No person may discharge any firearm, including but not limited to a handgun, rifle, shotgun, starter pistol, flare gun, antique firearm or a reproduction thereof, or any other deadly or dangerous weapon of any kind, whatsoever, in the Town limits of Snow Hill.
A. 
Nothing in this chapter shall apply to any law enforcement officer, licensed security officer or investigator acting within the scope of his or her employment, an organized event authorized by the Mayor and Council or at an approved range operated within the Town limits of Snow Hill.
B. 
A person may discharge a firearm within the Town limits of Snow Hill so long as all of the following restrictions are satisfied:
(1) 
The person is engaged in hunting birds and/or waterfowl only;
(2) 
The firearm is a shotgun and the ammunition is limited to shot. Slugs are not permitted;
(3) 
The hunting activity is restricted to properties comprised of at least 200 acres;
(4) 
The person may not discharge the firearm within 300 yards of any of the following: a residence, a public or private school, or a day-care center;
(5) 
The person is acting in compliance with the rules and regulations set forth in the Maryland Guide to Hunting and Trapping, as well as other state or county statutes and regulations pertaining to hunting and the use of firearms;
(6) 
While hunting, the person shall be in possession of written permission from the landowner to engage in the hunting activity. A copy of the landowner's written permission shall be provided to the Town Clerk in advance of the hunting activity;
(7) 
While hunting, the person shall be in possession of written permission of the Mayor and Town Council to engage in the hunting activity. Written permission of the Mayor and Town Council to engage in the hunting activity shall only be issued once a copy of the written permission from the landowner has been provided to the Town Clerk. Written permission of the Mayor and Town Council shall include a statement of all the requirements of this subsection; and
(8) 
The Mayor and Town Council shall notify any affected landowner that written permission of the Mayor and Town Council has issued by providing a copy of the written permission via U.S. Mail, mailed to the landowner the same day written permission for the hunting activity is issued.
Any person violating the provisions of § 85-1 (firearms and other dangerous and deadly weapons) and/or § 85-2B (exceptions) shall be guilty of a misdemeanor and, upon conviction, may be fined up to $500 and/or incarcerated up to 30 days in the county jail for each offense, plus costs of prosecution.
