The Mayor and the Board of Aldermen shall have power and authority, by ordinance, to open and improve streets, avenues, alleys and other highways and to make sidewalks and to build bridges, culverts, drains and sewers within the City and to establish grades for all improvements herein mentioned and shall exercise exclusive control over all streets, avenues, alleys and public highways within the limits of the City.

All persons are hereby required to take reasonable measures, excluding physical repairs, to keep the sidewalk in front of, or adjacent to, the property or premises owned or occupied by them or under their control, within the City, clear and free of hazards so as not to endanger or inconvenience pedestrians using such sidewalks.

It is hereby made unlawful for any person or persons, partnership or corporation to dig into or disturb or change the existing condition thereof in any manner any street, alley or public thoroughfare in the City of Seymour, Missouri, except as hereinafter provided.

Any person or persons, partnership or corporation desiring to dig into or disturb or change the existing condition of any street, alley or public thoroughfare in any manner, or for any purpose, shall before so doing apply to the City Clerk of the City of Seymour, Missouri, and be issued a written permit for the purpose requested.

Before issuing any permit as herein provided, the City Clerk shall obtain the approval thereof from the City Engineer of said City, whose approval shall be endorsed on said permit.

Each applicant for a permit to dig in any street or hard surfaced alley shall, upon applying for said permit, deposit with the City Clerk of the City a sum as designated by the City Administrator and receive a receipt therefrom. Said deposit shall be deposited in the General Fund of said City to cover expenses of repairing said street or hard surfaced alley. The City will be responsible for repairing said street or alley.
