The City Council of the City of Pittston, recognizing the needs of select businesses in the Central Business District in the City of Pittston, hereby establishes a loading zone parking program which will accommodate the loading and unloading of vehicles.
A. 
The City of Pittston will promulgate and have available applications for loading zone parking signs. Said applications can be obtained at the City Administrator's office located at City Hall, 35 Broad Street, Pittston, Pennsylvania. Once the application has been completed, it will be submitted for review to the Traffic Committee of the City of Pittston.
B. 
Application fee. Upon submission of an application, the applicant shall pay a nonrefundable fee to the City of Pittston, in an amount as set by resolution of the City Council.
C. 
All approved applicants shall be required to file a renewal application by February 1 of each year in which the loading zone space is held. Renewal forms will be sent to the applicant each year in January. A nonrefundable renewal fee, in an amount as set by resolution of the City Council, must accompany the application.
D. 
Applications are to be completed in their entirety. Applications not completed in their entirety will not be considered.
E. 
Approval or denial of applications will be made within 60 days by the Traffic Committee of the City of Pittston ("issuing authority").
F. 
Upon approval of an application and payment of requisite fees, the City of Pittston will erect one or two reserved parking signs.
G. 
The Traffic Committee of the City of Pittston shall maintain a log of all applications for a loading zone parking permit.
A. 
It shall be unlawful for any person or owner of realty to erect a loading zone sign upon the streets of the City of Pittston without first making application to the Traffic Committee of the City of Pittston. Any person who erects or utilizes a loading zone sign who has not followed the requirements of this article is subject to penalties as set forth herein.
B. 
Any stipulations made at the time of application regarding the eligibility of an applicant may be updated periodically at the request of the issuing authority.
C. 
At each loading zone, the Traffic Committee shall install and maintain signs designating the commercial vehicle parking zone where the loading zone is located and stating the hours during which the provisions of the loading zone restrictions apply. Any business has the right to load or unload in that loading zone.
D. 
A vehicle may occupy the space up to the time limit either indicated on the sign or as authorized by the permit, but in no case for longer than one hour.
E. 
Loading zone signs shall not supersede existing parking regulations, including but not limited to current and/or future street sweeping bans or snow removal regulations.
F. 
Loading zone signs will remain the property of the City of Pittston.
G. 
The issuing authority will take the following factors into consideration when issuing loading zone signs:
(1) 
Overall availability of parking in the area where a sign is requested.
(2) 
Existing parking problems in the area where a sign is requested.
(3) 
Existing private driveway, off-street parking and/or garage space available to the business/applicant and its overall accessibility.
H. 
The Traffic Committee of the City of Pittston reserves the right to remove any loading zone signs for cause shown.
I. 
No loading zone sign will be placed in front of a business other than the applicant, unless the property owner signs a notarized statement that they have no objection to the placement of the sign.
A. 
Any person who parks in a loading zone who is not authorized to do so shall be subject to immediate citation, and the vehicle will be subject to immediate removal.
B. 
No person shall erect or maintain a loading zone sign upon the streets of the City of Pittston without authority under this article from the Traffic Committee of the City of Pittston.
C. 
It shall be the duty of police officers of the City of Pittston, acting in accordance with instructions issued by the Chief of Police, to report any vehicle parked in a loading zone in violation of this article, the state license number of such vehicle, and any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violations. Each such police officer shall also place on such vehicle a notice to the owner thereof that such vehicle has been parked in violation of the provisions of this article and instructing such owner to report at the Police Headquarters of the City of Pittston in regard to such violation. Each such owner will, within five days of the time when such notice was attached to such vehicle, pay at Police Headquarters as a penalty for and in full satisfaction of such violation the sum of $10 for parking in a loading zone lane.
D. 
Failure to make payment.
(1) 
The owner having failed to make payment within five days will be sent a notice demanding payment and shall pay a fine of $25 for loading zone lane violations and for violation of other parking regulations of the City of Pittston.
(2) 
Upon failure of each such owner to make payment at the City Treasurer's office within 10 days, a citation will be filed with the Magisterial District Judge having jurisdiction over the City. Upon the issuance of a citation, the fine for violation of this article shall be $25, plus costs, for loading zone lane violations and for violation of other parking regulations of the City of Pittston.
(3) 
The owner shall be notified as required by the rules governing the office of the Magisterial District Judge. Upon conviction before said Magisterial District Judge, such person shall, upon failure to pay fine and costs, be imprisoned in the Jail of Luzerne County for a period not exceeding two days for each offense.
