As used in this Chapter, the following
terms shall have these prescribed meanings:
Chapter 44, RSMo., as amended.
For purposes of this Chapter, the Mayor of Blue Springs.
The "Director" shall serve as chair coordinator of the Central
Jackson County Emergency Management Agency (CJCEMA) as set forth in
Chapter 44.
The "Coordinator" shall serve as Coordinating Committee Member
representing the City of Blue Springs within the Central Jackson County
Emergency Management Agency, CJCEMA.

A.
Created. There is hereby created the local
organization, the Central Jackson County Emergency Management Agency,
for the preparation and the carrying out of all the emergency functions
other than functions for which the military forces are primarily responsible,
to minimize and repair injury and damage resulting from disaster as
defined in Chapter 44, RSMo., Civil Defense.
B.
Membership. This Agency shall consist of
a Director and other additional coordinating committee members to
be selected by the member cities in order to conform to the State
Emergency Management Agency and procedures for the conduct of emergency
operations as outlined in said Chapter 44.

The Agency shall perform such emergency management functions within the boundary as shall be prescribed in and by Chapter 44 and the State civil defense planning prepared by the State, and such orders, rules and regulations as may be promulgated by the Governor, and, in addition, shall perform such duties outside the corporate limits as may be required pursuant to any mutual-aid agreement with any other City, municipality or fire district entered into as provided by Section 250.050.

A.
Appointment. An Emergency Management Coordinator
for the conduct of emergency operations shall be appointed by the
Mayor and shall serve until removed by the same.
B.
Responsibilities. The Emergency Management
Coordinator shall have such responsibilities for the organization
and administration of emergency management functions for the City
of Blue Springs and shall serve as a member on the CJCEMA Coordinating
Committee as delegated by the Mayor as Chief Executive Officer subject
to the direction and control of the Mayor, City Administrator and
City Council.
C.
Appointment Of Personnel. The Emergency
Management Coordinator shall have the power to appoint without compensation
or remove any personnel as needed by the Agency for its efficient
operation.

A.
Authority Of City To Enter Into. The Mayor
may enter into mutual-aid arrangements or agreements with other public
and private agencies within and without the State for reciprocal emergency
aid. Such arrangements or agreements shall be consistent with the
State's plans, and in time of emergency it shall be the duty of each
local organization for emergency management and/or civil defense to
render assistance in accordance with the provisions of such mutual-aid
arrangements or agreements.
B.
Duty Of Emergency Management Coordinator.
The Emergency Management Coordinator of each local organization for
emergency management and/or civil defense may assist in negotiation
of reciprocal mutual-aid agreements between their organization and
other public and private agencies and between the Governor and the
adjoining States or City thereof, and shall carry out arrangements
or agreements relating to the local unit.

In carrying out the emergency powers
under the provisions of this Chapter, the Mayor and City Council of
the City of the State are directed to use the services, equipment,
supplies and facilities of existing departments, offices and agencies
of the State and of the City, and the officers and personnel of all
such departments, offices and agencies are directed to cooperate with
and extend such services and facilities to the State Emergency Management
Agency upon request.

Whenever the Federal Government or
officer or agency thereof shall offer to the City, through the State,
services, equipment, supplies, materials or funds by way of gift,
grant or loan for the purpose of emergency management and/or civil
defense, the City, through the Mayor, with the consent of the Governor,
may accept the offer and may receive those services, equipment, supplies,
materials or funds on behalf of the City, subject to the terms of
the offer.

In the event of an emergency as defined
in Chapter 44, the Emergency Management Coordinator is authorized
to procure such services, supplies, equipment or material as may be
necessary for such purposes, in view of the exigency, without regard
to the statutory procedures or formalities normally prescribed by
law pertaining to municipal contracts or obligations as authorized
by Chapter 44, provided that if the City Council meets at such time, they
shall act subject to the directions and restrictions imposed by that
body.

In the event of enemy attack, the
Mayor, City Administrator or City Council may waive any time-consuming
procedures and formalities otherwise required by Statute, City Code
or purchasing policies pertaining to the advertisement for bids for
the performance of public work or entering into contracts.

Every person appointed to serve in
any capacity in the Central Jackson County Emergency Management Agency
shall, before entering upon their duties, subscribe to the following
oath, which shall be filed with the Director:
"I _______________, do solemnly swear
(or affirm) that I will support and defend the Constitution of the
United States and the Constitution of the State of Missouri against
all enemies, foreign and domestic; that I will bear true faith and
allegiance to the same; that I take this obligation freely, without
any mental reservation or purpose of evasion; and that I will well
and faithfully discharge the duties upon which I am about to enter.
And I do further swear (or affirm) that I do not advocate nor am I
a member of any political party or organization that advocates the
overthrow of the government of the United States or of this State
by force or violence; and that during such a time as I am a member
of the Central Jackson County Emergency Management Agency, I will
not advocate nor become a member of any political party or organization
that advocates the overthrow of the government of the United States
or of this State by force or violence."

The Mayor, City Administrator or
City Council is authorized to designate space in any municipally owned
or leased building for the Central Jackson County Emergency Management
Agency as its office.

It shall be the responsibility of
the City of Blue Springs to adopt and put into practice the National
Incident Management System promulgated by the United States Department
of Homeland Security.
