A. 
Adoption. There is hereby adopted by reference the 2000 Edition of the International Private Sewage Disposal Code, including Appendix A and Appendix B, as published by the International Code Council for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of individual sewage disposal systems (septic tanks) in the City of De Soto and providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, conditions and terms of such International Private Sewage Disposal Code, 2000 Edition, three (3) copies of which are on file in the office of the City Clerk of the City of De Soto, are hereby referred to as, adopted and made a part hereof as fully as if set out in this Section.
B. 
Appointment Of Code Official. The "Code Official" under the code shall be the City Manager or the duly authorized representative of the City Manager.
C. 
Insertions. The following Sections of the International Private Sewage Disposal Code, 2000 Edition, are revised as follows:

Section 101.1. In the second line insert "City of De Soto".
2. 
Section 106.4.2. In the third line insert "$100.00".
3. 
Section 106.4.3. In subparagraph 2 insert "0%" and in subparagraph 3 insert "0%".
D. 
Deletions. The following Sections of the International Private Sewage Disposal Code, 2000 Edition, are deleted:

Section 103.1.
2. 
Section 103.2.
3. 
Section 103.3.
4. 
Section 103.4.
5. 
Section 109.
E. 
Appeals. Any person aggrieved by a decision of the Code Official or the duly authorized representative of the Code Official shall have the right to appeal that decision to the Board of Adjustment established in Section 405.410 of the De Soto City Code within thirty (30) days after service of the notice of the decision. An application for appeal shall be based on a claim that the true intent of the code, or the rules legally adopted thereunder, have been incorrectly interpreted, the provisions of the code do not fully apply or an equally good or better form of construction is proposed. Any appeal from the decision of the Board of Adjustment shall be filed with the Circuit Court of Jefferson County, Missouri, in the manner and time required by law after such decision is served upon the parties. Service upon the parties shall be deemed completed upon delivering or mailing a copy of the decision to the parties.

Any person, firm or corporation who shall violate a provision of the International Private Sewage Disposal Code, 2000 Edition, or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair private sewage disposal work in violation of the approved construction documents or directives of the Code Official or of a permit or certificate issued under the provisions of the code or who shall continue any work on a system after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be guilty of a misdemeanor punishable as provided in Section 100.090 of the De Soto City Code. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
