[CC 1988 §50.010]
It shall be unlawful for any person, either directly or indirectly, to conduct any business, trade, location, calling or occupation in whole or in part for which a license or permit is required until said license having been first procured and thereafter kept in effect at all times as required by this Article.

A. 
Except as may be required by this Article, a person shall be deemed to be in a business or engaged in a non-profit enterprise within the meaning of Section 605.010 when he/she does one act of:
1. 
Selling any goods or services;
2. 
Soliciting business or offering goods or services for sale or hire; or
3. 
Using any vehicle or any premises in the City for business purposes.

The City license officer shall make an initial determination of whether or not any particular business activity, occupation, solicitation or service shall be embraced within the provisions of this Article. Such determination shall be reasonably made based upon the generally accepted concept of each such activity, occupation, solicitation or service with regard and the intention of the General Assembly in the amendment of Section 94.270, RSMo., and other applicable Sections of the Revised Statutes of Missouri, except as may be provided otherwise in this Article, such determination by the City license officer shall be final and binding on all persons affected thereby unless and until such determination is held invalid by a court of competent jurisdiction.

The local agents or other representatives of non-residents who are doing business or engaged in non-profit enterprises in this City shall be personally responsible for compliance, of their principal and of the business and enterprises they represent, with applicable provisions of this Article.

Except as may be provided otherwise by this Article, no license shall be required by any person for mere delivery of any person or property purchased or acquired from such person at his/her regular place of business outside the City where no intent by such person is shown to exist to pervade the provision of this Article.

A. 
The City Clerk shall be the City license officer and shall issue in the name of the City all licenses and permits required by this Article to all qualified applicants therefor after all required taxes and fees have been paid in accordance with the provision of this City Chapter and a copy of Missouri sales tax license has been provided to the City Clerk.
B. 
Evidence Of Workers' Compensation Insurance Prior To Business License Issuance. No business license required under the provisions of this Article shall be issued by the City Clerk to any person doing business as a construction contractor until such person produces a copy of a certificate of insurance for Workers' Compensation coverage if the applicant for the license is required to cover his/her liability under Chapter 287, RSMo.

A person engaged in two (2) or more businesses at the same location shall be required to obtain a separate license for conducting each of such businesses but when eligible shall be issued one (1) license which shall specify on its face all of such businesses. The license fee shall be in addition to any other applicable tax or fee required by any other Chapter of the City Code.

When a licensee places himself/herself in a new status, the City license officer shall issue a supplemental license and such additional insignia as may be required.

A duplicate license shall be issued by the City license officer to replace any license or such permit previously issued and which has been lost, stolen, defaced or destroyed without any willful conduct on the part of the applicant upon the filing by him/her of an affidavit attesting to such fact and upon the payment of a fee of five dollars ($5.00).

Each licensee under this Article who conducts business on or from licensed premises shall post and maintain such license upon the licensed premises in a place where it may be seen at all times.

Every licensee under this Article who has no licensed business premises shall carry his/her license on his/her person and shall display it to the City Officer having authority to enforce this Article and the persons with whom he/she transacts or seeks to transact business at their request.

No license under provision of this Article shall be granted for a longer or shorter term than the time specified authorizing a license tax be levied and collected and each license shall terminate one (1) day, two (2) days or one (1) year, as the case may be, from the day on which the same is issued, provided that the term for all annual licenses shall be on the first (1st) day of July in each year.

No license issued under the provision of this Article shall be assigned or transferred; no money paid to the City Collector for any such license shall be refunded by this City or by any office thereof.

A. 
No license or permit provided for or required under this Article or any other ordinance of the City shall be issued by the City to any person until all applicable taxes including real property tax of the applicant for such license or permit shall have first been paid.
B. 
It shall be the duty of the City Collector to establish and promulgate rules and regulations relative to an orderly method of checking unpaid taxes in order to determine the amounts thereof due and owing to the City by any such applicant.

