The purpose of this chapter is as follows:
A. 
Protect the general health, safety and welfare of the residents of Pemberton Township and visitors to the Township.
B. 
Protect the docks, ramps, ramp areas and parking lots of the lakes of the Township of Pemberton.
C. 
Provide for an orderly procedure for the use of the Township's boat ramps and ramp areas by boaters and visitors alike.
As used in this chapter, the following terms shall have the meanings indicated:
NEW JERSEY STATE RESIDENT
A person owning a valid New Jersey driver's license which lists upon it the applicant's name and an address located within the State of New Jersey.
OUT-OF-STATE RESIDENT
All other applicants that are neither Pemberton Township residents nor New Jersey State residents as defined herein.
PEMBERTON TOWNSHIP RESIDENT
Any person who lives in the Township of Pemberton or owns a home therein.
A. 
No one shall be authorized to use any boat ramps or the designated parking areas reserved for persons with boat permits located within the Township of Pemberton without obtaining a permit from the Township. Applicants for a permit shall provide proof of a valid registration for the boat and trailer, if applicable. The permit will be assigned to the boat.
B. 
Permits for boat ramps and designated parking areas therefor shall be issued annually by the Township of Pemberton and shall be valid for the period of January 1 through December 31 of the year in which such permit was issued. The ramps and designated parking areas in the Township shall be closed to all boats and vehicles between the hours of 10:00 p.m. and 5:00 a.m. from January 1 to December 31.
C. 
Annual permit fees.
(1) 
Pemberton Township residents: free of charge.
(2) 
New Jersey State residents: $25 per year.
(3) 
New Jersey State residents/senior citizens: $20 per year.
(4) 
Out-of-state residents: $50 per year.
(5) 
Out-of-state residents/senior citizens: $40 per year.
(6) 
Permits shall be valid only for the calendar for which they are issued.
(7) 
The cost of permits shall not be prorated.
(8) 
Senior citizen eligibility shall be limited to individuals who have celebrated their 60th birthday as of the date of the application for the annual permit.
A. 
Upon issuance of a permit, the Township shall provide the applicant with a decal which shall be conspicuously located on the side of the boat at the port bow. If a trailer is used to launch the boat, then the Township shall provide the applicant with a duplicate decal which shall be conspicuously affixed to the left front of the boat trailer.
B. 
Upon issuance of a permit, the Township shall provide a hang tag which shall be placed on the vehicle review mirror at all times when the vehicle used to transport the boat is parked in the designated parking lot and/or the watercraft is on the waterway.
C. 
Parking shall be prohibited in the parking lot during those hours that the ramp is closed to the public. The Police Department shall be empowered to cause any vehicle parked in violation of these provisions to be towed away at the owner's expense.
A. 
Boat and lake restrictions.
(1) 
Boats may be propelled in any manner other than by motor or power artificially produced, except that boats propelled by electrical motors up to one horsepower shall be permitted. This provision shall not apply to events sponsored by the Department of Recreation and Senior Services or to drills and training authorized by the Pemberton Fire Director and conducted by the Pemberton Volunteer Fire Department, first-aid squads authorized to provide emergency medical services in Pemberton Township, and fire companies and first-aid squads from outside of the Township which are invited to participate in said drills and training.
(2) 
The mooring of boats shall not be permitted in the ramp or dock areas so as to restrict access to the ramp or dock.
(3) 
No boat shall be permitted to be tied to the municipal dock for a period in excess of 15 minutes.
(4) 
No obstruction shall be permitted which restricts the use of the ramp and dock areas by the public.
(5) 
Boats passing within the vicinity of the dock and ramp shall do so at slow speed so as to prevent the creation of wakes which may endanger the safety and welfare of the public.
(6) 
Jet ski boats are prohibited from launching from the dock.
B. 
Boat, trailer and parking area regulations.
(1) 
All boats and trailers using the municipal boat ramps and lakes shall have valid registrations and annual permits.
(2) 
There shall be no repairing of vehicles, boats or trailers or repair work of any type in the parking areas.
(3) 
There shall be no fishing allowed on the dock or in the ramp areas.
(4) 
There shall be no loitering on the dock or in ramp areas.
(5) 
There shall be no swimming at any time around the dock areas.
(6) 
Consumption of alcoholic beverages shall be prohibited on all public property regulated hereby.
(7) 
Bicycles shall not be permitted on the dock at any time.
(8) 
Walkways and other facilities through or by which access is gained to boats docked or moored shall be kept clear at all times. No supplies, equipment, or material of any kind shall be piled or placed thereon.
(9) 
Any conditions about or around a boat declared to be a fire hazard in the judgment of the Fire Official, Chief of the Fire Department or Assistant Chief shall be abated by the owner or person in charge of such boat as directed.
(10) 
Waste oil shall not be deposited or disposed of on any public property, including but not limited to lakes owned by the Township.
All persons using municipal boat launching ramps shall do so at their own risk. The Township assumes no responsibility for theft, loss or damage to any boats or motor vehicles or any equipment used in connection with them.
The provisions of this chapter shall be enforced by the Director of Community Development, his/her designees, and/or the Police Department.
Any person, firm, corporation, association or legal party who violates any one or more of the provisions of this chapter shall be subject to a fine of not more than $2,000 or to a period of imprisonment not to exceed 90 days or to a period of community service not to exceed 90 days, or any combination thereof, for each separate offense. In the case of a continuing violation or violations, such penalties may be assessed for each day that the violation or violations continue unabated, until such time as the violation or violations are corrected. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
