For the purpose of this Part, certain terms are herewith defined:
SWIMMING POOL
Any artificially constructed, belowground pool capable of being used for swimming or bathing, having a depth of two feet or more at any point.
PORTABLE POOL
Any artificially constructed, portable, aboveground pool capable of being used for swimming or bathing, having a depth of two feet or more at any point.
PRIVATE
That it is not open to the public, that it is not publicly owned, or not otherwise regulated by the State of Pennsylvania either by statute or by rules or regulations of one of its administrative bodies.

Before work is commenced on the construction of a private swimming pool or on any addition, alteration, remodeling or other improvement to a private swimming pool, a permit must be obtained from the Susquehanna Township Building Inspector. Application for such permit shall show the name of owner, the location of the proposed swimming pool, the manner in which its use shall be supervised, the safety precautions to be made to protect those making use thereof, or who might be endangered thereby, information showing size, depth, and capacity of such swimming pool, and shall be accompanied by a copy of such plans, which plans to remain on deposit with the Building Inspector and such application shall also provide such other information as is necessary for the protection of the public health and safety as may be required by the Building Inspector. There shall also be filed with the Building Inspector a plot plan of the property showing the location of such swimming pool which shall contain information as to type, height and location of the fence surrounding such swimming pool, and the number of gates therein.

Swimming pools shall not be any nearer than eight feet from the side or rear lot lines or from any house, building or residence.
2. 
No exposed electric wires shall be nearer than six feet from the water's edge, nor shall any exposed and permanently installed electric wire within 25 feet from the water's edge of a swimming pool be less than 10 feet above ground, nor shall wires of any kind cross or be over the water surface unless otherwise approved by the Building Inspector. Any underwater lighting shall be accomplished by the use of methods and materials approved for such purposes.
3. 
There shall be no cross-connections of the Township water supply with any other source of water supply for a swimming pool. The line from the Township water supply to the pool shall be protected against backflow of polluted water by means of an air gap and shall be discharged at least six inches above the maximum highwater level of the make-up tank or the pool.
4. 
Subject to the approval of the Township Engineer, the drain line for a swimming pool may be connected to the Township sewer system if the following provisions are complied with:
A. 
The drain shall be connected to the storm sewer if one is available.
B. 
Where a storm sewer is not available, the drain may be connected to a sanitary sewer or a combined sewer subject to the approval of the Township Engineer or his duly authorized representative and the Susquehanna Township Authority.
5. 
The construction of the swimming pool shall be made in such a manner that all scum, splash and deck water shall not return to the pool except through a filter system.
6. 
The swimming pool shall be kept free at all times of floating material, sediment and debris either by an automatic surface skimmer, scum gutter or by some other means approved by the Health Department.
7. 
The entire recirculating system shall be capable of filtering and recirculating the entire volume content of the swimming pool during a twelve-hour period. The rate of application of pool water on the filters shall not be greater than three gallons per minute per square foot of filter area. The Health Department may approve other rate of circulation or rate of application of water on the filters.
8. 
A provision shall be made for positive germicidal or bacterial control of a swimming pool's water by the use of chlorine, bromide or other such disinfecting agents as may be approved by the Health Department.
A. 
Such disinfecting agents shall be applied to the water at a uniform rate.
B. 
Provisions shall be made for adjusting the application thereof so as to keep the germicidal or bacterial protection of the water equal to standard of 0.5 parts per million to 1.0 parts per million chlorine residual.
C. 
Testing devices capable of accurately measuring such residual shall be provided by the pool owner.
9. 
All swimming pools to be constructed or which are already constructed shall be enclosed by an effective barrier not less than four feet in height, which shall be so constructed as to have no openings, holes, or gaps larger than two inches in any dimension, to separate said pool from a public thoroughfare or area. If the barrier is a picket fence the horizontal dimensions maintained shall not exceed four inches. A dwelling or accessory building may be used as part of such barrier. All points of entry into the property area shall have a gate, having a high, automatic locking device, inaccessible to small children, which shall be a self-closing, self-latching device on the pool side for keeping the gate securely closed at all times when not in use, except that the door of any dwelling or accessory building which forms a part of the enclosure need not be so equipped. The barrier shall surround the pool and the deck area.

1. 
Portable pools are not subject to the permit, design, or other requirements as set forth herein. However, all such pools having walls less than four feet shall be enclosed in accordance with provisions of this Part.
2. 
Portable pools having walls four feet or greater in height may be excluded from the fencing requirement, provided such pools are equipped with access ladders which may be raised and locked in a near vertical position when the pools are unattended. A portable pool which is served by a ladder or steps which cannot be raised and locked so as to prevent access by small children shall be enclosed in accordance with § 22-104(9) of this Part.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and costs, or in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