A. 
Business/merchant licenses shall not be issued without certification from the Building Inspector that the premises are in compliance with all applicable Zoning and Building Codes. A certification of inspection shall only be issued by the City Building Inspector if it is determined that the proposed use of, and the proposed premises are:
1. 
In compliance with all applicable zoning regulations of Lake Saint Louis;
2. 
Safe and habitable to the general public including, but not limited to, satisfactory handicapped facilities;
3. 
In compliance with the necessary parking facilities for the intended use in accordance with Chapter 425, Article III, Parking, Access, and Mobility;

4. 
In compliance with all applicable Building Codes; and
5. 
In compliance with all provisions within Article IV chronic and aggravated chronic nuisances.

B. 
An application for inspection must be obtained by the applicant seeking a business/merchant license pursuant to this Article and the City Building Inspector and his/her authorized agent shall perform an inspection to determine whether a certification may be issued only if one (1) or more of the following circumstances exist:
1. 
This is the first (1st) time the applicant has filed for a business/merchant license in the City of Lake Saint Louis;
2. 
This is the first (1st) time the applicant has filed on behalf of the business in which the applicant is involved and for which the applicant is seeking a business/merchant license;
3. 
The location of the business in which the applicant is involved and for which the applicant is seeking a business/merchant license has changed since the last business/merchant license application;
4. 
The ownership of the business in which the business/merchant license applicant is engaged is changed since the last business/merchant license;
5. 
The ownership of the premises on which the business is located has changed since the last application for business/merchant license; or
6. 
The nature of the business in which the applicant is involved and for which the applicant is seeking a business license has changed since the last application for a business/merchant license.
It shall be the duty of the City Building Inspector to establish and to promulgate rules and regulations relating to an orderly method of conducting the inspections necessary under this Section.
C. 
Change of ownership for purpose of this Section does not include a change in stock ownership of a corporation if the corporation continues in existence and the nature of the business in which the applicant is involved does not change, nor does it include changes of limited partners within a partnership if the nature of the business in which the applicant is involved does not change and the general partners remain the same.
D. 
It is the responsibility of the applicant for a business/merchant license to apply for an inspection of the premises from the City Building Inspector and to inform the City license officer if any of the above circumstances set forth in Subsection (B) exist.
E. 
The owner of a premises within the City of Lake Saint Louis shall inform the City of Lake Saint Louis City Administrator within thirty (30) days of a change of occupancy of the premises if a business begins conducting business at the owner's premises.
F. 
A fee of fifty dollars ($50.00) shall hereby be established for said inspection.
G. 
Any person, firm or corporation which violates the provisions of this Section shall be subject to the same penalties set forth in of the City Code.

