fee of twenty-five dollars ($25.00). Any license issued under this Article shall be for a period of one year from the date of issuance or renewal. Said license fee shall be in addition to any other license fee or charge established by any business and occupational license ordinance of the City applicable to said holder or the vehicle or vehicles under their operation or control.

A. 
Under the provisions of this Article the Chief of Police or their designee is hereby empowered and directed to:
1. 
Accept applications for licenses issued pursuant to this Article and to cause such investigation as they deem necessary with respect to the applicant and the proposed operation;
2. 
Issue the appropriate license hereunder with said license to be for a term of one (1) year unless earlier suspended, revoked or terminated, when they find that all requirements of this Article and all ordinances of the City together with all other applicable laws, including without limitation, all laws, rules and regulations of the State of Missouri have been met;
3. 
Reinspect, re-examine or cause reinspection or re-examination within thirty (30) days prior to requested renewal of license for any and all requirements to license renewal;
4. 
Initiate proceedings for revocation of any license issued pursuant to this Article through the appropriate agency of the State of Missouri or by initiation of a revocation proceeding under the procedures set out in Chapter 140 of this Code.

False information contained in an application for a license hereunder shall be considered sufficient grounds for denial of said license.

No ambulance license shall be issued under this Article, nor shall such license be valid, nor shall any ambulance be operated in the City unless there is at all times in force and effect insurance coverage in the amount required by the Director of the Department of Health and Senior Services, issued by an insurance company licensed to do business in the State of Missouri, for each and every ambulance owned and/or operated by or for the applicant or licensee. An insurance certificate shall be submitted to the Chief of Police or designee for approval prior to the issuance of such ambulance license. Satisfactory evidence that such insurance is at all times in force and effect shall be furnished to the Chief of Police or designee in such form as they may specify. Each insurance policy required hereunder shall be for the period covered by the license applied for and the insurer shall be obligated to give not less than thirty (30) days written notice to the Chief of Police or designee and to the insured prior to cancellation or termination thereof sooner than the expiration date of said policy. The cancellation and/or other termination of such policy shall cause immediate revocation and termination of the license issued for the ambulance covered by such policy unless other insurance in compliance with the provisions of this Article and this Section shall be provided and be in force and effect from the date of cancellation or termination of the prior policy and with a term extending to the expiration date of said license.

Every vehicle operated under this Article shall be kept clean and sanitary according to rules and regulations which may from time to time be promulgated by the Chief of Police or designee.

The Chief of Police or designee may and is hereby authorized to suspend or revoke a license issued hereunder for failure of a licensee to comply with and to maintain compliance with this Article and all other ordinances of City or for failure of licensee to comply with and maintain compliance with regulations promulgated hereunder or under any other applicable laws, rules, regulations, including without limitation, Sections 190.100 through 190.190, RSMo. Should the licensee fail to comply with the requirements of this Article or other ordinances of the City or with the statutes, rules and regulations of the Director of the Department of Health of the State of Missouri, the Chief of Police or designee may issue a notice of intent to revoke or suspend the license issued under this Article on behalf of City or may initiate proceedings with the Department of Health and Senior Services with respect to suspension or revocation of any license issued hereunder. The licensee shall be afforded a hearing in accordance with the procedures set out in Chapter 140 of this Code. The decision of the Hearing Officer shall be promptly transmitted to licensee. Suspension or revocation of any license pursuant to action of the State of Missouri Department of Health and Senior Services shall be processed as provided by State Statute.
All ambulance-type services operating within the City limits shall comply with State law.

Every person who is convicted of violation of any of the provisions of this Article shall be punished as set out in Section 100.080 of this Code.
