It shall be unlawful for any person to dig up, break, excavate, tunnel, undermine or cause to be made, any excavation in or under the surface of any street, alley, public or private property, by a mechanical digger, earth mover or by manual labor, excepting here from however any manually performed labor by pick and shovel or similar manual powered equipment on private property, unless such person shall first have obtained an excavation permit from the City as herein after provided.

A. 
Whenever it is necessary to place new or repair old underground work in any of the streets, alleys or public grounds of the City and it shall be necessary to cut, break or injure, any brick or asphalt, pavement or other pavement, the person desiring to have such work done shall make a written application to the City Clerk, stating what repairs are to be made and the location and size of the excavation, giving its length, breadth and depth.
B. 
Application for such permits shall be made at the office of the City Clerk and approved by the Mayor, subject to the regulations hereinafter provided. Such application may be waived in the event of an emergency during non-duty hours upon approval of the Mayor or Board of Aldermen.

A. 
Persons, firms or corporations desiring to make an excavation with any type of mechanical digger or earth mover or by manual labor shall first obtain the regular City license required by City ordinance to perform such services within the City.
B. 
Before being granted a City Excavation Permit, the applicant therefore shall furnish the City Clerk a certificate of effective public liability and property damage insurance equal to or more than ten thousand dollars ($10,000.00) for each person, thirty thousand dollars ($30,000.00) for each accident and ten thousand dollars ($10,000.00) for property damage.
C. 
The applicant shall also post a performance bond, in an amount to be determined by the City Clerk, but in no case less than fifty dollars ($50.00) for excavation. This bond shall be returned to the applicant upon completion of the work, less the cost of any correction work to bring the work up to the standards required by this Article.

Excavation work, either by machinery or manual labor, shall be performed or conducted not to interfere with access to fire stations or fire hydrants. Materials or obstructions shall not be placed within fifteen (15) feet of fire plugs.

A. 
Permittee working on the streets, alleys or private roads shall erect proper barriers for day time use and suitable flares so as to safeguard the flow of traffic.
B. 
Permittees crossing sidewalks or normal foot passage ways shall erect proper barriers so as to prevent individuals from falling into any excavation the permittee is responsible for.
C. 
Permittee shall not interfere with any existing utility without written consent of the owner of the utility.
D. 
Permittee shall not interfere with existing City water or sewage lines and shall not dig, by machine closer than three (3) feet to any existing sewer or City water lines. The last three (3) feet must be dug manually using extreme caution not to injure in any manner an existing line.
E. 
Permittee shall at all times make every effort not to interfere or injure any adjoining property and shall take appropriate protective measures.

A. 
It shall be unlawful for the permittee to allow unguarded at the place of excavation, any machinery, equipment or other device, having the characteristics of any attractive nuisance likely to attract children and become hazardous to their safety or health. The following procedures shall be followed when cutting and repairing the City streets.
1. 
Before digging, the area of blacktop to be removed must be precut with a diamond bladed saw.
2. 
After excavation, one hundred percent (100%) base rock only is used as a back fill, all excess rock and dirt is to be hauled from the site and properly disposed of.
3. 
The base rock is added to the excavated site area in six (6) inch lifts. Each lift is tamped by a mechanical tamper.
4. 
All black top cuts must be checked once a week to see if additional base rock is needed, it being required that only one-half (½) inch of rock exists on the top layer.
5. 
The cut is to be maintained with additional base rock as needed until the blacktop cut is repaired.
6. 
At the time of blacktop repair, the area surrounding the original cut is examined and if the same has been damaged, that area is cut and squared for repair.
7. 
Base rock is to be removed to allow for a patch equal in thickness to the original blacktop.
8. 
A hot tar pre-coat is applied to the base rock and the edges of the exiting blacktop.
9. 
New blacktop is installed and mechanically tamped to the height of the blacktop.
10. 
It is required that the cut be repaired if damage or sinking occurs within one (1) year after the date of completion of this work.

Resurfacing of all streets, alleys or traffic passageways excavated by the permittee under provisions of this Article shall be made and performed by the City, if so requested by permittee. Permittee shall bear the expense incurred by City while resurfacing said excavation.