There is hereby levied, fixed and ordered collected an annual license tax, unless a shorter period of time is indicated, upon the various things, objects, subjects, vocations, callings, persons and occupations within the City as follows:
Amusement parks. Miniature golf course and skating rink: $25.00/each.
Arborist, certified. Any owner or operator of a tree service, arboricultural firm or any business that performs work on trees greater than twelve (12) inches in diameter on public or private property and is ISA (International Society of Arboriculture) certified: $25.00.
Auctioneers. One (1) who sells, or offers to sell, any goods, wares, merchandise or other personal property or any real estate or any interest therein at any store, stand or other place of business within the City at public auction or outcry, whether the same be exempt from auction duty or not, or shall advertise or in any manner hold himself/ herself out as an auctioneer for public patronage and shall receive fees or any other compensation for his/her services: $20.00/$5.00 per day.
Automobile accessory dealers. Any person who shall buy, manufacture or assemble and sell or offer for sale any tires or other fixtures, appliances or accessories to or for automobiles, trucks or trailers except persons licensed as merchants: $100.00.
Automobile agencies. Any person who sells, trades or offers to sell or trade automobiles, trucks, trailers or buses which are not the property of such person, as the employee, agent or representative of a non-resident manufacturer, owner or dealer:
One (1) to six (6) employees: $100.00.
Seven (7) to twelve (12) employees: $125.00.
Thirteen (13) to twenty-four (24) employees: $200.00.
Over twenty-five (25) employees: $250.00.
Automobile dealers. Any person who shall buy for the purpose of sale or trade or who shall sell, trade or offer to sell or trade automobiles or other motor vehicles:
One (1) to six (6) employees: $100.00.
Seven (7) to twelve (12) employees: $125.00.
Thirteen (13) to twenty-four (24) employees: $200.00.
Over twenty-five (25) employees: $250.00.
Automobile garages. Any shop or place where automobiles or other motor vehicles are kept repaired, cleaned or oiled or let for hire, except the storage place for automobiles of the owner at the private residence of such owner: $75.00.
Bakeries. Any shop, stand, store or place where bread, cakes, cookies, doughnuts, pies, pastries and/or similar products are manufactured, prepared, sold or offered for sale, except a person who is licensed to do business as a merchant who sells, but does not manufacture such products: $50.00.
Banks: $300.00.
Barbers: See hair stylist.
Billiard tables. Each billiard or pool table set up and used for hire: $15.00.
Books, stationery dealers: $30.00.
Bowling alleys. Every bowling alley or ten (10) pin alley set up and used for hire: $5.00 per lane.
Brokers: See mercantile agents.
Brokers in merchandise. Each person having an office or other place of transacting business in the City not carrying a stock of goods and selling merchandise or goods of any kind for a commission or other compensation: $30.00.
Brokers in stocks, bonds, etc. Every person who buys, sells or offers to buy and sell stocks or shares in any corporation, joint stock company or association for money or property or on the weekly, monthly or other partial payment plan: $30.00.
Buses: $25.00 per bus.
Car wash or self-service laundry: $30.00.
Casualty companies: See fire insurance companies.
Cleaners and cleaning establishments. Any shop, stand or place of business where clothing or other articles are washed, cleaned or renovated: $50.00.
Collection agencies. Every person representing or holding himself/herself out as a collection agency or doing a general collection business for the public: $30.00.
Contractors — general. Any person who, in the capacity of an independent contractor, contracts with any business, property owner or person to perform a particular job or jobs, whether the remuneration received for performing the job or jobs is on a cost-plus basis, a flat sum basis or salary computed at so much per hour: $100.00/each.
Cosmetologists: See hair stylist.
Dance halls. Any place of business open to the public where dancing takes place and where there is music provided by an orchestra, band or mechanical means: $30.00.
Entertainments. Any public entertainment not otherwise taxed under this schedule: $5.00 per day; $30.00 per month.
Florist: See merchant.
Fur dealers: $30.00.
General fire insurance agents. Any person authorized to write fire, lightning, wind, cyclone, tornado, plate glass, burglary, casualty, accident and health insurance and to execute fidelity and security bonds: $25.00.
General life insurance agent. Any persons authorized to write life, accident and health insurance: $25.00.
Hair stylist. For the shop and one (1) hair stylist per year: $20.00.
Each additional hair stylist in the shop per year: $5.00.
Hotels or motels. Any place or establishment of rooms or more engaged in the renting of rooms to transients: $100.00.
Under fifty (50) rooms: $75.00.
Ice cream parlors. Any store, shop or place where ice cream, ices, sherbets or soft drinks are sold or served for consumption on the premises: $30.00.
Ice cream wagons. Any vehicle self-propelled, pushcart or any horse-drawn wagon that sells ice cream, ices, sherbets or soft drinks for consumption: For a period of one hundred twenty (120) days from date of issue: $25.00.
Job printing plants. Any person who does miscellaneous printing for hire: $50.00.
Laundries. Any person who washes or irons or offers to wash or iron clothing or fabrics for others, except such person who performs such service in his/her or his/her customer's private premises, and who operates not more than one (1) washing machine and two (2) hand irons in doing so: $50.00.
Loan companies. Any person who shall lend or offer to lend or negotiate the loan of any money belonging to himself/herself or another and who shall advertise money to lend, or one who purchases negotiable instruments and collects the same for the interest, including savings and loan associations: $150.00 per year.
Lumber dealers. Any person who buys, sells or deals in lumber or wood products. (See merchants): $30.00.
Lunch counters. Any stand or place where sandwiches, lunches and/or drinks are sold other than regular meals, and where tables and chairs are not provided for the customers: $30.00.
Machine shop. Any shop, stand or place of business maintaining or operating machines for making or repairing articles of wood, metal or equipment for others for a consideration: $100.00.
Manufacturers $1.00 per employee; with a minimum of: $75.00.
Merchants. A person who buys, sells or deals in any goods,wares or merchandise at any store, stand or place of business within the City, and not otherwise specifically taxed by this Article:
One (1) to three (3) employees: $50.00.
Four (4) to nine (9) employees: $100.00.
Ten (10) to fifteen (15) employees: $150.00.
Sixteen (16) to twenty-four (24) employees: $200.00.
Over twenty-five (25) employees: $250.00.
Mercantile agents and brokers. One who for a commission, brokerage fee or other compensation negotiates between owner and the purchaser or their respective agents for the sale of goods, wares and merchandise or other articles of commerce: $30.00.
Mobile food vendors. See Merchant and/or Transient Merchant. Additional requirements apply to mobile food vendors.
Nursery stock agent: See merchant.
Opera houses: See theaters.
Opticians. Selling of frames and/or prescription glasses: See merchant.
Outdoor advertising signs/structure. There shall be a fee of five hundred dollars ($500.00) for the initial inspection of an outdoor advertising sign/structure, and an annual fee of two percent (2%) of the gross annual revenue produced by the outdoor advertising sign/structure, within the City of Lake Saint Louis: $500.00.
Photographers. Any person, whether resident, transient or itinerant, engaging in the business of portrait or commercial photography or in the enlarging, copying, coloring or portrait finishing of photographs or soliciting or offering for sale any of such goods or services, directly or indirectly, verbally, by telephone, by mail, through the use of coupons or tokens of whatever nature, or by means of printed advertisements of any form, by subterfuge or otherwise, in the City: $50.00 per year; $5.00 per day.
Picture shows: See theaters.
Plumbers: See contractors and subcontractors.
Pool tables: See billiard tables.
Real estate brokers: $100.00.
Redi-mix concrete dealer: $100.00.
Repair shops: $25.00.
Restaurants. Any inn or establishment engaged solely or chiefly in the sale and serving of meals or lunches where tables and chairs are provided for the customer:
One (1) to six (6) employees: $50.00.
Seven (7) to twelve (12) employees: $75.00.
Thirteen (13) to twenty-four (24) employees: $125.00.
Over twenty-five (25) employees: $150.00.
Skating rinks: See amusement park.
Soft drink stand or vendors. Any person who sells soft drinks or non-alcoholic beverages, or any place where the same are sold or served: $15.00.
Special events. A person representing one (1) or more vendors who buys, sells or deals in any goods, wares or merchandise at any special event within the City, and not otherwise specifically taxed by this Article:
One (1) to twenty-five (25) vendors: $25.00.
Twenty-five (25) to fifty (50) vendors: $50.00.
More than fifty (50) vendors: $100.00.
Subcontractors. Any person who in the capacity of an independent contractor contracts with any contractor to perform a particular trade or job, whether the remuneration received for performing the job or jobs is on a cost-plus basis, a flat sum basis, or salary basis computed at so much per hour: $100.00/each.
Taxicabs: $25.00/each.
Theaters. Each public theater or motion picture show: $100.00.
Transient merchant. One who buys and sells merchandise, of any nature whatsoever, who is not a permanent merchant or who intends to continue in business in any one (1) place for a period of not more than one hundred twenty (120) successive days, per day: $10.00.
Wholesale gasoline dealers. Any person selling gasoline, oil and/or other petroleum products at wholesale, which business is commonly known as a "bulk station": $100.00.
Wholesale houses. Any house, store or establishment where goods wares and merchandise are kept and sold or offered for sale to retailers or others for resale by such purchasers: $50.00.
Wholesale merchants. Any person who sells or offers to sell any goods, wares or merchandise to retailers or to other persons for resale by such purchasers: $50.00.
If a person or company maintains a business office in accordance with the existing zoning regulations, in a non-residential zoning district, within the City limits for the purpose of providing any type service, trade, or avocation whatsoever, or conducting business transactions of any type with another party, providing said person or company is not engaged in interstate commerce or exempt from the application of a license by reason of a tax exempt status, the fee for such license shall be: $25.00.
Organizations registered with the State of Missouri as civic organizations or not-for-profit organizations maintaining a permanent establishment, open to the general public on a regular basis, or on occasion, engaged in providing enter- tainment to the general public, shall file an application for a business license with the City Clerk. Said application shall state the type organization, location, hours of operation, number of employees, if applicable, verification of Workers' Compensation insurance, if applicable, the annual fees shall be: $25.00.
A. 
Hereafter no person following for a livelihood the profession or calling of minister of the gospel, duly accredited Christian Science practitioner, teacher, professor in a college, priest, lawyer, certified public accountant, dentist, chiropractor, optometrist, chiropodist, or physician or surgeon in this City, shall be taxed or made liable to pay any municipal or other corporation tax or license fee of any description whatever for the privilege of following or carrying on such profession or calling, any law, ordinance or charter to the contrary notwithstanding.
B. 
No person following for a livelihood the profession of insurance agent or broker, veterinarian, architect, professional engineer, land surveyor, auctioneer, or real estate broker or salesman in this City, shall be taxed or made liable to pay any municipal or other corporation tax or license fee for the privilege of following or carrying on his/her profession unless that person maintains a business office within the City of Lake Saint Louis.

For the purpose of this Article, the term "employee" shall mean a full-time and part-time employee.

Any license issued for a part of the year, the fee shall be based on one-half (½) of the annual charge unless otherwise specified.

Any canvasser, solicitor or other person who may be exempt from the application of license, taxes or fees imposed by this Article by reason of engaging in interstate commerce shall, before engaging in any canvassing or solicitation in the City, register with the City license officer on forms provided by such officer.

Each registrant under the provision of Section 605.200 shall, at the time of making an initial application, the applicant shall pay to the City Clerk ten dollars ($10.00). In the event that the applicant's application to do business in the City of Lake Saint Louis is denied by the City Clerk, the applicant shall be refunded the sum of five dollars ($5.00), the remaining portion to cover the cost of investigation by the City of the proposed applicant. Applicant may appeal from such denial to the Board of Aldermen who should hear such appeal at their next regular meeting.

The City license officer shall refer each registration under Section 605.200 to the Police Chief who shall cause an investigation of the registration business and moral character of the registrant to be made as he/she deems necessary for the protection of the public.

Upon approval by the Police Chief the City license officer shall issue a registration certificate to each registrant to keep on his/her person at all times and shall upon demand display to Police and other officers of the City and to any citizen who so requests.

A. 
Any registration certificate issued under the provisions of Section 605.230 may be revoked by the City license officer for any of the following causes:
1. 
Fraud, misrepresentation or false statements made by the registrant on the registration form.
2. 
Fraud, misrepresentation or false statement made in the course of carrying on his/her business as a solicitor or canvasser.
3. 
Any violation of this Article.
4. 
Conducting the business of solicitation or of canvassing in an unlawful manner or in such manner as to constitute a breach of the peace or to constitute a menace to the health, welfare and safety of the community.
